SEOUL METROPOLITAN GOVERNMENT RULE ON REWARDS FOR REPORTING FAILURES OR PERSONS CAUSING DESTRUCTION OF ROAD FACILITIES, ETC.

Article 1 (Purpose) The purpose of this Rule is to provide for matters necessary for the payment of reporting rewards to citizens who report a failure or a person causing destruction of a road facility, a road fixture, or a facility for the safety and control of traffic, pursuant to Article 48 of the Seoul Metropolitan Government Ordinance on the Management of Roads and Other Major Facilities.

Article 2 (Persons Eligible for Payment of Rewards) (1) Persons eligible for payment of a reporting reward under Article 48 of the Seoul Metropolitan Government Ordinance on the Management of Roads and Other Major Facilities (hereinafter referred to as the "Ordinance") are as follows: <Amended by Rule No. 3938, Nov. 14, 2013>
1. A person who reports that a motor vehicle traffic signal malfunctions due to damage, malfunction, or power failure of the traffic signal;
2. A person who reports that a pedestrian traffic signal malfunctions or an auxiliary device malfunctions due to damage, malfunction, or power failure of the traffic signal or the auxiliary device;
3. A person who reports information necessary to identify a person who caused the destruction of a road facility, road fixture, or facility for the safety and control of traffic referred to in the attached Table (the agencies responsible for managing major facilities) pursuant to Article 5 of the Ordinance.
(2) If two or more persons are eligible for a reporting reward under paragraph (1), the reward shall be paid only to the person who first reported the matter, but if two or more persons made the report first, the reward shall be paid in equal portions to each of them.
(3) Notwithstanding paragraph (1), no reporting reward shall be paid in any of the following cases: <Amended by Rule No. 3938, Nov. 14, 2013>
1. Where a public official belonging to the division responsible for managing the facility in the Seoul Metropolitan Government, the Seoul Metropolitan Police, or to the competent police station, makes a report;
2. Where an employee of the business entity responsible for managing the facility, makes a report;
3. Where a person involved in a traffic accident or any other case or accident, makes a report;
4. Where a failure has been already discovered or reported and repair works or investigations into the person who caused destruction, are pending;
5. Where the reporting person refuses to provide his/her personal information, contact information, or other information necessary for the payment of rewards;
6. Where a report is made anonymously or with another person's name and/or address;
7. Where it is unnecessary to identify a person who caused destruction of a facility because such person voluntarily acknowledges that he/she did so and makes a report thereon.

Article 3 (Guidelines for Payment of Rewards) (1) A person who reports a failure of a facility (hereinafter referred to as "failure of a facility") set forth in subparagraphs 1 and 2 of Article 2; or a person who caused destruction of a facility, may be rewarded with up to 50,000 won in cash or an equivalent gift card, within budget limits, for each incident reported. <Amended by Rule No. 3938, Nov. 14, 2013>
(2) Detailed criteria for paying rewards for reporting under paragraph (1), shall be as specified in the attached Table. <Amended by Rule No. 3938, Nov. 14, 2013>

Article 4 (Limitations of Payment of Rewards) No rewards for reporting a failure of a facility pursuant to Article 3 shall exceed 200,000 won per month for any one individual.

Article 5 (Handling of Reports of Failures, etc.) (1) The Chief Officer of the City Transportation Headquarters shall designate the division responsible for the general management of affairs related to the payment of rewards for reporting a failure and a person causing destruction of a facility for the safety and control of traffic (hereinafter referred to as the "managing division"); and the Chief Officer of the Safety Management Bureau shall designate such division for affairs regarding the payment of rewards for reporting a person causing destruction of road facilities and road accessories; and both shall install and operate telephone lines dedicated to reporting and an Internet web-site. <Amended by Rule No. 3938. (2) Upon receipt of a report of a failure of a facility, or of a report on a person who caused destruction (hereinafter referred to as "report of a failure, etc."), the agency responsible for managing a major facility under Article 5 of the Ordinance (hereinafter referred to as "agency responsible for managing a facility") and the 120 Dasan Call Center shall notify the managing division of the report immediately.
(3) Upon receipt of a report of a failure, etc. pursuant to paragraph (2), the head of the managing division shall instruct the public official in charge to make entries in the register of acceptance and processing of reports of failures or persons causing destruction (hereinafter referred to as "reports register") in attached Form 1 attached hereto; and shall notify the agency responsible for managing the facility concerned of the report.
(4) Upon receipt of a report of a failure, etc. from the managing division, the head of the agency responsible for managing a facility, shall immediately instruct the public official in charge to make entries in the reports register in attached Form 1 attached hereto; and to conduct a field inspection on the failure, etc.

Article 6 (Method and Procedure for Payment of Rewards) (1) The reward for a report of a failure or destruction of facilities shall be paid by no later than 20th day of the following month, only where the report of the failure or a person causing the destruction, is verified by the public official in charge.
(2) Where rewards for reporting under Article 3 (1) and (2) are paid, a reward payment record of a failure or a person causing destruction of facilities, shall be prepared in attached Form 2. <Amended by Rule No. No. 4062, Jan. 14, 2016>

Article 7 (Protection of Reporting Persons) (1) In order to protect a reporting person, his/her identity shall not be divulged without his/her consent.
(2) No public official who is in charge of affairs regarding reporting and rewarding or public official who has accepted and handled reports, shall divulge any information about such reports that he/she has learned.
