SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON OPERATION OF CITIZEN PARTICIPATORY BUDGET SYSTEM

CHAPTER I GENERAL PROVISIONS Article 1 (Purpose) The purpose of this Ordinance is to enhance transparency and democracy of the budget of the Seoul Metropolitan Government by ensuring citizen participation in the budgeting process, including budget compilation, pursuant to Article 39 of the Local Finance Act and Article 46 of the Enforcement Decree of the same Act and to provide for matters necessary for revitalizing participatory democracy. <Amended by Ordinance No. 5480, May 16, 2013; Ordinance No. 6568, Jul. 13, 2017; Ordinance No. 7601, Jul. 16, 2020>

Article 2 (Definitions) (1) "Citizen" in this Ordinance means any of the following persons: <Amended by Ordinance No. 6568, Jul. 13, 2017; Ordinance No. 7217, Jul. 18, 2019>
1. A person domiciled within the jurisdiction of the Seoul Metropolitan Government (hereinafter referred to as the "Seoul Government");
2. A person who works for an institution within the jurisdiction of the Seoul Government;
3. A representative, executive officer, or employee of a corporation which has its headquarters or branch office in the City;
4. A student of a school located in the City under the Elementary and Secondary Education Act and the Higher Education Act and those equivalent thereto.
(2) Notwithstanding paragraph (1), public officials of the Seoul Metropolitan Government and an autonomous Gu and any other person who works for a City-funded institution or City-invested institution (hereinafter referred to as "public officials") shall be excluded from citizens. <Amended by Ordinance No. 6568, Jul. 13, 2017>

Article 3 (Basic Ideology) The basic ideology of the citizen participatory budget system is that the Seoul Government and citizens cooperate with each other to improve the welfare and quality of lives of citizens, realize fiscal democracy by ensuring transparency and democracy of fiscal management, and activate participatory democracy. <Amended by Ordinance No. 6568, Jul. 13, 2017>

Article 4 (Obligations to Observe Statutes and Regulations) Procedures and methods for citizens¡¯ participation in the budgeting process, including budget compilation, under this Ordinance (excluding matters subject to resolution by the Seoul Metropolitan Council under Article 39 of the Local Autonomy Act; hereinafter referred to as ¡°budgeting process¡±) shall be in compliance with the Local Autonomy Act, the Local Finance Act, and other statutes and regulations related to budget compilation of local governments. <Amended by Ordinance No. 6568, Jul. 13, 2017; Ordinance No. 7601, Jul. 16, 2020>

Article 5 (Responsibilities of Mayor) (1) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") shall endeavor to disclose information and guarantee citizen participation for citizens to obtain enough information and have opportunities to present their opinions at the stage of budget compilation. <Amended by Ordinance No. 6568, Jul. 13, 2017>
(2) The Mayor shall explore methods for boosting mutual cooperation with citizens and the Seoul Metropolitan Council (hereinafter referred to as the "Seoul Council") in connection with the operation of the citizen participatory budget system.

(3) The Mayor shall disclose details of budget compilation in which citizens have participated and reflected in the budgeting process. <Amended by Ordinance No. 5480, May 16, 2013; Ordinance No. 6568, Jul. 13, 2017>

Article 6 (Scope of Citizen Participatory Budgeting) The scope of opinions to be submitted by citizens during the budgeting process shall cover the total budget and funds for the pertinent year. <Amended by Ordinance No. 5480, May 16, 2013; Ordinance No. 6568, Jul. 13, 2017; Ordinance No. 7601, Jul. 16, 2020>

Article 7 (Rights of Citizens) Any citizen may submit his or her opinion on budget compilation by the Seoul Government within the scope prescribed by this Ordinance. <Amended by Ordinance No. 6568, Jul. 13, 2017; Ordinance No. 7601, Jul. 16, 2020>

PLAN AND COLLECTION OF OPINIONS

CHAPTER II FORMULATION OF OPERATION Article 8 (Public Notice on Formulation of Operation Plan) (1) The Mayor shall formulate a plan for operating the citizen participatory budget system (hereinafter referred to as ¡°operation plan¡±) before budget compilation and shall publicly announce such plan on the website, etc. for at least 20 days. <Amended by Ordinance No. 6568, Jul. 13, 2017; Ordinance No. 7601, Jul. 16, 2020>
(2) An operation plan under paragraph (1) shall include the following: <Amended by Ordinance No. 7601, Jul. 16, 2020>
1. Direction-setting for budget compilation;
2. Explanation, promotion, and discussion plans in connection with the budget of the Seoul Government;
3. Plans for providing training sessions for citizens and public officials of the Seoul Government;
4. Procedures and methods for gathering consensus from citizens in the budgeting process.

Article 9 (Procedures for Collecting Opinions) The Mayor may gather consensus from citizens by means of briefing sessions, public hearings, discussion sessions, and public offering for the projects.

Article 10 (Submission of Opinions) Any person who intends to submit opinions on budget compilation of the Seoul Government shall submit them in accordance with the operation plan under Article 8. <Amended by Ordinance No. 6568, Jul. 13, 2017; Ordinance No. 7601, Jul. 16, 2020>

Article 11 (Disclosure of Outcomes) The Mayor may disclose the outcomes of opinions collected from citizens submitted under Article 10 on the website, etc. <Amended by Ordinance No. 6568, Jul. 13, 2017>

Article 12 (Provision of Information) In order to encourage citizen participation, the Mayor may provide citizens with sufficient information on the budgeting process, such as budget compilation, execution, and settlement, etc., methods for citizen participation, operation of the citizen participatory budget system, etc. by actively involving in explanation, education, public relations, and discussion on the budget of the Seoul Government.

BUDGET COMMITTEE

CHAPTER III CITIZEN PARTICIPATORY Article 13 (Composition of Committee) (1) The Mayor shall establish a Citizen Participatory Budget Committee (hereinafter referred to as the "Committee"):to perform the following functions <Amended by Ordinance No. 6568, Jul. 13, 2017; Ordinance No. 7601, Jul. 16, 2020>
1. Submitting opinions on mid-to long-term budget, budget compilation for large-scale investment projects, relevant budgeting process, etc.;
2. Making final decisions on the projects deliberated on and coordinated by a regional citizen participatory budgeting meeting and public-private budget council;
3. Submitting opinions on draft budget compilation;
4. Providing support for PR and marketing activities for the citizen participatory budget system;
5. Other activities deemed necessary for achieving the objectives of the Committee.
(2) The Committee shall be comprised of up to 500 members, including one chairperson and one vice chairperson. <Amended by Ordinance No. 5480, May 16, 2013; Ordinance No. 6440, Jul. 23, 2017; Ordinance No. 7601, Jul. 16, 2020>
(3) Members pursuant to paragraph (2) shall be selected based upon gender and age equality.
(4) Members of the Committee shall be commissioned by the Mayor from among any of the following persons, and those falling under subparagraph 1 shall account for at least 4/5 of the total members: <Amended by Ordinance No. 5480, May 16, 2013; Ordinance No. 6440, Mar. 23, 2017; Ordinance No. 6568, Jul. 13, 2017; Ordinance No. 7601, Jul. 16, 2020>
1. Any citizen who wishes to joint the Committee and is selected through random draw after completing courses at a budget school;
2. Any person recommended by the Seoul Council;
3. Any person recommended by the Mayor.
(5) When persons falling under paragraph (4) 2 or 3 are recommended, participation of the youth, persons with disabilities, and multicultural families, etc., shall be guaranteed. <Amended by Ordinance No. 6568, Jul. 13, 2017; Ordinance No. 7601, Jul. 16, 2020>
(6) Any person recommended by the Seoul Council or the Mayor under paragraph (4) 2 or 3 may be commissioned after completing courses on budgeting. <Newly Inserted by Ordinance No. 6440, Mar. 23, 2017; Ordinance No. 7601, Jul. 16, 2020>

Article 14 (Commissioning, Dismissal, and Term of Office for Members) (1) The term of office for members shall commence on the date they are commissioned and expire at the end of January next year, and their term may be renewed for only one further term: Provided, That where a succeeding member is not commissioned even after such expiration, the preceding member may continue to serve as a member until his or her successor is commissioned, for up to one year from the date he or she was commissioned. <Amended by Ordinance No. 6440, Mar. 23, 2017; Ordinance No. 7601, Jul. 16, 2020>
(2) The Mayor dismiss any of the following members from office even before the term of office of such members ends: <Amended by Ordinance No. 6568, Jul. 13, 2017; Ordinance No. 7423, Dec. 31, 2019; Ordinance No. 7601, Jul. 16, 2020>
1. If he or she becomes unable to perform his or her duties for at least six months due to a disease that requires long-term treatment, overseas travel, or other causes;
2. If he or she voluntarily wishes to be dismissed;
3. If he or she engages in activities, contrary to the purpose of operation, principles, goals, functions, etc. of the Committee;
4. If he or she is found incompetent on the ground of neglecting duty, misdemeanor or any other cause.

Article 15 (Chairperson and Secretary) (1) The chairperson shall be elected from among the members of the Committee.
(2) A new chairperson shall be elected at each general meeting, who shall exercise general control over the affairs of the Committee while in office.
(3) The secretary shall be the head of the department in charge of operating the citizen participatory budget system to conduct the affairs of the Committee.

Article 16 (Operation Principles) The Committee shall be operated under the following principles: <Amended by Ordinance No. 6568, Jul. 13, 2017; Ordinance No. 7601, Jul. 16, 2020>
1. It shall contribute to improving welfare of citizens and creating a local community;
2. It shall guarantee participation of citizens and realize financial autonomy;
3. It shall encourage autonomous operation of the public-private budget council by office, headquarters, and bureau, and working divisions;
4. It shall endeavor to nurture and develop the Committee soundly;
5. It shall prevent the Committee from being used for political and/or private purposes;
6. It shall not violate any of the rights of the Seoul Council to deliberate on budgets; and shall be operated within the scope of the Mayor's rights for budget compilation.

Article 17 (General Meeting) (1) The Committee shall hold a general meeting to conduct final deliberation on and coordination of a proposal for budget compilation. In such cases, the chairperson shall submit to the Mayor the draft budget compilation coordinated through resolution at a general meeting. <Amended by Ordinance No. 7601, Jul. 16, 2020>
(2) A general meeting of the Committee shall be convened with the attendance of a majority of all incumbent members, and resolutions shall be adopted by the affirmative vote of a majority of those present. <Amended by Ordinance No. 7601, Jul. 16, 2020>
(3) Where deemed necessary by the chairperson, opinions of citizens and experts may be reflected in the resolution process. In such cases, the procedures and methods for participation of citizens and experts may be separately determined by the chairperson. <Amended by Ordinance No. 7601, Jul. 16, 2020>
(4) Any non-member who wishes to speak at a general meeting shall obtain the right to speak from the chairperson in accordance with the required procedures, which shall be determined by the Committee. <Amended by Ordinance No. 5670, Mar. 20, 2014; Ordinance No. 7601, Jul. 16, 2020>
(5) The Mayor shall submit to the Seoul Council coordinated opinions on the draft budget compilation passed at a general meeting, accompanied by the draft budget. <Amended by Ordinance No. 7601, Jul. 16, 2020>

Article 18 (Convocation of Meetings) (1) The chairperson shall convene meetings of the Committee and working divisions, where he or she deems it necessary for budgeting. <Amended by Ordinance No. 6440, Mar. 23, 2017>
(2) Where deemed necessary to gather members' consensus, the Mayor may request that a meeting of the Committee and working division be convened. <Amended by Ordinance No. 6440, Mar. 23, 2017>

Article 19 (Principles for Disclosure of Meeting Minutes) Meetings of the Committee shall be open to the public, and except as provided in Article 9 (1) of the Official Information Disclosure Act, the minutes of such meetings, stating the dates and times of meetings, agenda for deliberation, names and remarks of the members present and details of resolution, etc. shall be disclosed on the website of the Seoul Government, within seven days from the completion thereof.

Article 20 (Submission of Materials and Cooperation) (1) The Mayor shall notify the Committee members of meeting schedules and agenda at least seven days beforehand: Provided, That this shall not apply where there is an urgent need for a meeting or where a security issue arises. <Amended by Ordinance No. 7601, Jul. 16, 2020>
(2) If deemed necessary to perform its duties, the Committee may require relevant public officials or experts to attend its meetings and present their opinions; or may ask them to submit necessary materials.
(3) If deemed necessary to conduct its businsses, the Committee shall hold policy discussion sessions, public hearings, etc. to hear from relevant experts and citizens. <Amended by Ordinance No. 6568, Jul. 13, 2017>

Article 21 (On-Site Surveys and Public Hearings) The Committee may provide support for on-site surveys, public hearings, or discussion sessions where necessary, in order to gather consensus on the budgeting process from experts and citizens.

Article 22 (Public-Private Budget Council) (1) The Mayor shall organize and operate public-private budget councils under offices, headquarters, and bureaus (hereinafter referred to as ¡°public-private council¡±) to review projects for which budget has already been alloted and those suggested by citizens or organizations; and to adjust the priority of projects: Provided, That a public-private council may be named differently.
(2) A public-private council shall comprise up to 100 members, including its chairperson, consisting of members of the Committee referred to in Article 13, experts, public officials, etc. selected in consideration of the characteristics of each field and gender; and shall ensure that citizens including members of the Committee make up at least 2/3 of the total members.
(3) The chairperson of a public-private council shall be elected from among members who are not public officials.
(4) A meeting of a public-private council shall be convened where deemed necessary by its chairperson or the Mayor; and any decision thereof shall require the attendance of a majority of all incumbent members and the affirmative vote of a majority of those present.
(5) The chairperson may establish divisions under a public-private council to ensure efficient operation thereof. .
(6) A public-private budget committee shall have a secretary to handle its business affairs.

Article 22-2 (Standards for Examining Projects Suggested by Citizens and Organizations) The Committee shall select citizen participatory budget projects under the following principles: <Amended by Ordinance No. 6568, Jul. 13, 2017; Ordinance No. 7423, Dec. 31, 2019>
1. It shall prioritize a project covering the entire City;
2. It shall prioritize a project with its anticipated impact widely spreading to general citizens;
3. It shall exclude any project which requires raising or adding operation costs of facilities already established and operated in the Seoul Government or autonomous Gu;
4. It shall exclude any multi-year project;
5. It shall exclude projects suggested to circumvent standards and procedures for budget compilation.

PARTICIPATORY BUDGETING MEETINGS Article 23 (Organization of Regional Citizen Participatory Budgeting Meetings) The Mayor may establish a regional citizen participatory budgeting meeting (hereinafter referred to as "regional meeting") for each autonomous Gu in order to collect opinions of citizens: Provided, That a resident participatory budget committee of an autonomous Gu already in operation shall be construed as a regional meeting. <Amended by Ordinance No. 6568, Jul. 13, 2017; Ordinance No. 7601, Jul. 16, 2020>

Article 24 (Functions) A regional meeting shall deliberate on projects suggested by citizens of each autonomous Gu and prioritize such projects; and submit the outcomes to the Committee under Article 13 by the beginning of August. <Amended by Ordinance No. 7601, Jul. 16, 2020>

BUDGET SYSTEM¡¡SUPPORT COUNCIL

CHAPTER V CITIZEN PARTICIPATORY Article 25 (Composition and Organization of Citizen Participatory Budget System Support Council) (1) The Mayor shall establish and operate a Citizen Participatory Budget System Support Council (hereinafter referred to as the "Support Council") to perform the following functions: <Amended by Ordinance No. 6568, Jul. 13, 2017; Ordinance No. 7601, Jul. 16, 2020>
1. Suggesting opinions on the enactment and amendment of the Seoul Metropolitan Government Ordinance on Operation of Citizen Participatory Budget System and Enforcement Rule thereof;
2. Providing support for budget-related education, activities to promote the citizen participatory budget system, and activities for budget related discussion sessions and public hearings;
3. Providing support for activities for the general operation of the citizen participatory budget system including operation of a regional meeting, the Committee, and the Support Council;
4. Providing support in the formulation of the methods for evaluating and improving the citizen participatory budget system.
(2) The Support Council shall comprise up to 50 members (including one chairperson and one vice-chairperson) and consist of members of the Seoul Council, experts in budget, relevant persons from non-profit, non-governmental organizations, persons recommended by the Committee, and relevant public officials; and the number of public officials shall not exceed 1/2 of the total members. <Amended by Ordinance No. 6440, Mar. 23, 2017; Ordinance No. 6568, Jul. 13, 2017; Ordinance No. 7601, Jul. 16, 2020>
(3) The term of office for members who are not public officials shall be two years, and their term may be renewed for only one further term: Provided, That the term of office of a member filling a vacancy shall be the remainder of his or her predecessor's term of office. <Newly Inserted by Ordinance No. 6220, May 19, 2016>
(4) The chairperson and vice chairperson of the Support Council shall be elected from among its members and the secretary shall be the official in charge of the operation of the Seoul Government¡¯s citizen participatory budget system and may have a civilian executive secretary. <Amended by Ordinance No. 6220, May 19, 2016; Ordinance No. 6386, Jan. 5, 2017; Ordinance No. 6568, Jul. 13, 2017; Ordinance No. 7601, Jul. 16, 2020>
(5) The term of office for the chairperson and vice chairperson of the Council shall be one year: Provided, That the term of office of the chairperson, vice chairperson, and members filling a vacancy shall be the remainder of his or her predecessor's term of office. <Amended by Ordinance No. 6220, May 19, 2016; Ordinance No. 7601, Jul. 16, 2020>
(6) The chairperson of the Support Council shall exercise general control over the affairs of the Council and represent it. <Amended by Ordinance No. 6220, May 19, 2016; Ordinance No. 7601, Jul. 16, 2020>
(7) The vice chairperson of the Support Council shall assist its chairperson; and where the chairperson is unable to perform his or her duties, the vice chairperson shall act on his or her behalf. <Amended by Ordinance No. 6220, May 19, 2016; Ordinance No. 7601, Jul. 16, 2020>

Article 26 (Convocation of Meetings and Resolution) (1) The chairperson of the Support Council shall convene a meeting when necessary for the citizen participatory budget system. <Amended by Ordinance No. 6568, Jul. 13, 2017; Ordinance No. 7601, Jul. 16, 2020>
(2) A meeting shall be convened with the attendance of a majority of all incumbent members, and resolution thereof shall be adopted by the affirmative vote of a majority of those present. <Newly Inserted by Ordinance No. 7601, Jul. 16, 2020>

Article 27 (Functions) The Council shall conduct the following functions: <Amended by Ordinance No. 6568, Jul. 13, 2017>
1. Suggesting opinions on the enactment and amendment of the Seoul Metropolitan Government Ordinance on Operation of Citizen Participatory Budget System and Enforcement Rule thereof;
2. Budget-related education, activities to promote the citizen participatory budget system, and activities for relevant discussion sessions and public hearings;
3. Providing support for activities for the general operation of the citizen participatory budget system including operation of a regional meeting, the Committee, the Support Council, etc.;
4. Facilitating cooperation with the Seoul Council;
5. Formulating methods for evaluating and improving the citizen participatory budget system;
6. Other activities necessary to achieve the objectives of the Support Council.

CHAPTER VI ASSISTANCE Article 28 (Administrative and Financial Assistance) (1) The Mayor may provide administrative assistance, such as meeting venues and handling administrative affairs, to facilitate operation of the citizen participatory budget system. <Amended by Ordinance No. 6568, Jul. 13, 2017>
(2) The Mayor may subsidize expenses incurred in activities, etc. of the Committee, the Support Council, and the public-private council. <Amended by Ordinance No. 6440, Mar. 23, 2017; Ordinance No. 7601, Jul. 16, 2020>
(3) The Mayor may reimburse actual expenses, within budgetary limits, to members who attend meetings of the Committee, the Support Council, or the public-private council and who travel on business for official duties. <Amended by Ordinance No. 6440, Mar. 23, 2017; Ordinance No. 7601, Jul. 16, 2020>
(4) The Mayor may grant a monetary reward, within budgetary limits, to exemplary projects and citizens who have submitted his or her opinions so as to encourage participation in the budgeting process. <Newly Inserted by Ordinance No. 7601, Jul. 16, 2020>
(5) The Mayor shall inform citizens of the types and amounts of monetary rewards to be provided under paragraph (4) via the website before selecting exemplary projects and opinions. <Newly Inserted by Ordinance No. 7601, Jul. 16, 2020>
(6) The Standards for Faculty Fees and the Standards for Writing Teaching Materials and Providing Faculty Fees of the Seoul Human Resource Development Center shall apply mutatis mutandis to payments for lectures and teaching materials of the budget school. <Newly Inserted by Ordinance No. 7601, Jul. 16, 2020>

Article 29 (Enforcement Rule) Matters necessary for enforcing this Ordinance shall be prescribed by rule of the Seoul Government. <Amended by Ordinance No. 6568, Jul. 13, 2017>

ADDENDA
Article 1 (Enforcement Date)
This Ordinance shall enter into force on the date of its promulgation.
Article 2 (Special Cases concerning Operation of the Citizen Participatory Budget Committee)
(1) Notwithstanding Article 16 (4), the term of office of the members of the first Citizen Participatory Budget Committee commissioned shall commence from the time of commissioning and end by the end of February the following year.
(2) Where a resident participatory budget committee is not established in an autonomous Gu pursuant to Article 13, projects suggested by citizens may be submitted only in 2012 upon meetings participated by general residents.
(3) The deadline for a regional meeting to send projects suggested by residents pursuant to Article 14 shall be the middle of July 2012.

This Ordinance shall enter into force on the date of its promulgation: Provided, That Article 25 (10) shall begin to apply from budget schools in 2013.
