SEOUL METROPOLITAN CITY ORDINANCE ON ESTABLISHMENT AND OPERATION OF JUVENILE FACILITIES

CHAPTER I GENERAL PROVISIONS Article 1 (Purpose) The purpose of this Ordinance is for juveniles to be fairly treated and guaranteed the rights and interests as community members, to think for themselves, lead an active life freely, and grow up to be healthy democratic citizens of the future society by providing for necessary matters concerning the establishment and operation of juvenile facilities. <Amended by Ordinance No. 4698, Sep. 30, 2008>

Article 2 (Definitions of Terms) The term "juvenile facilities" in this Ordinance means facilities established and operated by the Seoul Metropolitan Government for activity, welfare, protection and fostering of juveniles pursuant to the Framework Act on Juveniles, the Juvenile Activity Promotion Act and the Local Autonomy Act. <Amended by Ordinance No. 4792, May 28, 2009>

Article 3 (Scope of Application) Except as otherwise prescribed by other Acts and subordinate statutes and Ordinances, this Ordinance shall apply to the establishment and operation of juvenile facilities. <Amended by Ordinance No. 4698, Sep. 30, 2008>

Article 4 (Establishment) The names, functions, and locations of juvenile facilities established and operated pursuant to this Ordinance shall be as specified in attached Table 1. <Amended by Ordinance No. 4698, Sep. 30, 2008>

Article 5 (Principles of Operation) (1) The Mayor of Seoul Metropolitan City (hereinafter referred to as the "Mayor") shall operate juvenile facilities in accordance with the purpose for which such facilities have been established, and give users of juvenile facilities the opportunity to fairly use them. <Amended by Ordinance No. 4698, Sep. 30, 2008>
(2) It is the principle that juvenile facilities shall be opened and operated except public holidays and election days provided in subparagraphs 3, 4 and 9 of Article 2 of the Regulations on Public Holidays of Government and Public Offices. In such cases, any person who has worked on a public holiday may take a day off work on a weekday. <Amended by Ordinance No. 4698, Sep. 30, 2008>
(3) The Mayor may allow ordinary citizens to use juvenile facilities for the improvement of welfare of community residents, however, even in such cases, he/she shall give priority on the use of the facilities to juveniles. <Amended by Ordinance No. 4698, Sep. 30, 2008>

CHAPTER II USE OF FACILITIES, USER FEES, ETC. Article 6 (Use of Facilities) (1) Persons eligible to utilize or use juvenile facilities (hereinafter referred to as "user") shall be classified as follows: <Amended by Ordinance No. 4698, Sep. 30, 2008>
1. Youth: Persons between the ages of 9 and 24;
2. Others: Persons other than youth, who are permitted by the Mayor to use juvenile facilities.
(2) The Mayor may recruit members of ordinary use facilities, including a swimming pool, etc., and issue membership cards. <Amended by Ordinance No. 4698, Sep. 30, 2008>

Article 7 (Opening Hours) (1) The opening hours of juvenile facilities shall comply with the following guidelines: Provided, That the foregoing shall not apply to cases where the Mayor prescribes the special opening hours according to characteristics of facilities or program: <Amended by Ordinance No. 4698, Sep. 30, 2008>
1. Daytime: from 09:00 to 18:00;
2. Nighttime: from 18:00 to 22:00.
(2) Where the Mayor specially prescribes the opening hours pursuant to the proviso to paragraph (1), he/she shall notify the special opening hours by posting a notice of the details thereof at the place where users, etc. may read the notice well. <Amended by Ordinance No. 4698, Sep. 30, 2008>

Article 8 (User Fees, etc.) (1) The Mayor may prescribe user fees or lesson fees (hereinafter referred to as "user fee") within the limits prescribed in attached Table 2, and impose user fees on persons who use juvenile facilities and collect user fees from them. In such cases, he/she shall announce matters of user fees on the Official Gazette of the Seoul Metropolitan Government in advance. <Amended by Ordinance No. 4792, May 28, 2009>
(2) Where any person falls under any of the following, the Mayor may reduce his/her user fee under paragraph (1) or exempt him/her from the user fee: <Amended by Ordinance No. 4792, May 28, 2009; Ordinance No. 5329, Jul. 30, 2012>
1. A recipient under the National Basic Living Security Act or juveniles among his/her family members;
2. A person of distinguished services to the State under the Act on the Honorable Treatment and Support of Persons, etc. of Distinguished Services to the State or juveniles among his/her family members;
3. Juveniles in a social welfare facility under the Social Welfare Services Act;
4. Juveniles of a low income single-parent family under the Single-Parent Family Support Act;
5. Juveniles registered as persons with disabilities, etc. pursuant to the Act on Welfare of Persons with Disabilities.
(3) Where a user has paid a user fee pursuant to paragraph (1) but cannot use juvenile facilities or programs for reasons not imputable to him/her, the Mayor shall return the paid user fee to him/her. <Amended by Ordinance No. 4792, May 28, 2009>
(4) The Local Autonomy Act, the Local Finance Act and Seoul Metropolitan City Ordinance on the Management of Public Property and Commodities shall apply to the imposition and collection of user fees not prescribed by this Ordinance. <Amended by Ordinance No. 4530, May 29, 2007; Ordinance No. 4698, Sep. 30, 2008>
(5) Notwithstanding paragraph (1), the Mayor may give a reduction of 10 percent of a monthly user fee only to females between the ages of 13 and 55 who use a swimming pool among facilities specified in attached Table 1. <Amended by Ordinance No. 4792, May 28, 2009>
(6) Notwithstanding paragraph (1), where a juvenile who carries a multiple children happiness card uses facilities specified in attached Table 1, the Mayor shall give a reduction of 30 percent of a monthly user fee. In such cases, such reduction shall only apply to cases where the number of children mentioned in the multiple children happiness card is three or more. <Newly Inserted by Ordinance No. 4792, May 28, 2009>

Article 9 (Rent, etc. of Rental Apartments) (1) The Mayor shall impose a security deposit and rent calculated according to methods prescribed in the following on tenants of the rental apartments for working juveniles included in juvenile facilities by applying the standard price of the standard security deposit and the standard rent of the permanent rental house announced by the Ministry of Land, Infrastructure and Transport, and collect the security deposit and rent from them: <Amended by Ordinance No. 4629, May 29, 2008; Ordinance No. 4698, Sep. 30, 2008; Ordinance No. 5799, Jan. 2, 2015>
1. Security deposit = standard price of standard security deposit (per㎡) × area for exclusive use (㎡) ÷ number of tenants per household;
2. Rent (monthly) = standard price of standard rent (per㎡) × area for exclusive use (㎡) ÷ number of tenants per household.
(2) Where the Mayor enters into a rental agreement, he/she shall collect a security deposit under paragraph (1): Provided, That where necessary due to the conditions of a payer, he/she may allow the payer to pay the security deposit in installments. <Amended by Ordinance No. 4698, Sep. 30, 2008>

CHAPTER III ENTRUSTMENT OF OPERATION Article 10 (Delegation or Entrustment of Authority) (1) The Mayor may delegate the following authority over juvenile facilities specified in attached Table 1 to the head of an autonomous Gu or entrust such authority to a juvenile organization, as prescribed by the Rules: Provided, That where he/she delegates the authority to the head of an autonomous Gu, he/she may subsidize operating expenses, etc. within the budgetary limits in consideration of the financial conditions of the autonomous Gu, such as the level of its financial self-sufficiency: <Amended by Ordinance No. 4698, Sep. 30, 2008; Ordinance No. 4792, May 28, 2009>
1. Operation of juvenile facilities under Article 5;
2. Recruitment of members and issuance of membership cards under Article 6 (2);
3. Determination and public relations of the opening hours under proviso to Article 7 (1) and paragraph (2) of the aforesaid Article;
4. Collection, reduction or exemption, and return of user fees under Article 8;
5. Imposition and collection of security deposits and rent under Article 9.
(2) Where the Mayor operates juvenile facilities by entrusting the operation of juvenile facilities to a juvenile organization pursuant to the main sentence of paragraph (1), he/she may require the juvenile organization to apply mutatis mutandis Seoul Metropolitan City Ordinance on Entrustment of Administrative Affairs to Non-governmental Organization to matters not prescribed by this Ordinance, and apply mutatis mutandis the Financial and Accounting Rules of Social Welfare Corporations and Social Welfare Facilities to necessary matters concerning budget and accounting. <Amended by Ordinance No. 4792, May 28, 2009; Ordinance No. 5799, Jan. 2, 2015>

Article 11 (Regulations Governing Operation) (1) Where the Mayor operates juvenile facilities by entrusting the operation of juvenile facilities to a juvenile organization, he/she shall prescribe standards concerning the organization, human resource management, remuneration, property and commodity management, safety management, procedures and standards for handling affairs, guidance, supervision, evaluation of operation, etc. for each juvenile facility, and inform a person who operates the juvenile facility after being entrusted with the operation of the juvenile facility of such standards. <Amended by Ordinance No. 4792, May 28, 2009>
(2) A person who operates a juvenile facility after being entrusted with the operation thereof shall prepare and keep the regulations governing the operation thereof meeting standards informed pursuant to paragraph (1). <Amended by Ordinance No. 4698, Sep. 30, 2008; Ordinance No. 5799, Jan. 2, 2015>
(3) Where a person who operates a juvenile facility after being entrusted with the operation thereof has prepared the regulations governing the operation thereof pursuant to paragraph (2), he/she shall report the regulations governing the operation thereof to the Mayor. <Amended by Ordinance No. 4367, Mar. 16, 2006; Ordinance No. 4698, Sep. 30, 2008>

CHAPTER IV ASSOCIATION OF JUVENILE FACILITIES OF SEOUL METROPOLITAN CITY Article 12 (Organization and Operation) (1) For the establishment of the mutual interchange system and balanced development, juvenile facilities may organize and operate the association of juvenile facilities of Seoul Metropolitan City (hereinafter referred to as the "Association of facilities") pursuant to Article 40 of the Juvenile Activity Promotion Act. In such cases, juvenile facilities shall obtain approval from the Mayor in advance. <Newly Inserted by Ordinance No. 4792, May 28, 2009; Ordinance No. 5329, Jul. 30, 2012>
(2) The Association of facilities shall be a nonprofit corporation or nonprofit organization.
(3) The Association of facilities shall be formed by obtaining registration of the establishment thereof or registration as an organization at the location of its main office.
(4) An office of the Association of facilities may be established in a juvenile training facility.

Article 13 (Projects, etc.) (1) The Association of facilities shall perform the following projects: <Newly Inserted by Ordinance No. 4792, May 28, 2009; Ordinance No. 5329, Jul. 30, 2012>
1. Cooperation in and support for projects and activities performed by juvenile facilities which are members;
2. Study and training, education and interchange for the improvement of expertise of leaders of juveniles;
3. Juvenile training activities, counselling activities, and revitalization of specialized business;
4. Public relations and action campaign concerning the safety of juvenile facilities;
5. Survey and research on, and support for juvenile policies;
6. Other projects deemed necessary by the Mayor for the operation and development of juvenile facilities.
(2) The Mayor may subsidize expenses incurred in the operation of the Association of facilities, such as operating expenses, within the budgetary limits.
(3) The Mayor shall direct and supervise the operation of projects of the Association of facilities for which he/she provides subsidies.
