SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON SUPPORT FOR THE FEMALE VICTIMS OF FORCED LABOR ON COMPULSORY MOBILIZATION DURING KOREA’S RESISTANCE AGAINST JAPAN

SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON SUPPORT FOR THE FEMALE VICTIMS OF FORCED LABOR ON COMPULSORY MOBILIZATION DURING KOREA’S RESISTANCE AGAINST JAPAN

Article 1 (Enforcement Date) This Ordinance shall enter into force on January 1, 2014.

Article 1 (Purpose) The purpose of this Ordinance is to support the female victims of forced labor on compulsory mobilization during Korea’s resistance against Japan for the stability of their livelihood and their activities for restoring their honor, establishing the right historical perspectives on the issue of the female victims of forced labor on compulsory mobilization and promoting their human rights.

Article 2 (Definitions) “Female victims of forced labor on compulsory mobilization” used in this Ordinance means women victimized by forced labor at munitions companies, etc. after being forcibly mobilized through conciliation, coercion, etc. during Korea’s resistance against Japan.

Article 3 (Duties of Mayor) (1) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the “Mayor”) shall actively endeavor for the honor restoration of the female victims of forced labor on compulsory mobilization and for the promotion of their human rights.
(2) The Mayor shall take necessary actions for the stability of the livelihood of the female victims of forced labor on compulsory mobilization.

Article 4 (Eligibility for Support) The eligibility for the support under this Ordinance shall include women who are registered as a resident of Seoul Special Metropolitan City from among those who are determined as a female victim of forced labor on compulsory mobilization as the results of an examination by the Committee for the Investigation into Damage from the Compulsory Mobilization and for Supporting the Victims of Compulsory Overseas Mobilization during Korea’s Resistance against Japan.

Article 5 (Support Projects) The Mayor shall implement each of the following to support the female victims of forced labor on compulsory mobilization:
1. Provision of supplementary living allowances to those eligible for the support: 300,000 won per month;
2. Subsidizing medical expenses for those eligible for the support (up to 300,000 won per month for patients’ cost-sharing);
3. Provision of condolence money on the death of those eligible for the support: one million won on death;
4. Investigation into the actual conditions of those eligible for the support;
5. Other projects recognized as necessary by the Mayor including a project for commemorating, publicizing, and investigating the female victims of forced labor on compulsory mobilization, a project for restoring their honor, etc.

Article 6 (Redemption of Supplementary Living Allowances) (1) Where a person who has received supplementary living allowances under this Ordinance falls under any of the following, the Mayor may redeem all or part of the allowances:
1. When a person has received supplementary living allowances by fraud or other improper means;
2. When overpayment or erroneous payments have been made.
(2) Where the Mayor redeems allowances under paragraph (1), he/she shall collect such allowances in the same
manner as delinquent national taxes are collected if those who are to return such allowances fail to do so within a specified period.

Article 7 (Financial Resources for Support) The Mayor shall endeavor to secure budget for the financial resources for the support.

Article 8 (Enforcement Rules) Necessary matters concerning the enforcement of this Ordinance shall be prescribed by rule.
