SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON WELFARE AND LIVELIHOOD SUPPORT FOR FLOPHOUSE RESIDENTS

Article 1 (Purpose) The purpose of this Ordinance is to protect the right of flophouse residents in Seoul to lead a decent human life in accordance with the Act on Welfare and Self-Reliance Support for Homeless Persons, etc. and to help create a foundation that will stabilize the lives of these residents and promote their welfare.






Article 2 (Definitions) The terms used in this Ordinance are defined as follows:
1. The term "flophouse residents" refers to those who live in areas where flophouses are concentrated, which are determined by the Mayor;
2. The term "flophouse resident support facility" refers to the following facilities:
a. Flophouse Counseling Center: A facility that provides counseling and welfare services for flophouse residents;
b. Institutions or facilities that promote the welfare of flophouse residents designated by the Mayor or the head of a district.
3. The term "employees of flophouse residents support facilities" refers to the head of flophouse resident support facilities and their employees at flophouse resident support facilities, i.e., individuals who are in charge of the protection, counseling, welfare service connection, and welfare of flophouse residents.






Article 3 (Duties of the Mayor) (1) The Mayor of Seoul Metropolitan City (hereinafter referred to as the "Mayor") shall endeavor to manage the safety of the residential environment and promote a stable livelihood for flophouse residents.
(2) The Mayor shall cooperate with relevant private organizations to smoothly promote support projects for flophouse residents.






Article 4 (Scope of Application) Except as specifically provided for in the Act, the provisions of this Ordinance shall apply.






Article 5 (Establishment of Welfare and Livelihood Support Plans for Flophouse Residents) (1) The Mayor shall establish and implement a comprehensive plan for the welfare and livelihood support of flophouse residents every three years. In this case, efforts shall be made to link the plan to major health, housing, and family policies of the city.
(2) Matters in each of the following subparagraphs shall be included in the establishment of a comprehensive plan under paragraph (1):
1. Basic goals and direction of welfare policy for flophouse residents;
2. Evaluation of current status and performance of support for flophouse residents;
3. Matters concerning health and medical support for flophouse residents;
4. Matters concerning support for flophouse residents support facilities;
5. Matters concerning job and housing support for flophouse residents;
6. Matters concerning the establishment of a private sector cooperation system and the cooperation;
7. Other matters deemed necessary by the Mayor.
(3) Before establishing a comprehensive plan, the Mayor shall collect the opinions of autonomous districts, experts, related institutions and organizations, and citizens, etc., and endeavor to reflect their opinions.






Article 6 (Fact-Finding Investigation) (1) The Mayor may conduct a fact-finding investigation on flophouse residents on a regular basis in order to appropriately establish a comprehensive plan under Article 5.
(2) The following subparagraphs shall be included in the fact-finding survey under paragraph (1).
1. Basic information such as the number of flophouse residents, place of residence, type of residence, gender and age;
2. Types and details of social welfare services that flophouse residents receive from the country, local governments, and public institutions;
3. Types and details of social welfare services supported by the private sector;
4. Other matters deemed necessary for fact-finding investigations due to environmental changes.
(3) If necessary for the fact-finding investigation under paragraph (1), the Mayor may entrust the investigation to related specialized research institutes and organizations.






Article 7 (Project Support) The Mayor may support the following projects to promote the welfare of flophouse residents and stabilize their livelihood:
1. Counseling and services for livelihood stability and rights promotion for flophouse residents;
2. Feeding service and meal support for flophouse residents;
3. Medical support services such as health examinations and rehabilitation programs for flophouse residents;
4. Housing stability support and employment support projects for flophouse residents;
5. Support to improve the working environment of workers in flophouse residents support facilities;
6. Other support projects necessary to promote the welfare of flophouse residents and stabilize their livelihood.






Article 8 (Organization and Operation of Flophouse Policy Advisory Committee) (1) The flophouse Policy Advisory Committee shall be established to advise on the following matters pertaining to the welfare policy for flophouse residents in Seoul:
1. Matters for setting welfare policy directions for flophouse residents;
2. Matters concerning the establishment and implementation of comprehensive plans;
3. Matters concerning support for private organizations for the welfare of flophouse residents;
4. Other matters deemed necessary by the chairperson.
(2) The committee shall consist of up to 15 members, including one chairperson.
(3) The members shall be composed of ex officio members who are public officials related to the Seoul Metropolitan Government, and commissioned experts on flophouse residents designated by the Mayor.
(4) Allowances, etc. may be paid to members who attend committee meetings within the limits of the budget. However, this does not apply when a member who is a public official directly related to the work is present.
(5) In addition, detailed matters regarding the composition and operation of the Committee shall be determined by the rules.






Article 9 (Entrustment of Project) In order to efficiently promote the welfare and livelihood stability of flophouse residents, the Mayor may promote projects under Article 7 jointly with public institutions and private organizations or entrust projects to them.






Article 10 (Installation and Operation of Support Facilities for Flophouse Residents) (1) The Mayor may install and operate flophouse resident support facilities to support the welfare and livelihood of flophouse residents.
(2) If necessary, the Mayor may entrust the operation of flophouse resident support facilities established pursuant to paragraph (1) to social welfare corporations, non-profit corporations, public institutions, or private organizations.






Article 11 (Subsidization) (1) The Mayor may provide administrative and financial support to related organizations or institutions, if necessary for the implementation of welfare promotion and livelihood support policies for flophouse residents.
(2) The method and procedure for supporting expenses under paragraph (1) and other necessary matters shall be in accordance with the Seoul Metropolitan City Ordinance on the Management of Local Subsidies, etc.






Article 12 (Guidance and Supervision) The Mayor shall guide and supervise flophouse resident support facilities and related entrusted institutions/organizations, etc., which receive financial support under Article 10, and, if necessary, order a report on the business or submission of related documents or have public officials under the jurisdiction enter and investigate flophouse residents support facilities, etc.






Article 13 (Education) The Mayor shall conduct training to improve the professionalism of workers, such as counseling training, at least once a year for workers in flophouse resident support facilities.






Article 14 (Enforcement Rule) Matters necessary for enforcing this Ordinance shall be prescribed by rule of the Seoul Government.






ADDENDUM <Ordinance No. 8493, Oct. 17, 2022>
This Ordinance shall enter into force on the date of its promulgation.
