SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON PHYSICAL ACTIVITIES FOR PROMOTION OF CITIZENS' HEALTH

SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON PHYSICAL ACTIVITIES FOR PROMOTION OF CITIZENS' HEALTH

Article 1 (Purpose) The purpose of this Ordinance is to contribute to the promotion of citizens' health by diffusing correct knowledge about health and by creating an environment in which citizens can practice a healthy life on their own in their daily lives so as to enhance citizens' values in health and their sense of social responsibility.

Article 2 (Definitions) The terms used in this Ordinance shall be defined as follows:
1. "Physical activities" means all activities of moving a person's own body, which take place in the course of daily life or business, including sports activities conducted as part of practice of a healthy life;
2. "Promotion of health" means the improvement of the level of physical, mental, and social health by practicing a healthy life;
3. "Encouragement of physical activities" means programs implemented under the National Health Promotion Act, the National Sports Promotion Act, and other statutes concerning the promotion of physical activities and health to encourage the promotion of citizens' health by increasing the amount of physical activities in their daily lives.

Article 3 (Relationships to Other Statutes and Regulations) Except as otherwise provided by other statutes and municipal ordinances, programs implemented by the Seoul Metropolitan Government (hereinafter referred to as the "Seoul Government") to encourage physical activities shall be governed by this Ordinance.

Article 4 (Responsibilities of Mayor, etc.) (1) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") shall implement programs for the following purposes in order to formulate relevant policies and establish a system for systematic administrative assistance in implementing the policies, with which the Seoul Government can encourage physical activities for the promotion of health of citizens of the Seoul Metropolitan Government (hereinafter referred to as "citizens"):
1. Formulating and implementing a comprehensive plan to encourage citizens' physical activities for practicing a healthy life;
2. Conducting research and development projects for encouraging physical activities and training experts for local communities;
3. Assistance to disadvantaged citizens in need of physical activities (infants, women, disabled persons, aged persons, etc.).
(2) The heads of autonomous Gus and organizations that engage in the promotion of health shall cooperate with the Mayor in the programs implemented by him/her under any subparagraph of paragraph (1), and relevant offices/bureaus shall mediate conflicting interests by collecting various opinions and cooperate with one another to improve efficiency of such programs.

Article 5 (Formulation, etc. of Master Plans for Encouraging Citizens' Physical Activities) (1) The Mayor shall formulate a master plan to encourage citizens' physical activities (hereinafter referred to as the "master plan") once every five years.
(2) Matters that shall be included in the master plan are as follows:
1. Formulation of strategies and goals for the programs for encouraging physical activities;
2. Tasks of encouraging physical activities for promoting health and methods therefor;
3. Schemes for management of human resources and procurement of financial resources for the programs for encouraging physical activities;
4. Other matters necessary for encouraging physical activities.
(3) The Mayor shall secure funds for necessary expenses incurred in implementing the master plan, within budgetary limits of the Seoul Metropolitan Government.

Article 6 (Formulation of Annual Implementation Plans for Encouraging Physical Activities) (1) The Mayor shall formulate annual implementation plans to encourage physical activities (hereinafter referred to as "implementation plans") on the basis of the master plan formulated under Article 5.
(2) Matters that shall be included in an implementation plan are as follows:
1. Formulation of strategies and goals for the programs for encouraging physical activities;
2. Annual goals for the master plan;
3. Annual plans for the operation of programs for encouraging physical activities, and each agency's missions, annual goals, and performance indicators;
4. Survey and research on programs for encouraging physical activities;
5. Improvement of citizens' awareness and creation of an environment for training, public relations activities, etc. for encouraging physical activities;
6. Installation of facilities and development and diffusion of programs for encouraging physical activities;
7. Securing and management of experts for programs for encouraging physical activities;
8. Review, analysis, and evaluation of performance of the implementation plan for the preceding year and reflection of the results thereof;
9. Other matters necessary for encouraging physical activities.

Article 7 (Organization, etc. of Committee for Promotion of Physical Activities) (1) The Mayor may organize and operate a committee for the promotion of physical activities (hereinafter referred to as the "Committee") in order to promote citizens' physical activities.
(2) The Committee shall deliberate and render advice on the following matters:
1. Formulation and amendment of a master plan for encouraging physical activities;
2. Evaluation and reflection of annual implementation plans;
3. Consulting or deliberation on important issues on encouragement of physical activities;
4. Other matters necessary for encouraging physical activities.
(2) The Citizen Health Committee of the Seoul Metropolitan Government under the Seoul Metropolitan Government Framework Ordinance on Management of Citizens' Health shall serve as the Committee under paragraph (1).

Article 8 (Team for Assistance in Programs for Encouraging Physical Activities) (1) The Mayor may organize a team for assistance in programs for encouraging physical activities so that experts from relevant fields can efficiently conduct preliminary examinations and perform their assignments. (2) Matters necessary for the organization and operation of a team for assistance in programs for encouraging physical activities shall be prescribed by municipal ordinance.

Article 9 (Allowances, etc.) Attendance allowances and travel expenses may be paid to the experts who attend a meeting of the team for assistance in programs for encouraging physical activities, within budgetary limits.

Article 10 (Evaluation of Plans) (1) The Mayor shall examine, analyze, and evaluate each agency's missions, goals, and performance indicators in the master plans and implementation plans and shall reflect the results thereof in administrative performance, etc.
(2) Major policies and programs in master plans and implementation plans shall be subject to evaluation.
(3) The Mayor may, when deemed necessary, designate various assistance programs involving administrative functions delegated by the State or cities to autonomous Gus, and subsidies, etc. as administrative affairs subject to evaluation.
(4) The Seoul Metropolitan Government Rule on Evaluation of Administrative Performance, etc. shall apply to the procedure and methods for evaluation.

Article 11 (Fostering of Programs for Encouraging Physical Activities) If the Mayor deems it necessary for fostering programs for encouraging physical activities, he/she may directly participate in programs or may fully or partially subsidize City-invested or City-funded institutions, autonomous Gus, related institutions and organizations, individuals, etc. for expenses incurred in such programs.

Article 12 (Delegation or Entrustment of Programs for Encouraging Physical Activities) (1) If the Mayor deems it necessary for fostering programs for encouraging physical activities, he/she may entrust part of administrative functions to City-invested or City-funded institutions, autonomous Gus, related institutions and organizations, individuals, etc.
(2) Matters concerning entrustment to the private sector shall be governed by the City-invested or City-funded institutions, autonomous Gus, related institutions and organizations, individuals, etc.

Article 13 (Awards, etc. for Exemplary Cases) The Mayor may search for exemplary cases for motivating participants in programs and award them.
