SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON SUPPLY AND MANAGEMENT OF SUPPORTED HOUSING

CHAPTER I GENERAL PROVISIONS Article 1 (Purpose) The purpose of this Ordinance is to prescribe matters necessary for supplying and managing supported housing for the residential stability of housing-disadvantaged people who need physical and mental care.

Article 2 (Definitions) The definitions of terms used in this Ordinance shall be as follows:
1. The term "supported housing" means rental housing supplied with support services for continued residence;
2. The term "support services for continued residence" means services provided to the occupants of supported housing together with residence so that they can maintain an independent and stable life;
3. The term "support service institution" means an institution that provides various services to occupants by utilizing supported housing.

Article 3 (Selection of and Support for Occupants-To-Be) (1) Any of the following persons shall be eligible for an occupant-to-be, and the relevant regulations, such as selection standards and procedures and order of priority, shall be separately determined by the Mayor within the scope prescribed by the relevant statutes:
1. A person aged 65 or above;
2. A person with a disability who falls under Article 2 (2) of the Act on Welfare of Persons with Disabilities;
3. A homeless person who falls under subparagraph 1 of Article 2 of the Act on Support for Welfare and Self-Reliance of the Homeless, Etc., and any other relevant person;
4. A mentally ill person who falls under subparagraph 1 of Article 3 of the Act on the Improvement of Mental Health and the Support for Welfare Services for Mental Patients;
5. Any other person separately determined by the Mayor.
(2) A Mayor and the president of the Seoul Housing and Communities Corporation (hereinafter referred to as the "Mayor, etc.") may lend or subsidize rental deposit and rent to an occupant-to-be within budgetary limits.
(3) The Mayor, etc. and each support service institution (hereinafter referred to as "service institution") shall provide the following support services for continued residence (hereinafter referred to as "support services") tailored to the characteristics of each occupant-to-be:
1. Support and consultation for move-in of occupants;
2. Support in management of housing facilities;
3. Support for continued residence, such as management of utility bills and rent overdue;
4. Support for social welfare services reflecting the characteristics and needs of residents;
5. Support for medical treatment and health care;
6. Employment consultation and support for self-reliance;
7. Connection with local community;
8. Various types of other public and social welfare services that the Mayor deems necessary.

Article 4 (Support for Service Institutions) The Mayor may provide the following support to service institutions within budgetary limits:
1. Support for funding and human resources, and investment in kind;
2. Costs incurred in providing support services;
3. Support for training professional human resources;
4. Other matters that the Mayor, etc. deems necessary.

Article 5 (Principle of Public Asset Preservation) Where a service institution is supported with assets in kind, such as public rental housing, from the Mayor, etc., it shall in principle return them to the Mayor, etc. in their original form when the project is terminated or discontinued: Provided, That if it is difficult to restore them to original state because there is a depreciation or a building, etc. in which residual value remains, they shall be returned in the form as at the time of discontinuation or termination of the project.

CHAPTER II SUPPLY, ETC. OF SUPPORTED HOUSING Article 6 (Formulation, etc. of Master Plans) (1) The Mayor shall formulate a master plan for supplying supported housing (hereinafter referred to as "master plan") every five years: Provided, That he/she may include it in the comprehensive housing plan referred to in Article 4 of the Seoul Metropolitan Government Framework Ordinance on Residence.
(2) The plan referred to in paragraph (1) shall include the following:
1. Matters concerning the construction and supply of supported housing, and financial support;
2. Standards and methods for selection of persons to whom supported housing is to be supplied;
3. Plans to provide support services;
4. Matters concerning the application of convenience facilities and universal designs;
5. Other matters that the Mayor deems necessary.
(3) The Mayor shall formulate an implementation plan that defines the detailed direction for implementation, etc. of the master plan for smooth supply of supported houses and provision of support services.

Article 7 (Supply of Supported Housing) The Mayor, etc. may supply the following housing as supported housing:
1. Public rental housing under subparagraph 1 (a) of Article 2 of the Special Act on Public Housing;
2. Publicly-constructed rental housing under subparagraph 1-2 of Article 2 of the Special Act on Public Housing;
3. Buy-to-rent public housing under subparagraph 1-3 of Article 2 of the Special Act on Public Housing;
4. Social Housing under the Seoul Metropolitan Government Ordinance on Support, etc. for Promotion of Social Housing;
5. Community housing under the Seoul Metropolitan Government Ordinance on Support, etc. for Invigoration of Community Housing.

Article 8 (Installation, etc. of Convenience Facilities) (1) The Mayor, etc. shall install convenience facilities reflecting the special requirements of occupants-to-be, such as their physical characteristics.
(2) The Mayor, etc. shall endeavor to apply universal designs inside and outside of supported housing.

CHAPTER III OPERATION AND MANAGEMENT OF SUPPORTED HOUSING Article 9 (Selection of Service Institutions) (1) The Mayor may select any of the following institutions as a service institution:
1. A non-profit-making juristic person under the Civil Act;
2. A public interest corporation under the Act on the Establishment and Operation of Public Interest Corporations;
3. A social welfare foundation under the Social Welfare Services Act;
4. Seoul Housing and Communities Corporation;
5. Any other institution that the Mayor deems to have the capacity to provide support services and to operate supported housing.
(2) The Mayor may separately determine the standards for selection and operation of service institutions.

Article 10 (Reporting on Projects) (1) Where a service institution receives any aid on cost, subsidy, etc. pursuant to Article 4, it shall file a report on the commencement of the relevant project to the Mayor at least seven days prior to the commencement of the project as separately determined by the Mayor.
(2) A service institution shall submit a performance result to the Mayor twice a year as separately determined by the Mayor, and, in any of the following cases, it shall submit a report on the result of the project within one month:
1. When the project is completed;
2. When the fiscal year ends;
3. When a decision is made to suspend or cancel the project;
4. Other cases where the Mayor requests to submit a report on the result of the project.
(3) The report on the result of a project under paragraph (2) shall be accompanied by the following documents:
1. Operation status and performance result;
2. Details of the execution and settlement of expenses, etc.;
3. Self-evaluation result;
4. Other documents determined by the Mayor.

Article 11 (Guidance and Supervision) (1) Where deemed necessary in relation to the operation, performance of affairs, etc. of a service institution, the Mayor may require the head of a service institution to file a report thereon or have relevant public officials to investigate or inspect books or documents of the service provider.
(2) If any matter is found to be illegal, such as the case where any statutes or terms and conditions of support are violated or any false content of the application is found, the Mayor may take necessary measures, such as requesting the relevant person to submit data and issuing a corrective order.
(3) Where a service institution that has received a financial support falls under any of the following cases, the Mayor may take necessary measures such as the cancellation or withdrawal of the decision to provide support, suspension or discontinuation of support, and recovery of support money already paid:
1. Where it has violated any statutes or terms and conditions of financial support;
2. Where it has filed an application by fraudulent or illegal means;
3. Where it has become unable to use any land or house planned to be used in the project plan;
4. Where it fails to implement all or part of support services without a justifiable reason.
(4) A service institution shall return the balance remaining after executing expenses and deposit interest, etc. accrued as a result of the settlement of expenses, and in such cases, it shall also submit the detailed statement of the expenditure and evidential documents.

CHAPTER IV SUPPORTED HOUSING MANAGEMENT COMMITTEE, ETC. Article 12 (Establishment of Supported Housing Management Committee and Its Functions) (1) The Mayor may establish the Supported Housing Management Committee (hereinafter referred to as the "Committee") for continuous supply of supported housing and preparation of efficient management thereof.
(2) The Committee shall deliberate or provide advice on the following matters:
1. Master plans and implementation plans;
2. Criteria for selection of occupants;
3. Method of selecting service institutions;
4. Determination of types of support services and methods of providing them;
5. Other matters requested by the Mayor.

Article 13 (Composition and Operation of Committee) (1) The Committee shall be comprised of at least 25 but not more than 30 members, including one chairperson and one vice chairperson, but in the case of commissioned members, members of either sex shall not exceed six tenths of the total number of members.
(2) The chairperson shall be appointed or commissioned by the Mayor from among members, and the vice chairperson shall be elected by and from among commissioned members.
(3) Members of the Committee shall be appointed or commissioned by the Mayor from among the following persons. In such cases, at least one person from among persons falling under each of subparagraphs 2 through 4 shall be commissioned as members, and the number of members commissioned as such shall be at least two-thirds of the total number of members:
1. One each public official of Grade IV or higher who is in charge of affairs related to housing policy and social welfare of the Seoul Metropolitan Government;
2. Any person who has experience of working as an executive officer, employee, or the representative of a corporation related to social welfare;
3. Any person who has experience of working as an executive officer, employee, or the representative of a non-profit, non-governmental organization related to housing;
4. Any person who has majored in academic fields related to construction, housing, or welfare, including social welfare, urban planning, and real estate, and has served as at least an associate professor or in an equivalent position at a university, college, or public research institute;
5. Other persons with extensive knowledge and experience in the field of housing welfare and social welfare.
(4) The term of office of a member shall be two years, and may be consecutively renewed only once: Provided, That the term of office of a supplementary member shall be the remainder of his/her predecessor's term of office.
(5) Where a member who falls under paragraph (4) is re-commissioned within one year after he/she has been dismissed, he/she shall be deemed to be consecutively commissioned.
(6) The chairpersons shall exercise overall control of the affairs of the Committee, and shall convene and preside over meetings of the Committee.
(7) The vice chairperson shall assist the chairperson, and if the chairperson is unable to perform his/her duties due to any extenuating circumstances, the vice chairperson shall perform duties of the chairperson on behalf of the chairperson.
(8) Where both the chairperson and the vice chairperson are unable to perform their duties due to any extenuating circumstances, the member nominated by the chairperson in advance shall perform such duties on behalf of the chairperson.
(9) A majority of all incumbent members shall constitute a quorum (a majority of those present shall be the members who fall under paragraph (3) 2 through 5), and any decision thereof shall require a concurring vote of at least a majority of those present. In such cases, the chairperson shall also have the voting right.
(10) The Committee shall have one executive secretary and several clerks, and the public official of Grade V of the division in charge of the Committee shall be the executive secretary.

Article 14 (Subcommittees) (1) If necessary for an efficient operation of the Committee, the Mayor may establish subcommittees.
(2) A subcommittee shall be comprised of at least five but not more than nine members elected by the Committee from among its members, and a member of the Committee may become members of two or more subcommittees.
(3) The chairperson of a subcommittee shall be elected by and from among the members of the subcommittee.
(4) A majority of all incumbent members shall constitute a quorum for a subcommittee meeting, and any decision thereof shall require a concurring vote of a majority of those present.
(5) Among matters subject to deliberation by a subcommittee, the subcommittee's deliberation and decision on the matters designated by the Committee shall be deemed the deliberation and decision of the Committee. In such cases, the executive secretary shall report the matters deliberated and decided by the subcommittee at the next Committee meeting.

Article 15 (Exclusion, Challenge, and Abstention of Members) (1) For impartial deliberation, any member who falls under any of the following cases shall be excluded from the deliberation of the relevant agenda:
1. Where the member has provided any service, advice, research, etc. with respect to the relevant matter subject to deliberation;
2. Where the member is directly interested in relation to the matter subject to deliberation.
(2) If any ground exists for which it would be difficult to expect a member to impartially perform his/her duties, a party to the deliberation of the Committee may file a request to the chairperson to challenge him or her.
(3) Any member may, if falling under paragraph (1) or (2), abstain from the deliberation of the relevant case voluntarily, and where any request for abstention is received, the relevant member shall be excluded from the deliberation of the relevant agenda.

Article 16 (Dismissal of Members) In any of the following cases, the Mayor may dismiss the relevant member even before the expiration of his/her term of office, and a member newly appointed to fill a vacancy occurring before the expiration of the term for which his predecessor was appointed shall serve for the remainder of such term:
1. Where the member becomes incapable of performing his/her duties due to a mental disorder;
2. Where the member voluntarily requests to be dismissed;
3. Where the member fails to abstain from the deliberation or conducts a wrongful act, despite the fact that there is an obvious conflict of interest due to which it is difficult to expect fairness in deliberation;
4. Where the member is deemed unsuitable as a member due to neglect of a duty, loss of dignity, or on any other reason.

Article 17 (Allowances) Allowances and travel expenses may be reimbursed, within budgetary limits, to members who attend a meeting of the Committee, as prescribed by the Seoul Metropolitan Government Ordinance on Reimbursement of Allowances and Travel Expenses for Council/Committee Members.

Article 18 (Cooperation with Related Institutions) If necessary for the smooth supply of supported housing and its settlement in the regional community, the Mayor, etc. may cooperate with academic associations, private organizations, etc., such as universities, colleges, and academic societies, and in such cases, he/she may provide budgetary and administrative support.

Article 19 (Education and Publicity) The Mayor, etc. shall strive to enhance public awareness through such means as education and publicity activities utilizing diverse media for efficient promotion of supported housing-related projects, and in such cases, he/she may provide budgetary and administrative support.
