The Standard of Dilapidated Buildings Subject to Designation under District-Unit Plan


(Pursuant to Article 4)

1. Principle: Among buildings in the planned area, the number of buildings exceeding 20 years since a use permit was issued regarding them shall account for at least 2/3 or 1/2 of the total number of buildings in the area; and the number of multi-family houses and multi-household houses which have been more than 15 years since the completion permit was issued, shall account for at least 3/10 of the total number of buildings in such area: Provide, That this shall not apply to any of the following cases:

(a) The number of years elapsed since building of town houses with at least 20 households and apartments, among multi-unit buildings, shall be applied by the standards prescribed in Article 3 (1) 1 of the Seoul Metropolitan Government Ordinance on Urban and Residential Environment Maintenance;

(b) The degree of building deterioration shall not apply to an area determined in a district-unit plan prior to September 6, 2004, which was designated as a special planning area under Subparagraph 4 of Article 48 of the Decree for the purpose of constructing a multi-unit house;

(c) The degree of building deterioration shall not apply to the matters the Seoul Metropolitan Urban Planning Committee deems inevitable at its deliberation in order to standardize project sites or secure reasonable public facilities;

(d) The Mayor may determine a separate standard for old buildings, where a multi-unit house or a mixed-use building, including a long term-lease house established through a district-unit plan, is built in a quasi-residential zone;

(e) The degree of building deterioration shall not apply to a case where quasi-public rental houses (limited to where the total households are supplied as quasi-public rental house) under Article 6-2 of Rental Housing Act are supplied in a residential area and where the total building area of the buildings in the site, is less than 20/100 of the total size of the site;

(f) Other cases where the Mayor deems necessary to apply a lenient standard on the degree of building deterioration.

2. The Standard for calculation of the number of building blocks and the year elapsed:

(a) The the number of building blocks and the year elapsed, shall be calculated based on the building register: Provide, That the provisions of Article 2 (1) of the Seoul Metropolitan Government Ordinance on Urban and Residential Environment Maintenance, shall apply to the existing buildings constructed without permission;

(b) The number of households on the typical floor of a townhouse or an apartment building shall be included in the calculation of the number of building blocks;

(c) Where the existing buildings were demolished, the number of building blocks and the years elapsed, shall be verified with a building closure register: Provided, That this shall not be included in the calculation of the number of building blocks, where the relevant buildings were destroyed due to a natural disaster.
