SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON UBIQUITOUS CITY CONSTRUCTION PROJECTS

Article 1 (Purpose) The purpose of this Ordinance is to prescribe matters prescribed by the Act on the Construction, etc. of Ubiquitous Cities and other necessary matters for the efficient advancement of a ubiquitous city.

Article 2 (Definitions and Objects of Application) (1) The definitions of terms used in this Ordinance shall be in accordance with Article 2 of the Act on the Construction, etc. of Ubiquitous Cities (hereinafter referred to as the "Act").
(2) Objects of the application of this Ordinance shall be ubiquitous city construction projects promoted by the Seoul Metropolitan Government, Seoul Metropolitan Government-invested or funded institutions and Gus.

Article 3 (Basic Principles of Promotion of Ubiquitous City Construction Projects) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") shall promote ubiquitous city construction projects in accordance with the basic principles referred to in the following subparagraphs to create and build a "ubiquitous-based international business city":
1. A people-oriented city where the quality of life is guaranteed with expansion of the social welfare network;
2. A city where daily life becomes cultural;
3. A comfortable and green city where nature and human coexist;
4. An uninterrupted traffic city supporting international business;
5. A digital-based industrial city the world comes to see;
6. A city where open administrative service and intelligent administration are realized.

Article 4 (Ubiquitous City Plan) (1) The Mayor shall formulate a ubiquitous city plan referred to in Article 8 of the Act in consideration of a master plan of ubiquitous cities referred to in Article 4 of the Act to promote ubiquitous city construction projects.
(2) The standard target number of years of a ubiquitous city plan shall be five years, however, the target number of years may be adjusted in consideration of the time of formulation of a master plan of ubiquitous cities under the National Land Planning and Utilization Act and the current status and circumstances of Seoul Metropolitan City.

Article 5 (Ubiquitous City Construction Project Plan) (1) A performer of a ubiquitous city construction project shall formulate a ubiquitous city construction project plan in accordance with the ubiquitous city plan referred to in Article 4.
(2) In cases of a project pursuant to Article 3 of the Act and Article 7 of the Enforcement Decree of the Act, a performer of a ubiquitous city construction project shall include a ubiquitous city construction project plan in a plan for development (construction, creation, building, promotion, readjustment, etc.) or formulate a ubiquitous city construction project plan at the time a plan for development (construction, creation, building, promotion, readjustment) is determined.

Article 6 (Execution Plan of Ubiquitous City Construction Project) (1) A performer of a ubiquitous city construction project shall formulate an execution plan of a ubiquitous city construction project under Article 14 of the Act. <Amended by Ordinance No. 6009, Oct. 8, 2015>
(2) In cases of a project pursuant to Article 3 of the Act and Article 7 of the Enforcement Decree of the Act, a performer of a ubiquitous city construction project shall formulate an execution plan of a ubiquitous city construction project when it is included in an execution plan for development (construction, creation, building, promotion, or readjustment, etc.) or such execution plan is finalized. <Amended by Ordinance No. 6009, Oct. 8, 2015>

Article 7 (Standardization) (1) The Mayor may promote the standardization of project promotion procedures, ubiquitous city service models and operation for the prevention of overlapping investment, interoperability and connectivity between services in the promotion of ubiquitous city construction projects.
(2) A performer of a ubiquitous city construction project shall observe the standards referred to in paragraph (1) once they are set.

Article 8 (Establishment and Formation of Committee) (1) A smart city subcommittee shall be established under the Informatization Strategy Committee of the Seoul Metropolitan Government under the Seoul Metropolitan Government Framework Ordinance on Informatization to deliberate on matters concerning ubiquitous city construction projects, etc. <Amended by Ordinance No. 5527, Aug. 1, 2013; Ordinance No. 6009, Oct. 8, 2015>
(2) The committee shall be comprised of not more than 15 members including one chairperson.
(3) The Director-General for Information System Planning shall be the chairperson, and the Mayor shall appoint or commission members from among experts in a field related to ubiquitous development and each field of services; experts in the field of urban planing, related public officials, etc. <Amended by Ordinance No. 5527, Aug. 1, 2013; Ordinance No. 6009, Oct. 8, 2015>
(4) The term of office of commissioned members shall be two years, who may be recommissioned only once.
(5) Necessary matters concerning forming and operating the Committee may be prescribed by rule.

Article 9 (Functions) The Committee shall deliberate on matters referred to in the following subparagraphs: <Amended by Ordinance No. 6009, Oct. 8, 2015>
1. Matters concerning ubiquitous city plans and ubiquitous city construction projects;
2. Matters concerning overall adjustment of ubiquitous city construction projects;
3. Matters concerning assessment of results of ubiquitous city construction projects;
4. Other matters the chairperson refers to meetings of the Committee.

Article 10 (Hearing of Opinions) If necessary, the Committee may have related public officials or experts attend a meeting and hear their opinions on its matters concerned.

Article 11 (Allowance) An allowance, etc. may be paid to members attending a meeting of the Committee or participating in the electronic deliberation within budgetary limits: Provided, That this shall not apply where a member who is a public official attends a meeting in direct connection with his/her duties.

Article 12 (Assessment of Results) (1) The Mayor may assess ubiquitous city construction projects promoted by Seoul Metropolitan Government, Seoul Metropolitan Government-invested or funded institutions and Gus, etc. following deliberation by the Committee.
(2) Matters referred to in the following subparagraphs shall be included in assessment referred to in paragraph (1):
1. Results of projects promoted;
2. Comparison of results among Seoul Metropolitan Government, Seoul Metropolitan Government-invested or funded institutions and Gus, etc.;
3. Problems and a plan for improvement;
4. An advancement plan;
5. Other matters deemed necessary for assessment.

Article 13 (Management of Outputs) The Mayor shall manage outputs from ubiquitous city construction projects with the electronic data processing system so that performers of ubiquitous city construction projects may utilize them.

Article 14 (Information Security) The Mayor shall establish the following countermeasures required for information security for the establishment of healthy order of information and communication and the safe circulation of information:
1. Security measures for collecting, connecting or providing personal information;
2. Security measures for the prevention of information leaks;
3. Other matters deemed necessary for information security.

Article 15 (Copyright Registration) The Mayor shall register copyrights of ubiquitous city service models and ubiquitous city infrastructure requiring protection and take protective measures for them pursuant to the relevant provisions.

ADDENDUM <Ordinance No. 4943, Mar. 2, 2010>
This Ordinance shall enter into force on the date of its promulgation.
ADDENDA <Ordinance No. 5527, Aug.1, 2013>
Article 1 (Enforcement Date)
This Ordinance shall enter into force on the date of its promulgation: Provided, That the amended provisions of Article 5-2 shall enter into force on November 23, 2013.
Article 2 (Applicability to Reflection of Informatization Plan, etc.)
The amended provisions of Article 5-2 shall apply beginning with the formulation of the first informatization plan for the relevant investment project after this Ordinance enters into force.
Article 3 Omitted.
ADDENDUM <Ordinance No. 6009, Oct. 8, 2015>
This Ordinance shall enter into force on the date of its promulgation.
