SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON ESTABLISHMENT AND OPERATION OF CITIZENS COMMITTEE FOR OPERATION OF OPEN PLAZA

SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON ESTABLISHMENT AND OPERATION OF CITIZENS COMMITTEE FOR OPERATION OF OPEN PLAZA

Article 1 (Purpose) The purpose of this Ordinance is to prescribe the matters concerning operation of citizens committee for operation of open plaza assigned to the Seoul Metropolitan Government for deliberation of matters necessary for operation of Seoul Plaza, Cheonggye Plaza, and Gangwhamun Plaza. <Amended by Ordinance No. 5031, Sep. 27, 2010>

Article 2 (Relationship with Other Ordinances) This Ordinance shall apply to operation of Seoul Plaza, Cheonggye Plaza, and Gangwhamun Plaza (hereinafter referred to as “plaza”) except cases as specially provided in other Ordinances.

Article 3 (Establishment and Functions) The Seoul Metropolitan Government citizens committee for operation of open plaza (hereinafter referred to as “committee”) shall be established for deliberation of the followings: <Amended by Ordinance No. 5031, Sep. 27, 2010>
1. Matters concerning master plans and annual plans for operation of plaza;
2. Matters concerning determination of general criteria on operation of plaza;
3. Other important matters submitted by the Mayor of the Seoul Metropolitan Government (hereinafter referred to as “Mayor”) and the chairperson concerning use and operation of plaza.

Article 4 (Organization) (1) The committee shall be composed of within fifteen members including one chairperson.
(2) The chairperson and the vice chairperson of the committee shall be elected by and from among members.
(3) The members of the committee shall be appointed and entrusted from those of the following persons by the Mayor, and the members of subparagraphs 1 through 3 shall form a majority of the committee:
1. Academic experts and citizens having knowledge and experiences;
2. Representatives and officers of citizen’s organizations (organizations of Article 2 of the Assistance for Non-profit, Non-governmental Organizations Act);
3. Two members belonging to the standing committee under jurisdiction of the Seoul Metropolitan Council;
4. Public officials belonging to higher than the third grade of the Seoul Metropolitan Council.

Article 5 (Term) (1) The term of office of appointed members shall be two years and may be renewed once, and the term of office of the members of subpargraphs 2 through 4 of Article 4 (3) shall correspond to the period during which he/she holds the relevant position.
(2) The Mayor may dismiss a member from office when he/she desires resignation or is unable to perform his/her duties due to diseases, long term absence, injury to dignity, etc., and the term of office of a new member commissioned to fill a vacancy shall correspond to the remaining term of office of his/her predecessor.

Article 6 (Duties of Chairperson) (1) The chairperson shall represent the committee and administer all business affairs thereof.
(2) The vice chairperson shall act on behalf of the chairperson, if the chairperson is unable to perform his/her duties due to an unavoidable cause or event.

Article 7 (Meetings) (1) The chairperson shall call a meeting of the committee and preside over the meeting.
(2) Meetings of the committee shall be classified as regular meetings and special meetings.
(3) A regular meeting shall be held once a quarter as a rule, and a special meeting may be frequently held if the chairperson deems necessary therefor.
(4) Where the chairperson intends to hold a meeting, he/she shall notify the members, respectively, of the date and time, place and deliberation agenda seven days before opening the meeting: Provided, That it shall not apply if there are emergencies in need or unavoidable reasons.
(5) A majority of the members of the Committee shall constitute a quorum and any decision thereof shall require the concurring vote of a majority of those present.
(6) A meeting shall prepare and manage the minutes on which the followings are written, and the chairperson shall sign and seal or make signature on the minutes:
1. Date and time of a meeting;
2. Members present;
3. Deliberation agenda and details of deliberations and decisions;
4. Other matters deemed necessary by the chairperson.

Article 8 (Executive Secretary, etc.) (1) An executive secretary and a clerk shall be respectively assigned therein for management of affairs of the committee.
(2) The executive secretary shall be the head of the department which operates the committee under its jurisdiction (an official in charge), and the clerk shall be an assistant junior official.

Article 9 (Allowances, etc.) Allowances and travel expenses may be paid in the range of budget to the members attending a meeting: Provided, That it shall not apply in such cases a member of an official attends therein in direct connection with his/her duties.

Article 10 (Exclusion of Members) A member in the members of the committee who has interest in the relevant agenda shall be considered as a member who is not eligible for deliberations and decisions of the applicable agenda.

Article 11 (Detailed Rules of Operation) Matters which has not been determined by this Ordinance concerning operation, etc. of the committee shall be separately determined by the chairperson in resolution of the committee.

This Ordinance shall enter into force on the date of its promulgation.

Article 1 (Enforcement Date)
This Ordinance shall enter into force on the date of its promulgation.
