SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE COMMAND OF EMERGENCY RESCUE AT THE SCENE OF ACCIDENTS AND DISASTERS

SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE COMMAND OF EMERGENCY RESCUE AT THE SCENE OF ACCIDENTS AND DISASTERS

Article 1 (Purpose) The purpose of this Ordinance is to provide for matters necessary for establishing a command system at the scene of an accident or disaster in order to protect citizens' lives and property from various accidents and disasters and to promptly and efficiently conduct emergency rescue activities.

Article 2 (Definitions) (1) The terms used in this Article shall be defined as follows:
1. "Scene of an accident or disaster" (hereinafter referred to as "scene") means an area inside of the second control line set under Article 17 the Rule on Emergency Rescue and Response Activities and Field Command (hereinafter referred to as the "Ordinance of the Prime Minister") and a place where the duties specified in Articles 18 and 19 of the Ordinance of the Prime Minister are performed;
2. "Field commander" means any of the following public officials who shall command emergency rescue activities at the scene of an accident or disaster, among public officials of the Seoul Metropolitan Fire and Disaster Headquarters (hereinafter referred to as "Fire and Disaster Headquarters"):
(a) The head of the Seoul metropolitan emergency rescue and control unit: Chief Officer of the Fire and Disaster Headquarters;
(b) The head of the Seoul metropolitan emergency rescue command: The head of the Command and Control Team (or the head of a regional command headquarters) of the Fire and Disaster Headquarters;
(c) The head of the emergency rescue and control unit of an autonomous Gu: The head of the competent fire station;
(d) The head of the emergency rescue and control command of an autonomous Gu: The head of the team in charge of the competent fire station;
(e) The head of the first-arriving unit: The head of the fire-fighting unit arriving first at the scene.
(2) Other terms used in this Ordinance shall be defined in accordance with the Framework Act on Fire-Fighting Services, the Framework Act on the Management of Disasters and Safety, and the Act on 119 Rescue and Emergency Medical Services.

Article 3 (Mayor's Responsibility) The Mayor of Seoul Metropolitan City (hereinafter referred to as "Mayor") shall formulate and implement an emergency rescue and response plan annually so that field commanders can effectively command the scene of an accident or disaster.

Article 4 (Responsibilities of Field Commanders) (1) When an accident or disaster is feared to occur or has occurred, a competent field commander shall promptly take all measures necessary for protecting lives, bodies, and property of citizens to minimize damage.
(2) A field commander shall determine the situation based on information about the scene, and if deemed necessary, he/she may issue an emergency alert at the response phase.

Article 5 (Field Command) (1) A field commander shall direct the following matters:
1. Taking emergency measures to search for and rescue human lives and to minimize damage to property;
2. Deploying human resources and equipment from emergency rescue agencies and emergency rescue support agencies and assigning tasks to them;
3. Taking emergency measures to prevent further accidents or disasters;
4. Administering first aid to casualties and transferring them to medical institutions;
5. Managing supplies necessary for emergency rescue and deploying volunteers;
6. Conducting all other activities necessary for emergency rescue, including controlling access to the scene and controling traffic around the perimeter.
(2) If necessary, a field commander may install and operate an integrated field command post at a scene. In such cases, each emergency rescue support agency shall dispatch a liaison officer to the integrated command post.
(3) The scope of command of a commander by phase according to the scale of an accident or disaster, matters regarding the installation of a field command post, and the standard field command system shall be prescribed by Rules.

Article 6 (Emergency Rescue Support Activities) (1) A field commander may request the head of an emergency rescue support agency to provide human resources, supplies, etc. necessary for emergency rescue. In such cases, the head of an emergency rescue support agency shall comply with such requests, except in extenuating circumstances.
(2) When human and physical resources (hereinafter referred to as "resources") arrive at a scene, the liaison officer dispatched from the relevant emergency rescue support agency shall report the arrival to the field commander immediately and shall conduct field response activities for the missions assigned to him/her, under the command of the field commander.

Article 7 (Integrated Support Center) (1) If casualties or victims exist or if it is necessary to take measures for safety at the scene, a competent field commander shall notify the head of the competent autonomous Gu of relevant facts.
(2) Upon receipt of notice under paragraph (1), irrespective of whether a disaster safety response headquarters is in operation, the head of the competent autonomous Gu shall install and operate an integrated support center at a scene or shall dispatch a liaison officer.
(3) The head of the integrated support center or liaison officer under paragraph (2) shall proactively cooperate with the field commander, as requested, in conducting activities at a scene.

Article 8 (Transfer of Command) (1) When a field commander determines that activities at a scene have ceased, he/she shall transfer command to the head of the integrated support center or to the head of the accident cleanup headquarters, upon consultation with the relevant agency responsible for disaster management.
(2) When a field commander transfers command under paragraph (1), he/she shall provide relevant information and proactively cooperate, so that the scene can be smoothly cleaned.

Article 9 (Record-keeping) A field commander shall prepare and preserve a daily activity log book regarding activities at each scene.

Article 10 (Evaluation of Activities at Scene) A field commander shall conduct a comprehensive evaluation of emergency rescue support agencies pursuant to Chapter VIII of the Ordinance of the Prime Minister after an accident or disaster terminates.

Article 11 (Enforcement Rule) Matters necessary for enforcing this Ordinance shall be prescribed by Rules.
