SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON PREVENTION OF CHILD POVERTY AND SUPPORT OF CHILDREN

SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON PREVENTION OF CHILD POVERTY AND SUPPORT OF CHILDREN

Article 1 (Purpose) The purpose of this Ordinance is to prescribe necessary matters to ensure that impoverished children of the Seoul Metropolitan Government can grow into healthy members of society without being alienated or discriminated against in the aspects of welfare, education, culture, etc.

Article 2 (Definitions) The terms used in this Ordinance shall be defined as follows:
1. The term "child" means a child defined in subparagraph 1 of Article 3 of the Act on Prevention of Child Poverty, Support of Children, Etc. (hereinafter referred to as the "Act");
2. The term "child poverty" means a state of poverty in which a child is disadvantaged socially, economically, and/or culturally due to inadequate daily living conditions and lack of resources, as defined in subparagraph 2 of Article 3 of the Act;
3. The term "impoverished child" means a child defined in subparagraph 3 of Article 3 of the Act.

Article 3 (Mayor's Responsibility) (1) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") shall endeavor to prepare legal and institutional mechanisms necessary for implementing policies on impoverished children, such as welfare, educational, and cultural assistance, and to secure financial resources required for performing such affairs in a stable manner.
(2) In order to promote the safety, health, and welfare of impoverished children, the Mayor shall establish and execute policies to support impoverished children and their guardians and families.
(3) The Mayor shall formulate measures necessary to protect impoverished children from discrimination on any ground.

Article 4 (Relationship to Other Statues, Regulations, etc.) Except as otherwise expressly provided for in other statues, regulations, or other ordinances concerning prevention of child poverty and support of children, this Ordinance shall govern.

Article 5 (Formulation and Execution of Implementation Plans for Prevention of Child Poverty) (1) The Mayor shall formulate and execute an implementation plan for prevention of child poverty in the Seoul Metropolitan Government (hereinafter referred to as "implementation plan") annually to prevent child poverty.
(2) In order to facilitate formulating and executing the implementation plan referred to in paragraph (1) efficiently, the Mayor may conclude an agreement with the Superintendent of the Seoul Metropolitan Office of Education.
(3) To formulate the implementation plan referred to in paragraph (1), the Mayor shall conduct a fact-finding survey. <Newly Inserted Ordinance No. 6157, Mar. 24, 2016>

Article 6 (Establishment, etc. of Committee on Prevention of Child Poverty) (1) In order to deliberate on the following matters concerning prevention of child poverty and support of impoverished children, the Mayor shall establish the Seoul Metropolitan Committee on Prevention of Child Poverty (hereinafter referred to as the "Committee"): <Amended by Ordinance No. 6869, May 3, 2018>
1. Basic direction-setting for implementation plans referred to in Article 5, and relevant policies;
2. Matters concerning projects for the prevention of child poverty and support of children pursuant to Article 7;
3. Improvement of systems relating to policies on impoverished children, and allocation of subsidies from budgets;
4. Any other matters deemed necessary by the Mayor.
(2) The Seoul Metropolitan Child Welfare Deliberation Committee under the Seoul Metropolitan Government Ordinance on Establishment and Operation of Child Welfare Deliberation Committee shall act on behalf of the Committee referred to in paragraph (1).

Article 7 (Implementation, etc. of Projects) (1) In order to prevent child poverty and support children, the Mayor may conduct the following projects: <Amended by Ordinance No. 6869, May 3, 2018>
1. A project for surveys and research on prevention of child poverty and support of children;
2. A project for eduction for prevention of child poverty and support of children, and for improvement of their health;
3. A project for career counseling and education for the prevention of child poverty and support of children;
4. A project for education and employment support for parents of impoverished children;
5. Any other projects deemed by the Mayor necessary for preventing child poverty and supporting children.
(2) If necessary to implement the projects under paragraph (1), the Mayor may entrust the implementation thereof to a research institute, corporation, or organization which has specialization, human resources, and equipment relating to impoverished children. In such cases, the Mayor may subsidize expenses incurred therein, within the budget.

Article 8 (Enforcement Rule) Matters necessary for the enforcement of this Ordinance shall be prescribe by rule.

This Ordinance shall enter into force on the date of its promulgation.
