SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON PRESERVATION, MANAGEMENT, ETC. OF HANYANGDOSEONG, THE SEOUL CITY WALL

Article 1 (Purpose) The purpose of this Ordinance is to prescribe matters necessary to promote the inscription of Hanyangdoseong, the Seoul City Wall, which has outstanding universal value worth preserving for all mankind, on the World Heritage List and to preserve and manage it.

Article 2 (Definitions) The terms used in this Ordinance are defined as follows:
1. The term "World Heritage" means heritage that the UNESCO's World Heritage Committee has inscribed on the World Heritage List under the Convention for the Protection of the World Cultural and Natural Heritage (hereinafter referred to as the "World Heritage Convention") upon acknowledging its outstanding universal value worth preserving for all mankind;
2. The term "tentative list" means a preliminary heritage list submitted to the UNESCO's World Heritage Committee in order to apply for inscription as World Heritage afterwards as heritage having value for inscription on the World Heritage List;
3. The term "heritage site" means a site occupied by World Heritage or heritage inscribed on the tentative list;
4. The term "buffer zone" means an area surrounding heritage designated to protect the heritage together with the natural environment and cultural landscapes surrounding the heritage.

Article 3 (Mayor's Responsibilities) (1) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") shall strive to inscribe Hanyangdoseong, the Seoul City Wall (hereinafter referred to as "Hanyangdoseong") on the World Heritage List.
(2) The Mayor shall systematically preserve and manage Hanyangdoseong to preserve its value as a world heritage site and to hand it down in its entirety to future generations.

Article 4 (Committee for Inscription of Hanyangdoseong on the World Heritage List) (1) The Mayor shall establish the Committee for Inscription of Hanyangdoseong on the World Heritage List (hereinafter referred to as the "Committee") to deliberate on the following matters concerning promoting the inscription of Hanyangdoseong on the World Heritage List, and the preservation and management of Hanyangdoseong:
1. Matters concerning promoting the inscription of Hanyangdoseong on the World Heritage List;
2. Matters concerning the preservation, management, and utilization of Hanyangdoseong and its surrounding areas;
3. Matters concerning the education and public relations activities on cultural heritage of Hanyangdoseong, and citizens' participation therein;
4. Other matters the Mayor deems necessary and refers for deliberation.
(2) The Committee shall consist of up to 35 members, including two co-chairpersons who are the Mayor and a civilian chairperson, and any particular gender shall not exceed 6/10 of the number of members commissioned under the main sentence of Article 21 (2) of the Framework Act on Gender Equality: Provided, That this shall not apply where any inevitable ground, such as lack of professionals of a particular gender in the relevant field, is deemed to exist, and the Working Committee on Gender Equality adopts a resolution thereon pursuant to the proviso of Article 21 (2) of the said Act. <Amended by Ordinance No. 6982, Jan. 3, 2019>
(3) The Mayor, the Vice-Mayor I for Administrative Affairs, the Chief Officer of the Culture Headquarters, the heads of autonomous Gus in the vicinity of Hanyangdoseong, the representatives of related agencies, such as the Cultural Heritage Administration, the Seoul Metropolitan Office of Education, and the Capital Defense Command, and public officials of the Seoul Metropolitan Government nominated by the Mayor shall be ex officio members; and the commissioned members shall be commissioned by the Mayor from among the following persons: <Amended by Ordinance No. 6982, Jan. 3, 2019>
1. Members of the Seoul Metropolitan Council;
2. The chairperson of the Hanyangdoseong Advisory Committee;
3. The president and vice presidents of the Korean National Committee of the International Council on Monuments and Sites;
4. Experts in the fields of world heritage and cultural heritage, the representatives of villages in the vicinity of Hanyangdoseong, the representatives of civic organizations, and the representatives of each field, such as religious circles, business circles, and media.
(4) In order to seek counseling on the matters prescribed by rule of the Seoul Metropolitan Government (hereinafter referred to as the "Seoul Government") concerning the preservation and management of Hanyangdoseong, the Hanyangdoseong Advisory Committee comprised of experts with extensive knowledge and experience shall be established as a subcommittee of the Committee.
(5) In order to consult and coordinate matters concerning the establishment and enforcement of policies for the preservation and management of Hanyangdoseong, the Hanyangdoseong Administration Council comprised of related persons belonging to the Seoul Metropolitan Government (hereinafter referred to as the "Seoul Government") and local governments shall be established as a subcommittee of the Committee.
(6) Except as otherwise expressly provided for in paragraphs (1) through (5), matters necessary for the composition of the Committee and subcommittees, terms of office of the members thereof, conducting meetings, etc. shall be prescribed by rule of the Seoul Government.

Article 5 (Establishment of Organization for Site Management and Research) (1) The Mayor may establish an organization for site management and research for the efficient preservation, management, and research of Hanyangdoseong.
(2) The organization for site management and research shall perform the following duties:
1. Routine repair and inspection, safety management, and preservation and restoration of Hanyangdoseong;
2. Inspection of and research into, and education and public relations activities regarding, Hanyangdoseong, and operation of programs for citizens' participation therein;
3. Other projects the Mayor deems necessary.

Article 6 (Formulation of Master Plans for Preservation and Management) (1) In accordance with the World Heritage Convention, the Mayor shall formulate a master plan necessary to preserve and manage Hanyangdoseong every six years.
(2) A master plan for preservation and management of Hanyangdoseong shall include the following:
1. Matters concerning the preservation and management of Hanyangdoseong;
2. Matters concerning the inspection of and research into, and education and public relations activities regarding, Hanyangdoseong, and operation of programs for citizens' participation therein;
3. Matters concerning the domestic and international exchange and cooperation related to Hanyangdoseong;
4. Other matters necessary for the preservation, management, etc. of Hanyangdoseong.
(3) In formulating a master plan, the Mayor shall undergo the procedures to gather consensus of interested parties in the villages in the vicinity of Hanyangdoseong. In such cases, the scope of interested parties, procedures for the consensus gathering, and other relevant matters, shall be prescribed by rule of the Seoul Government.

Article 7 (Heritage Sites and Buffer Zones) (1) The Mayor shall designate a heritage site and a buffer zone to protect the value of Hanyangdoseong as a World Heritage, its surrounding landscape, etc.
(2) A cultural heritage zone under Article 25 of the Cultural Heritage Protection Act and a protection zone of cultural heritage under Article 27 of the said Act, shall be a heritage site. <Amended by Ordinance No. 6982, Jan. 3, 2019>
(3) The preservation area of a historic and cultural environment under Article 13 of the Cultural Heritage Protection Act shall be a buffer zone. <Amended by Ordinance No. 6982, Jan. 3, 2019>

Article 8 (Management of Destroyed or Damaged Sections, etc.) (1) The Mayor shall strive to restore the original form of Hanyangdoseong through research, excavation, restoration, etc. of destroyed or damaged sections of Hanyangdoseong.
(2) The Mayor shall reflect matters necessary to preserve landscapes, etc. of destroyed or damaged surrounding areas of Hanyangdoseong, in metropolitan plans, master plans for rearrangement of urban and residential environments, etc.

Article 9 (Support to Private Sector) (1) In order to preserve and manage Hanyangdoseong and to enhance citizens' awareness thereof, the Mayor may support or promote the activities of related private organizations and local residents.
(2) In order to preserve the history, culture, villages, landscapes, etc. of areas in the vicinity of Hanyangdoseong, the Mayor may fully or partially subsidize the expenses to be incurred in the following or provide loans therefor: <Amended by Ordinance No. 6982, Jan. 3, 2019>
1. Expenses necessary for the installation, maintenance, operation, etc. of maintenance infrastructure and joint use facilities;
2. Expenses necessary for the preservation of history and culture resources and living culture resources;
3. Expenses for the installation, maintenance, operation, etc. of all types of facilities necessary for reenforcing identity of villages and vitalizing villages;
4. Expenses necessary for the installation, maintenance, operation, etc. of facilities required for the residents' right for settlement and stabilization of residence;
5. Expenses for the operation of programs for vitalization of local communities;
6. Other matters that the Mayor deems necessary in connection with the improvement of living environment and activities of village communities.
(3) Detailed matters, such as eligibility for support, and scope and methods of support under paragraphs (1) and (2), shall be separately determined by the Mayor. <Amended by Ordinance No. 6982, Jan. 3, 2019>
(4) The Mayor may provide subsidies, within the budget, to academic organizations or civilian experts to help them cover costs for travel and other activities associated with international exchanges, public relations, and academic conferences relating to Hanyangdoseong. <Newly Inserted by Ordinance No. 6982, Jan. 3, 2019>

Article 10 (Operation of Special Account, etc.) The Mayor may operate a special account, etc. to secure financial resources necessary for the preservation and management of Hanyangdoseong.

Article 11 (Relationship to Other Ordinances of the Seoul Government) Except as otherwise provided in other Ordinances of the Seoul Government, the preservation, management, and utilization of Hanyangdoseong shall be governed by this Ordinance.

Article 12 (Entrustment of Affairs) (1) If necessary for the preservation, management, and utilization of Hanyangdoseong, the Mayor may entrust some of such affairs to a corporation, organization, institution, or individual.
(2) Detailed matters concerning the procedures, methods, etc. for entrusting affairs under paragraph (1) shall be governed by the Seoul Metropolitan Government Ordinance on Entrustment of Administrative Affairs to the Private Sector. <Amended by Ordinance No. 6982, Jan. 3, 2019>

Article 13 (Enforcement Rule) Matters necessary for the enforcement of this Ordinance shall be prescribed by rule of the Seoul Government.
