| SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE ESTABLISHMENT AND OPERATION OF SMALL AND MEDIUM BUSINESS SUPPORT FACILITIES
Ordinance No. 3769, Jul. 15, 2000 Amended by Ordinance No. 4021, Jul. 15, 2002 Ordinance No. 4027, Sep. 12, 2002 Ordinance No. 4273, Apr. 14, 2005 Ordinance No. 4342, Dec. 29, 2005 Ordinance No. 4502, Apr. 17, 2007 Ordinance No. 4592, Dec. 26, 2007 Ordinance No. 4818, Jul. 30, 2009 Article 1 (Purpose) The purpose of this Ordinance is to provide for matters necessary for the establishment and operation of small and medium business support facilities of the Seoul Metropolitan Government (hereinafter referred to as the "Support Facilities") to support and promote the establishment and development of small and medium businesses in Seoul Special Metropolitan City (hereinafter referred to as "Seoul") pursuant to Article 3 (2) of the Framework Act on Small and Medium Businesses, Article 63 (1) of the Enforcement Decree of the Balanced Regional Development and Support for Local Small and Medium Businesses Act and Article 9 (2) 3 of the Local Autonomy Act as well as to contribute to the economic vitalization of Seoul. Article 2 (Scope of Application) Except as otherwise provided for in other Acts, subordinate statutes or ordinances, this Ordinance shall apply with regard to the establishment and operation of the Support Facilities. Article 3 (Establishment of Support Facilities) The names and functions of the Support Facilities established under this Ordinance shall be described in the Table annexed hereto, and the locations thereof shall be publicized by the Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor"). <Amended by Ordinance No. 4021, Jul. 15, 2002; Ordinance No. 4273, Apr. 14, 2005> Article 4 (Principles of Management and Operation) The Mayor and each person commissioned to manage and operate the Support Facilities under Article 5 (1) shall manage and operate the Support Facilities in a manner consistent with their purposes of establishment. <Amended by Ordinance No. 4502, Apr. 17, 2007> Article 5 (Commission, etc. of Management and Operation) (1) The Mayor may commission any other administrative agency, juristic person, organization, or any office or individual belonging thereto, that is capable of managing and operating the Support Facilities to manage and operate such Facilities in order to ensure the efficient and professional management and operation thereof. (2) The Support Facilities whose management and operation may be commissioned under paragraph (1) shall be as follows: 1. Seoul Hightech Venture Center; 2 and 3. Deleted; 4. Chang-dong Small and Medium Business Products Exhibition and Sale Center; 5. Seoul Animation Center; 6. Seoul Fashion Design Center; 7. Seoul Printing Center; 8. Seoul Design Center; 9. Seoul Trade Exhibition Center; 10. DMC (Digital Media City) High-Tech Industry Center. (3) The provisions of Articles 7 through 13 and Articles 15 through 19 of the Seoul Metropolitan Government Ordinance on the Private Entrustment of Administrative Affairs shall apply mutatis mutandis to necessary procedures, methods and so on concerning the commission of management and operation of the Support Facilities under paragraph (1). Article 6 Deleted. Article 7 (Steering Committees) (1) Any person commissioned to manage and operate the Support Facilities may organize and operate a steering committee for each Support Facility to deliberate on the following matters relating to such management and operation: 1. Matters concerning the budget and the closing account: 2. Matters concerning the establishment and implementation of the master plan for the management and operation of the Support Facilities; 3. Deleted; 4. Other matters deemed necessary for the management and operation of the Support Facilities and referred to the relevant steering committee for deliberation. (2) Except as provided for in paragraph (1), necessary matters concerning the organization and operation of the steering committees shall be determined by the person commissioned to manage and operate the Support Facilities with the approval of the Mayor. Article 8 (Enforcement Rule) Necessary matters concerning the enforcement of this Ordinance shall be provided for by the Enforcement Rule.
ADDENDA Article 1 (Enforcement Date) This Ordinance shall enter into force on the date of its promulgation. Article 2 (Transitional Measures concerning Establishment of Support Facilities and Commission of Operation) The small and medium business support-related facilities that are being managed and operated after having been established and commissioned under the Seoul Metropolitan Government Ordinance on the Establishment of Public Facilities and the Seoul Metropolitan Government Ordinance on the Private Entrustment of Administrative Affairs before this Ordinance enters into force, shall be deemed to be facilities established under this Ordinance, and the said management and operation shall, during the period of such commission, be deemed to be commissioned under this Ordinance. Article 3 (Transitional Measures concerning Permit to Use) Each person who obtained a permit to use the Support Facilities under the relevant provisions, including the Seoul Metropolitan Government Ordinance on the Private Entrustment of Administrative Affairs and the Seoul Metropolitan Government Ordinance on the Establishment of Public Facilities, before this Ordinance enters into force, shall, until the period of such permit expires, be deemed to have obtained the said permit in accordance with this Ordinance.
