SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE PREVENTION OF STALKING CRIME AND SUPPORT FOR VICTIMS

Article 1 (Purpose) The purpose of this Ordinance is to prescribe measures to address and prevent stalking crimes, which can cause unjustifible anxiety or fear in another party against the will of that party.

Article 2 (Definitions) The terms used in this Ordinance are defined as follows:
1. The term "stalking" refers to an act that causes anxiety or fear in another party by doing any of the following acts toward that party, his/her cohabitant, or family member against the other party's will and without a justifiable reason:
a. Approaching, following, or blocking the path of the other party;
b. Waiting for or watching the other party near a residence, workplace, school, or other place (hereinafter referred to as "residence, etc.") where the other party is regularly present;
c. Sending an object, text, word, code, sound, picture, video, or image (hereinafter referred to as “thinks, etc.”) to the other party by mail, telephone, fax, or information and communication network under Article 2 (1) 1 of Act on Promotion of Information and Communications Network Utilization and Information Protection.
d. Making things, etc. reach the other party by oneself or through a third party or placing things, etc. in or near their residence, etc.;
e. Damaging the residence, property, etc. of the other party.
2. The term 'stalking crime' refers to continuous or repeated stalking;
3. The term 'victim' refers to a person who has been directly harmed by a stalking crime;
4. The term 'victims, etc.' refers to the victims and the other party of the stalker.

Article 3 (Duties of the Mayor) (1) The Mayor of Seoul Metropolitan City (hereinafter referred to as the "Mayor") may establish and promote policies necessary to prevent stalking crimes and protect victims, etc., and provide necessary administrative and financial support.
(2) The Mayor shall endeavor to secure the necessary budget and manpower to promote and support the policies under paragraph 1.

Article 4 (Establishment of Implementation Plan) (1) The Mayor shall annually establish and implement a plan for stalking crime prevention and damage support, including the following items:
1. Measures necessary to prevent stalking crime;
2. Measures necessary to protect and support victims, etc. of stalking crimes;
3. Matters related to education and publicity for stalking crime prevention;
4. Matters related to improving citizen awareness to eradicate stalking crime;
5. Other matters deemed necessary by the Mayor to prevent stalking crimes and protect and support victims, etc.
(2) If the Mayor deems it necessary, the plan in accordance with paragraph 1 shall be incorporated into the annual implementation plan for the prevention of violence against women and the protection and support policies for victims under Article 5 of the Seoul Metropolitan Government Ordinance of Prevention on Violation Against Women and Protection and Support of Victims.
(3) The Mayor may request cooperation from public institutions and other corporations or organizations when necessary for the establishment and implementation of a plan under paragraph 1.

Article 5 (Preparation of Reporting System) (1) The Mayor may establish a system for citizens to report suspected stalking crimes.
(2) In the case of establishing a reporting system under paragraph 1, the Mayor shall take necessary measures to prevent additional damage caused by reporting to victims of stalking crimes.

Article 6 (Project) (1) The Mayor may carry out the following projects to prevent stalking crimes and protect and support victims:
1. Matters concerning stalking crime fact-finding and support policy development;
2. Education and promotion projects to prevent stalking crime;
3. Psychological counseling support project for victims, etc. of stalking crimes;
4. Legal counseling support project for victims, etc. of stalking crimes;
5. Matters concerning cooperation and support between public organizations such as the National Police Agency and private organizations such as victim protection groups for stalking crime protection and support projects;
6. Other projects necessary to prevent stalking crimes and protect and support victims, etc.

Article 7 (Budget Support) The Mayor may provide support within budgetary limits to related corporations or organizations promoting projects under Article 6.

Article 8 (Installation of Support Facilities) The Mayor may install and operate victim support facilities to protect and support victims, etc. and effectively prevent damage.

Article 9 (Establishment of Cooperation System) (1) The Mayor may establish a cooperative system with the central government, the Seoul Metropolitan Police Agency, the Seoul Metropolitan Office of Education, other local governments, and related corporations and organizations to prevent stalking crimes and protect and support victims, etc.
(2) The Mayor may conclude business agreements on information exchange and cooperation to establish a cooperation system under paragraph 1.

Article 10 (Education and Promotion) (1) The Mayor may conduct education to prevent stalking crimes in accordance with relevant laws and regulations.
(2) The Mayor may cooperate with educational institutions, private organizations, media organizations, and other related organizations to produce, distribute, and publicize materials related to stalking crime prevention and damage support.

Article 11 (Entrustment) (1) If it is deemed necessary to efficiently promote the projects under each subparagraph of Article 7 (1), the Mayor may entrust the project to an institution, corporation, or organization that has expertise in the project.
(2) In the case of entrusting affairs pursuant to paragraph 1, the Seoul Metropolitan Government Ordinance on the Administrative Work to the Private Sector shall be followed.

Article 12 (Confidentiality) A person who has or is engaged in work related to the prevention of stalking crimes and the protection and support of victims under this Ordinance shall not disclose any secrets learned in the course of performing his or her duties and shall comply with the Personal Information Protection Act.

Article 13 (Enforcement Rule) Measures to enforce this Ordinance shall be prescribed by rule of the Seoul Government


ADDENDUM <Ordinance No. 8496, Dec. 17, 2022>
This Ordinance shall enter into force on the date of its promulgation.
