SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON CREATING AND SUPPORTING A CULTURE OF INTEGRITY

CHAPTER I GENERAL PROVISIONS Article 1 (Purpose) The purpose of this Ordinance is to provide for necessary matters to create and spread a culture of integrity among public officers in the Seoul Metropolitan Government, thereby fully implementing impartial and transparent government policies and gaining full confidence from the citizens of Seoul.

Article 2 (Definitions) The terms used in this Ordinance are defined as follows: <Amended by Ordinance No. 7557, May 19, 2020>
1. The term "public officers" means persons working in affiliated and subordinate agencies under the jurisdiction of the Seoul Metropolitan Government and falling under any of the following:
(a) Public officials prescribed in the Local Public Officials Act and fire officers prescribed in the State Public Officials Act;
(b) Public service employees prescribed in the Seoul Metropolitan Government Regulations on Public Service Workers;
(c) Executives and employees working in contributed, invested, or funded agencies;
(d) Private persons performing public duties prescribed in the Improper Solicitation and Graft Act;
2. The term "contributed, invested, or funded agencies, etc." means public corporations or public agencies established by the Seoul Metropolitan Government pursuant to the Local Public Enterprises Act, and organizations or agencies invested and funded by the Seoul Metropolitan Government pursuant to the Seoul Metropolitan Government Ordinance on the Operation of Agencies invested and funded by the Seoul Metropolitan Government.

Article 3 (Responsibilities of Mayor of the Seoul Metropolitan Government) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") shall endeavor to create labor conditions conducive for public officers to perform their duties impartially and disinterestedly.

Article 4 (Obligations of Integrity of Public Officers) Public officers shall comply with statutes and shall perform their duties impartially and disinterestedly; and no public officers shall engage in all the acts of corruptions and demeaning behaviors.

Article 5 (Formulation and Promotion of Comprehensive Plans for Creation of Culture of Integrity) (1) The Mayor shall formulate and promote an annual comprehensive plan for creating a culture of integrity (hereinafter referred to as "comprehensive plan") to create and spread the culture of integrity.
(2) Each comprehensive plan shall include the following:
1. Current status including integrity assessment results for the preceding year;
2. Basic direction-setting for creating a culture of integrity;
3. Objectives and strategies to promote the creation of a culture of integrity;
4. Creating and educating about a culture of integrity;
5. Publicizing a culture of integrity;
6. Other matters deemed necessary by the Mayor to create a culture of integrity.
(3) The Mayor may collect opinions from citizens or civilian specialists, etc. when formulating and implementing each comprehensive plan.

Article 6 (Projects for Invigorating Culture of Integrity) The Mayor may promote the following projects to invigorate a culture of integrity:
1. Projects for education and publicity;
2. Projects related to experience and practice of a culture of integrity:
3. Projects to research and investigate integrity and corruption cases;
4. Other projects deemed necessary by the Mayor.

Article 7 (Collaboration System) The Mayor shall build a collaboration system with agencies or organizations, etc. related to create a culture of integrity.

Article 8 (Formation of Task Force on Integrity Policies) The Mayor may form a task force on integrity policies within the Seoul Audit and Inspection Commission and may support promotion of feasible integrity policies to raise awareness of integrity within the relevant organization.

CHAPTER II ADVISORY COMMITTEE FOR INTEGRITY POLICIES Article 9 (Establishment of Advisory Committee for Integrity Policies) (1) An advisory committee for integrity policies affiliated with the Seoul Audit and Inspection Commission (hereinafter referred to as the "Committee") may be established to provide advice to the Mayor about creating a culture of integrity.
(2) The Committee may provide advice and submit a proposal about the following matters:
1. Formulating a comprehensive plan for creating a culture of integrity;
2. Improving systems through feedback following the monitoring and evaluation of the whole process to implement policies;
3. Submitting a proposal for feasible policies based on the views of citizens as policy demanders.

Article 10 (Composition of Committee) (1) The Mayor shall appoint or commission Committee members from among persons acknowledged as those with substantial knowledge and experience or expertise related to anti-corruption and integrity, who engage in the fields such as academics, law, media, economy, and civil society groups.
(2) The Committee shall be comprised of up to 15 non-standing members including one chairperson and one vice-chairperson, respectively; however, the chairperson and the vice-chairperson shall be elected by and from among the members.
(3) Committee members shall serve a term of two years; and may serve only one term: Provided, That a member filling a vacancy of the Committee shall serve the remaining term of his/her preceding member.

Article 11 (Operation of Committee) (1) The Committee chairperson shall represent the Committee and take overall charge of the affairs of the Committee.
(2) Where the chairperson is unable to perform duties due to extenuating grounds, the vice-chairperson shall perform the duties on behalf of the chairperson; and where both the chairperson and the vice-chairperson are unable to perform the duties due to extenuating grounds, a Committee member pre-designated by the chairperson shall perform the duties of the chairperson.
(3) One executive secretary shall be appointed in the Committee; and the executive secretary shall become an audit officer.
(4) Committee meetings shall consist of regular meetings and special meetings.
(5) Each regular meeting shall be held once a year; and each special meeting may be called where deemed necessary by the Committee chairperson.
(6) Where the chairperson intends to call a meeting, he/she shall notify each Committee member of the date, time, and agenda of the meeting by at least seven days before the meeting is held: Provided, That the forgoing shall not apply where the relevant issues require emergency action.
(7) The Committee shall prepare and keep minutes including the following matters; and the chairperson shall affix his/her name and seal or signature to minutes:
1. Date, time, and venue of a meeting;
2. Committee members present in the meeting;
3. Agenda and details deliberated;
4. Other matters deemed necessary by the chairperson.

Article 12 (Committee Allowance) Allowances, etc. may be paid to Committee members who attend the Committee within budgetary limits according to the Seoul Metropolitan Ordinance on the Payment of Committee Allowances and Travel Expenses.

CHAPTER III OPERATION OF INTEGRITY COMPLIANCE PROGRAM Article 13 (Integrity Compliance Program) The term "Integrity compliance program" means internal system for management, supervision, and education, which is established and operated autonomously by affiliated agencies under the jurisdiction of the Seoul Metropolitan Government to prevent corruption of their members and assist the members in performing administrative affairs proactively.

Article 14 (Designation as Integrity Compliance Officers and Operation of Integrity Compliance Program) The affiliated agencies, including offices, headquarters, or bureaus, and contributed, invested, or funded agencies shall designate integrity compliance officers independently for each affiliated agency to perform affairs pursuant to Article 15.

Article 15 (Operation of Integrity Compliance Program) The affiliated agencies, including offices, headquarters, or bureaus, and contributed, invested, or funded agencies shall endeavor proactively to operate an integrity compliance program, including performing the following affairs:
1. Strengthening the leadership of each affiliated agency with integrity;
2. Designating integrity compliance officers and securing budget;
3. Providing education and public relations to spread a culture of integrity;
4. Identifying corruption factors and enhancing monitoring of corruption behaviors;
5. Formulating measures to prevent a recurrence of corruption and improving systems for such prevention.

Article 16 (Evaluation of Integrity Compliance Program) (1) The Mayor shall inspect and evaluate the following matters biannually in the first half and second half of a year to operate an integrity compliance program based on a solid foundation:
1. Necessary matters including investigating, diagnosing, evaluating, and inspecting current status implemented by the integrity compliance program in the first half of a year;
2. Evaluating performance of operation of the integrity compliance program.
(2) The Mayor may form and operate a compliance committee to evaluate performance of operation of the integrity compliance program prescribed in paragraph (1) 2.

Article 17 (Provision of Incentives) The Mayor may provide outstanding agencies with incentives, including awarding prizes, using results made by evaluating performance of operation of an integrity compliance program for each agency; and the Seoul Audit and Inspection Commission may take necessary measures for the relevant agency, including deferring of audit.

CHAPTER IV CREATION OF CULTURE OF INTEGRITY Article 18 (Meetings for Creating Culture of Integrity) (1) The Mayor shall endeavor to improve integrity levels of the Seoul Government, including holding at least one meeting for creating a culture of integrity annually.
(2) Meetings for creating a culture of integrity shall contribute to enhancing integrity levels of the Seoul Government, following analysis on results of integrity levels investigated by the Anti-Corruption Survey and Evaluation Division and of fragile corruption factors.

Article 19 (Evaluation of Integrity) (1) The Mayor may evaluate each internal agency annually to create a culture of integrity within the relevant organization (hereinafter referred to as "evaluation").
(2) The Mayor may the entrust evaluation process to external agencies, including surveys, to seek impartiality and objectiveness for evaluation.

Article 20 (Surveys on Integrity) (1) The Mayor may conduct a survey, including an annual survey of citizens, to prevent the occurrence of corruption in processing major affairs for citizens and identify complaints filed by citizens.
(2) The Mayor may entrust external specialty agencies with surveys on integrity to seek impartiality of the surveys.
(3) Surveys on integrity shall be conducted in the following:
1. Fields related to construction and service contract management and supervision;
2. Fields related to providing subsidies;
3. Fields of civil affairs;
4. Other fields of affairs deemed necessary by the Mayor.

Article 21 (Formation and Operation of Integrity Supporters) (1) The Mayor may designate and operate integrity and audit officers as integrity supporters by department in offices, bureaus, or headquarters (including branches), and agencies that received contribution, investment, or funding to draw the attention of employees about integrity and contribute to spreading a culture of integrity within the relevant organization.
(2) Integrity supporters shall perform the following affairs:
1. Implementing and managing an integrity compliance program to voluntarily practice integrity;
2. Identifying, monitoring, and inspecting corruption risk factors in corruption-prone fields by department; receiving corruption reporting; and proposing and promoting improvement measures by department;
3. Submitting reports to integrity compliance officers concerning necessary matters including the current status of operation of integrity supporters and the result of inspecting the occurrence of corruption;
4. Spreading a voluntary culture of integrity within the relevant organization, including provision of education of integrity that is suitable for the characteristics of the organization.
(3) The Mayor may award prizes to excellent integrity supporters who have improved corruption-prone fields and produced excellent results in enhancing integrity levels by department in the affiliated agencies including offices, headquarters, bureaus, or branches, and agencies that received contribution, investment, or funding.

Article 22 (Formation and Operation of Citizens' Integrity Monitoring Group) (1) The Mayor may form and operate the Citizens' Integrity Monitoring Group (hereinafter referred to as the "Monitoring Group") to formulate integrity policies that can strengthen cooperation and governance between the private and public sectors and gain confidence from citizens.
(2) The Monitoring Group may be formed through open recruitment including public participation on the Internet, targeting the citizens of Seoul domiciled in Seoul Metropolitan City.
(3) The Monitoring Group may perform Seoul Metropolitan Government-wide monitoring of the affairs such as including authorization and permission, construction and service, and civil complaints process; and various activities to keep Seoul from corruption.

Article 23 (Education and Public Relations of Integrity) (1) The Mayor shall educate public officers periodically at least once a year to build their attitude of integrity and encourage them to perform their obligation of integrity.
(2) The Mayor may systematically perform activities of anti-corruption and integrity, including operation of Integrity Weeks, holding of activities of integrity supporters, and hosting of presentations for exemplary anti-corruption cases, to spread a culture of integrity within the relevant organization.
(3) The Mayor shall perform activities of public relations for citizens to participate in improvement of integrity levels, including proactively advertising of policies to improve integrity levels in the Seoul Metropolitan Government.

CHAPTER V OPERATION OF HAJEONG CHEONGBAENGNI AWARDS Article 24 (Hajeong Cheongbaengni Awards) The Mayor may present the Seoul Metropolitan Government's Hajeong Cheongbaengni Awards (hereinafter referred to as the "Hajeong Cheongbaengni Awards") to public officials of the Seoul Metropolitan Government and of its autonomous Gus who have displayed integrity and honesty, and dedicated themselves to providing public service, following selection procedures.

Article 25 (Types of Awards and Number of Winners) The types of the Hajeong Cheongbaengni Awards are the Highest Award and Major Awards; the Highest Award shall be presented to one person; and the Major Awards shall be presented to two persons: Provided, That the number of winners may be changeable in extenuating circumstances.

Article 26 (Selection Procedures) (1) The Director-General of the Seoul Audit and Inspection Commission shall verify, through public verification and field verification, award candidates recommended from offices, bureaus, or headquarters, branches, and autonomous Gus through their own committee for deliberating on achievements, and shall submit award nominations to the Seoul Metropolitan Government's Hajeong Cheongbaengni Awards Commission prescribed in Article 27 (hereinafter referred to as the "Awards Commission") to deliberate on such nominations.
(2) The Awards Commission shall select winners of the Hajeong Cheongbaengni Awards, following deliberation based on award candidates' integrity, honesty, dedication, public service, integrity in both public and private life, and contribution to building a sound social ethos: Provided, That no winner may be selected where the award candidates fail to meet requirements for award purposes.

Article 27 (Hajeong Cheongbaengni Awards Commission) (1) The Awards Commission may be formed and operated to examine achievements of award candidates for the Hajeong Cheongbaengni Awards and determine winners.
(2) The Awards Commission shall be comprised of up to 17 members including external members and internal members. The internal members shall consist of the Director-General of the Seoul Audit and Inspection Commission and one public official in at least Grade 3 employed in the Seoul Metropolitan Government, and the external members may consist of members of the Advisory Committee for Integrity Policies.
(3) The Awards Commission chairperson and vice-chairperson shall be elected by and from among Awards Commission members; and where the Awards Commission chairperson is unable to perform duties due to extenuating grounds, the Awards Commission vice-chairperson shall perform the duties on behalf of the Awards Commission chairperson.
(4) The Awards Commission shall deliberate on the following:
1. Matters concerning selecting and canceling the Hajeong Cheongbaengni Awards;
2. Matters concerning determining award grades for the Hajeong Cheongbaengni Awards;
3. Other matters submitted for consideration by the Award Commission Chairperson.
(5) Awards Commission meetings shall be held when a majority of Awards Commission members is present, and Awards Commission resolutions shall be passed by an affirmative vote of a majority of Awards Commission members present.
(6) The Awards Commission shall be dissolved automatically on the date following the date the Hajeong Cheongbaengni Awards are presented.
(7) Detailed matters concerning operating the Awards Commission shall be determined by the Awards Commission chairperson, following resolutions passed by the Awards Commission.

Article 28 (Award Certificates and Cash Awards, etc.) (1) The Mayor shall present award certificates, award plaques, and cash awards, etc. to winners.
(2) Where each winner's achievements turn out to be those of a third person or be false after the Awards Commission presents an award to such winner, such presentation shall be canceled; and such award plaque and cash award, etc. shall be returned to the Awards Commission.

Article 29 (Accepting Awards on Behalf of Winners) Where a winner is unable to receive an award in person at the relevant ceremony due to the death of the winner himself/herself or extenuating circumstances, the award may be presented to his/her bereaved family or a person acting on behalf of the winner.

Article 30 (Detailed Regulations) Detailed matters concerning enforcing this Ordinance shall be determined separately.

ADDENDA
Article 1 (Enforcement Date)
This Ordinance shall enter into force on the date of its promulgation.
Article 2 (Transitional Measures)
Ongoing or processed affairs the date this Ordinance enters into force shall be deemed processed affairs pursuant to this Ordinance.
Article 3 (Repeal of Other Ordinances)
The Seoul Metropolitan Government Ordinance on Operating the Hajeong Cheongbaengni Awards is repealed simultaneously.
ADDENDUM <Ordinance No. 7557, May 19, 2020>
This Ordinance shall enter into force on the date of its promulgation.
