SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON RESTRICTIONS ON IDLING OF MOTOR VEHICLES

Article 1 (Purpose) The purpose of this Ordinance is to prescribe matters necessary for restrictions on idling of motor vehicles pursuant to Article 59 of the Clean Air Conservation Act. <Amended by Ordinance No. 4695, Sep. 30, 2008>

Article 2 (Definitions) The terms used in this Ordinance are defined as follows: <Amended by Ordinance No. 4695, Sep. 30, 2008; Ordinance No. 5659, Jan. 9, 2014>
1. The term "motor vehicle" means a motor vehicle under subparagraph 13 of Article 2 of the Clean Air Conservation Act (hereinafter referred to as the "Act"): Provided, That a motorcycle shall be excluded;
2. The term "motor" means a mechanism installed in a motor vehicle, converting natural energy to power (mechanical energy);
3. The term "idling" means running a motor when a motor vehicle is parked or stopped;
4. The term "anti-idling sign" means regulatory, instructional, and supplementary signs which are installed at no-idle zones.

Article 3 (Idle-Free Zones) (1) The whole area within the jurisdiction of the Seoul Metropolitan Government shall be idle-free zones where idling is restricted (hereinafter referred to as "idle-free zone").
(2) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the “Mayor”) and the head of an autonomous Gu (hereinafter referred to as the "head of a Gu") may designate no-idle zones in locations that need special restrictions on idling such as terminals, depots, parking lots, and school environmental sanitation and cleanup zones.
(3) The Mayor and the head of a Gu shall install at least one separate anti-idling sign in a no-idle zone to make them easily identifiable to citizens. <Amended by Ordinance No. 5659, Jan. 9, 2014>
(4) Anti-idling instruction signs placed at no-idle zones may be appended with a supplementary sign stating "Idling at no-idle zones may be subject to penalties without warning". <Newly Inserted by Ordinance No. 5659, Jan. 9, 2014>

Article 4 (Time Limit) (1) No motor vehicle operator shall idle for more than two minutes in an idle-free zone pursuant to Article 3 (1). <Amended by Ordinance No. 5821, Jan. 2, 2015>
(2) Notwithstanding paragraph (1), the time limit shall be five minutes only where the air temperature is at least 25 degrees centigrade above zero or lower than five degrees centigrade above zero: Provided, That the same shall not apply where the air temperature is not more than 0 degrees centigrade or at least 30 degrees centigrade above zero. <Amended by Ordinance No. 4695, Sep. 30, 2008; Ordinance No. 5659, Jan. 9, 2014; Ordinance No. 5821, Jan. 2, 2015>

Article 5 (Kinds of Restricted Motor Vehicles) Motor vehicles defined in subparagraph 1 of Article 2 shall be subject to idling restrictions: Provided, That this shall not apply to any of the following motor vehicles: <Amended by Ordinance No. 4695, Sep. 30, 2008, Ordinance No. 4791, May 28, 2009; Ordinance No. 6911, Oct. 4, 2018>
1. Emergency motor vehicles in active service, such as police cars, fire trucks, and ambulances, and motor vehicles corresponding thereto;
2. Motor vehicles which use a motor as power, such as freezer trucks, refrigerator vans, and garbage trucks;
3. Motor vehicles being serviced or repaired while running the engine is required: Provided, That the same shall not apply to motor vehicles being serviced or repaired using chemicals or the like without a purifier while their engine is running.

Article 6 (Installation of Anti-Idling Devices) (1) The Mayor may order the installation of an anti-idling device on motor vehicles prescribed by Ordinance of the Ministry of Environment, such as motor vehicles for mass transportation, to prevent air pollution and fuel loss due to idling.
(2) The Mayor may subsidize or lend part of necessary fund within budgetary limits to owners of motor vehicles who have been ordered to install an anti-idling device pursuant to paragraph (1).

Article 7 (Controlling Public Officials) (1) The Mayor or the head of a Gu may appoint a public official working in areas relating to the environment or to traffic administration as a public official dedicated to control over restrictions on idling (hereinafter referred to as "controlling public official") to have him or her perform his or her duties of control over idling. <Amended by Ordinance No. 4695, Sep. 30, 2008; Ordinance No. 4881, Nov. 11, 2009>
(2) When a controlling public official performs his or her control duties, he or she shall wear a cap or armband so that anyone may readily recognize that the relevant public official is performing his or her control duties, and shall carry equipment necessary for control, such as a watch for measurement, a thermometer, and a mobile phone. <Amended by Ordinance No. 4695, Sep. 30, 2008; Ordinance No. 4881, Nov. 11, 2009>

Article 8 (Methods of Control) (1) Where a controlling public official finds an idling motor vehicle in an idle-free zone, he or she shall warn its driver to stop idling. <Amended by Ordinance No. 4695, Sep. 30, 2008; Ordinance No. 4881, Nov. 11, 2009>
(2) A controlling public official shall start counting the idling time only after he or she issues a warning pursuant to paragraph (1): Provided, That where the driver is not in the vehicle and the idling motor vehicle is found on a no-idle zone, he or she shall start counting the time as soon as he or she finds the vehicle. <Amended by Ordinance No. 4791, May 28, 2009; Ordinance No. 4881, Nov. 11, 2009; Ordinance No. 5659, Jan. 9, 2014>
(3) Where the idling time measured pursuant to paragraph (2) exceeds the time limit referred to in Article 4, a controlling public official shall prepare a written confirmation in the attached Form and issue it to the driver of a motor vehicle. <Amended by Ordinance No. 4695, Sep. 30, 2008; Ordinance No. 4881, Nov. 11, 2009>

Article 9 (Raising Awareness and Providing Guidance) (1) The owner or manager of a no-idle zone shall raise awareness and provide guidance to users of the relevant area about the restriction on idling.
(2) The head of a Gu shall continuously raise awareness and provide guidance so as to prevent idling of motor vehicles in areas under his or her jurisdiction.

Article 10 (Imposition of Administrative Fines) (1) The Mayor or the head of a Gu shall impose an administrative fine of 50,000 won per violation on a person who violates this Ordinance, and collect such fine pursuant to Article 94 (4) 5 of the Act, and may reduce the amount imposed by up to 1/2 taking into account, among other things, the motive of the relevant violation and the result thereof. <Amended by Ordinance No. 4791, May 28, 2009; Ordinance No. 4881, Nov. 11, 2009; Ordinance No. 6016, Oct. 8, 2015; Ordinance No. 7217, Jul. 18, 2019>
(2) Where the Mayor or the head of a Gu imposes and collects an administrative fine referred to in paragraph (1), the Act on the Regulation of Violations of Public Order shall apply. <Amended by Ordinance No. 4791, May 28, 2009; Ordinance No. 4881, Nov. 11, 2009>

This Ordinance shall enter into force on January 1, 2013.
Article 2 (Transitional Measures concerning Idle-Free Zones)
Idle-free zones designated under the previous provisions before this Ordinance enters into force shall be deemed no-idle zones designated under the amended provisions of Article 3 (2).
