SEOUL METROPOLITAN GOVERNMENT ENFORCEMENT RULE OF THE ORDINANCE ON THE PROMOTION OF TRANSPORTATION CONVENIENCE OF MOBILITY DISADVANTAGED PERSONS

Article 1 (Purpose) The purpose of this Rule is to prescribe matters authorized by the Seoul Metropolitan Government Ordinance on the Promotion of Transportation Convenience of Mobility Disadvantaged Persons and matters necessary for the enforcement thereof. <Amended by Rule No. 4143, Feb. 23, 2017; Rule No. 4303, Oct. 10, 2019>

Article 6 (Qualification Criteria for Employees of Transportation Support Center) (1) In order for a person to be qualified for employment at the transportation support center under Article 11 (5) of the Seoul Metropolitan Government Ordinance on the Promotion of Transportation Convenience of Mobility Disadvantaged Persons (hereinafter referred to as the “Ordinance”), the person shall meet any of the following qualification criteria: <Amended by Rule No. 4303, Oct. 10, 2019>
1. A qualified social worker, a transportation engineer, a professional transportation engineer, or an engineer or a professional engineer in the field of communications under the Social Welfare Services Act or the National Technical Qualifications Act;
2. A graduate from a department related to social welfare or transportation in a junior college or a higher educational institution;
3. A person who has at least one year's experience performing duties in an area of social welfare or transportation for the State, a local government or a legal entity, an organization, a school, or a research institute authorized by or registered by the State or a local government;
4. A person who has at least two years' experience operating vehicles in an institution, an organization, or a facility for social welfare or an organization or a facility related to mobility disadvantaged persons or a person who has at least one year's experience operating a vehicle that is a special means of transportation under subparagraph 8 of Article 2 of the Act on Promotion of the Transportation Convenience of Mobility Disadvantaged Persons (hereinafter referred to as "special means of transportation");
5. A person who has at least two years' experience working for an institution, an organization, or a facility for social welfare or an organization or a facility related to mobility disadvantaged persons;
6. A person who is qualified as an information processing engineer or a professional information processing engineer as may be necessary for the operation of the transportation support center, a person who has at least two years' experience working in an field of electronic computer systems, or a person who has at least one year's experience working as a telephone operator;
7. The scope of persons whose qualifications, techniques, skills, and career cannot be included in the qualifications and career requirements under subparagraphs 1 through 6 shall be determined by the head of the transportation support center with approval from the Mayor case by case.
(2) In order for a person to become the head of the transportation support center, the person shall meet the qualification requirements under any of paragraph (1) 1 through 3 and shall have a total of at least two years' experience working for a legal entity, an organization, or a public agency in a related area.

Article 7 (Application for Use of Special Means of Transportation) (1) A person eligible to use special means of transportation under Article 15 (1) of the Ordinance shall file an application with the transportation support center by telephone, in writing, or through a computer communications network. <Amended by Rule No. 4143, Feb. 23, 2017>
(2) The transportation support center shall, upon receiving an application for the use of special means of transportation pursuant to paragraph (1), examine whether the applicant is a person eligible under paragraph (1) and shall take measures to provide the applicant with a special means of transportation available at the nearest distance to the applicant.
(3) If the Mayor intends to place limitations on the scope of persons eligible for the use of special means of transportation, taking into consideration the number of vehicles in operation, the rate of satisfaction of demands for special means of transportation (hereinafter referred to as "demand satisfaction rate"), and other factors, in order to minimize inconvenience that may be caused by keeping users waiting for a long time to use special means of transportation and in order to ensure the efficient use of special means of transportation, the Mayor shall give public notice of such limitations through the official bulletin of the Seoul Metropolitan Government and shall conduct public relations activities on the limitations. <Amended by Rule No. 4143, Feb. 23, 2017>
(4) The transportation center shall always keep data about programs for the operation of special means of transportation, the current status of vehicles in operation and drivers in service, and service regulations in order to provide users with convenience in using and may keep equipment and tools for assisting mobility disadvantaged persons in transportation convenience.

Article 8 (Operation of Special Means of Transportation) (1) In principle, special means of transportation shall be operated within the boundaries of the Seoul Metropolitan Government (hereinafter referred to as "the boundaries of Seoul") and, if a destination is located in an area abutting the boundaries of Seoul, a travel to such a destination shall be made with prior approval from the transportation support center: Provided, That such restriction on the area of operation shall not apply to charter buses for the transportation convenience of a group of persons with disabilities. <Amended by Rule No. 4322, Jan. 16, 2020>
(2) The process of requesting a special means of transportation and the guidelines for the use of special means of transportation under Article 14 (3) of the Ordinance are as follows:
1. The on-duty staff of the transportation support center shall, upon receiving a request for a special means of transportation, dispatch a special means of transportation available quickly after verifying the applicant's eligibility and shall inform the eligible person of how to use the special means of transportation and the fare rate for the use. If there are many requests from eligible persons, the priority for the use of special means of transportation shall be given basically in the order of receipt of requests;
2. Upon receiving a reservation request from an eligible person, the transportation support center shall take measures to enable him or her to use special means of transportation at the time and place designated by him or her; an eligible person shall make a reservation within 24 hours before the time at which he or she intends to use special means of transportation, and, regarding a reservation, the transportation support center shall confirm within one hour before the time of intended use whether the person actually intends to use the requested service and shall take appropriate measures;
3. Matters about which an eligible person shall make a request and consult with the transportation support center with regard to purposes of use and the time schedule for use are as follows:
(a) Where it is necessary to use special means of transportation on a regular basis for a specified period for medical treatment or commuting to and from work or school: From the first day through the tenth day of each month;
(b) Where it is necessary to temporarily use special means of transportation continuously for not less than 24 hours: Within 72 hours before the time of intended use;
4. As regards the use of special means of transportation under the items of subparagraph 3, the time of introduction may be determined separately, taking into consideration the number of vehicles in operation, the demand satisfaction rate, and the performance of the operation of special means of transportation.
(3) When the transportation support center receives a request from an eligible person, it may acquire information in advance about physical particulars or aids in need, which may be helpful in providing transportation service to the person, with the person's consent thereto.
(4) The driver of each special means of transportation shall assist users with information acquired in advance so as to avoid inconvenience in users' boarding and alighting.
(5) Further specific guidelines for receiving and processing requests for the use of special means of transportation shall be prescribed separately by the Mayor or an entrusted operator with the Mayor's approval.
