SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON ESTABLISHMENT AND OPERATION OF OPTIMAL GALLERY FOR THE PERSONS WITH DISABILITIES

Article 1 (Purpose) The purpose of this Ordinance is to prescribe matters necessary for establishing and operating a gallery for the persons with disabilities, etc. which provides them with the most suitable viewing environment in performance venues, etc. managed and operated by the Seoul Metropolitan Government, in order to substantially guarantee the right to access of persons with disabilities, etc. under Article 4 of the Act on the Guarantee of Convenience Promotion of Persons with Disabilities, Older Persons, Pregnant Women and Nursing Mothers, Etc. <Amended by Ordinance No. 5894, May 14, 2015; Ordinance No. 6386, Jan. 5, 2017; Ordinance No. 6726, Jan. 4, 2018>

Article 2 (Definitions) The definitions of terms used in this Ordinance shall be as follows: <Amended by Ordinance No. 6726, Jan. 4, 2018>
1. The term "persons with disabilities, etc." means persons with disabilities, senior citizens, pregnant women, nursing mothers, etc. who experience inconvenience in traveling, using facilities, accessing information, etc. in their daily lives;
2. The term "performance venue, etc." means facilities managed and operated (including any entrusted operation) by the Seoul Metropolitan Government among performance venues, assembly halls, convention centers and galleries under Article 7 of the Act on the Guarantee of Convenience Promotion of Persons with Disabilities, Older Persons, Pregnant Women and Nursing Mothers, Etc. (hereinafter referred to as the "Act") and Article 3 of the Enforcement Decree of the Act;
3. The term "optimal gallery seat" means a gallery seat built at a place most suitable for viewing and easy for moving and escaping within each facility for viewing;
4. The term "person concerned with a person with disabilities" means a person who enters into a gallery with a person with disabilities in order to assist him or her.

Article 3 (Relationship to Other Statutes, Regulations, and Ordinances of the Seoul Metropolitan Government) Except as otherwise provided in other statutes, regulations, and ordinances, this Ordinance shall apply to the establishment and operation of optimal gallery seats for persons with disabilities, etc. <Amended by Ordinance No. 6726, Jan. 4, 2018>

Article 4 (Establishment of Optimal Gallery Seats) (1) In each performance venue, etc., gallery seats for persons with disabilities, etc. prescribed in Article 8 of the Act and Article 4 of the Enforcement Decree of the Act shall be built as the optimal gallery seats. <Amended by Ordinance No. 5894, May 14, 2015; Ordinance No. 6726, Jan. 4, 2018; Ordinance No. 7164, May 16, 2019>
(2) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") shall reflect a plan for establishing optimal gallery seats for persons with disabilities, etc. when he or she evaluates any investment, loan, budget and design for performance venues, etc. in which the Seoul Metropolitan Government's budget is invested. <Amended by Ordinance No. 5894, May 14, 2015; Ordinance No. 6726, Jan. 4, 2018>

Article 4-2 (Management of Optimal Gallery Seats) An operator of a performance venue, etc. shall mark some of the gallery seats as optimal gallery seats for persons with disabilities, etc. for their convenient use.

Article 5 (Convenience Facilities) For the access of persons with disabilities etc. to and their convenient use of facilities, convenience facilities provided for in the Act shall be built near the optimal gallery seats. <Amended by Ordinance No. 6726, Jan. 4, 2018>

Article 6 (Gallery Seat for Persons Concerned with Persons with Disabilities) An operator of a performance venue, etc. or a person who is supervising the concerned event shall assign, near the optimal gallery seat for a person with disabilities, a gallery seat to be used by a person concerned with the person with disabilities.

Article 7 (Utilization of Optimal Gallery Seats) The Mayor shall devise measures, etc. to induce persons with disabilities, etc. to actively use optimal gallery seats. <Amended by Ordinance No. 5894, May 14, 2015; Ordinance No. 6386, Jan. 5, 2017; Ordinance No. 6726, Jan. 4, 2018>

Article 8 (Facilities Being Operated by Private Entities) For facilities operated by private entities, the Mayor shall actively recommend to establish optimal gallery seats for persons with disabilities, etc. <Amended by Ordinance No. 6726, Jan. 4, 2018>

Article 9 (Financial Support) Where the Mayor intends to improve the relevant facilities to ensure that a performance venue, etc. within his or her jurisdiction complies with the provisions under this Ordinance, he or she may fully or partially provide subsidies to cover the expenses. <Amended by Ordinance No. 5894, May 14, 2015>

ADDENDA
Article 1 (Enforcement Date)
This Ordinance shall enter into force on the date of its promulgation.
Article 2 (Transitional Measures concerning Existing Facilities)
Concerning performance venues, etc. being operated as at the enforcement date of this Ordinance, optimal gallery seats for persons with disabilities shall be established within two years after the date this Ordinance enters into force.
