SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE PROMOTION AND SUPPORT OF THE DRONE INDUSTRY

SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE PROMOTION AND SUPPORT OF THE DRONE INDUSTRY

Article 1 (Purpose) The purpose of this Ordinance shall be to contribute to the economic development of Seoul Metropolitan City by promoting the creation of a foundation for the drone industry and the reinforcement of competitiveness under the Act on the Promotion of the Utilization of Drones and the Creation of Infrastructure Therefor. <Amended on Dec. 31, 2020>

Article 2 (Definitions) The terms used in this Ordinance are defined as follows:
1. The term "drone" refers to an apparatus under Article 2(1)1 of the Act on the Promotion of the Utilization of Drones and the Creation of Infrastructure Therefor (hereinafter referred to as the "Act").
2. The term "drone industry" refers to an industry under Article 2(1)3 of the Act.

Article 3 (Relation with Other Statutes) Except in cases specifically prescribed by other statutes concerning drones, what is prescribed by this Ordinance shall be followed. <Amended on Dec. 31, 2020>

Article 4 (Duties of the Mayor) (1) The Mayor of Seoul Metropolitan City (hereinafter referred to as the "Mayor") shall endeavor to share and diffuse drone technology, and create a foundation and reinforce the competitiveness of drone industry. <Amended on Dec. 31, 2020>
(2) The Mayor shall endeavor to improve regulations that hinder the operation of drones and the advancement of the drone industry. <Amended on Dec. 31, 2020>
(3) The Mayor shall endeavor to prevent human and property accidents that could arise from the operation of drones. <Amended on Dec. 31, 2020>

Article 5 (Formulation of a Plan for the Development of the Drone Industry) (1) The Mayor shall formulate and enforce a plan for the development of the drone industry (hereinafter referred to as the "Development Plan"). <Amended on Dec. 31, 2020>
(2) The Development Plan under paragraph (1) above shall include the following: <Amended on Dec. 31, 2020; May 20, 2021>
1. Matters concerning the fundamental objective and direction for the promotion of the drone industry;
2. Matters concerning a plan for training of experts in the drone industry;
3. Matters concerning the startup, management, and technical support of drone business operators;
4. Matters concerning the establishment of the drone industry projects for events, technology development, training, research, etc.;
5. Matters concerning information exchange and base expansion of the drone industry;
6. Matters concerning investment expansion and financial resources to promote a drone industry;
7. Matters concerning the provision of places safe for experiments regarding the operation of drones;
8. Matters concerning the safe operation of drones and the protection of privacy;
9. Matters concerning the development, use, etc. of spatial information using drones; and
10. Other matters necessary for the promotion of the drone industry.
(3) Where necessary to formulate an implementation plan, the Mayor may request the related materials to heads of the relevant administrative agencies or other organizations.

Article 6 (Development, Support, etc. of the Drone Industry) (1) The Mayor may promote projects for the Development Plan under Article 5 severally and jointly with state agencies, government-funded research institutes, public institutions, universities, businesses, etc. <Amended on Dec. 31, 2020>
(2) The Mayor may consign agencies or organizations participating in joint projects with all or part of the affairs concerning the development of the drone industry to efficiently promote projects stipulated by paragraph (1) above. <Amended on Dec. 31, 2020>
(3) The Mayor may provide legal aid services to resolve disputes related to the development and operation of drones by people engaged in a drone industry. <Amended on Dec. 31, 2020>
(4) The Mayor may support the necessary expenses within a budgetary limit for a person who promotes drone research, the drone industry development, etc. <Amended on Dec. 31, 2020>

Article 7 (Expansion of Base for Drones) (1) The Mayor may provide the following support to expand the base for drones: <Amended on Dec. 31, 2020>
1. Provision and consultation about drone-related information;
2. Administrative support for the promotion of the effective use of drones; or
3. Other matters that the Mayor recognizes as necessary to expand a base for drones.
(2) The Mayor may promote projects for expansion of the base for drones, such as contests, events, etc. and may provide subsidies within a budgetary limit for public institutions, corporations, organizations, etc. that promote the projects. <Amended on Dec. 31, 2020; May 20, 2021>

Article 7-2 (Projects to Support Training on Drones) (1) The Mayor may promote the following support projects related to the training on drones to reinforce competence, such as the use of drones:
1. Project to operate and support drone-related experience programs;
2. Project to support the acquisition of drone-related certificates; and
3. Other support projects related to the training on drones that the Mayor recognizes as necessary.
(2) The Mayor may provide subsidies within a budgetary limit for public institutions, corporations, organizations, etc. that promote the projects related to the training on drones under paragraph (1) above.

Article 8 (Construction of Drone Testbeds) The Mayor shall endeavor to construct testbeds for pilot application and demonstration of drone technology. <Amended on Dec. 31, 2020>

Article 9 (Safety Training) The Mayor may implement the following safety training for the safe operation of drones: <Amended on Dec. 31, 2020>
1. Training on safe operation for people who fly drones;
2. Training on safety for people engaged in a drone industry; and
3. Other trainings that the Mayor recognizes as necessary for safety.

Article 10 (Survey) (1) The Mayor shall conduct a survey of the drone industry to formulate and enforce the drone industry-related policies. <Amended on Dec. 31, 2020>
(2) The Mayor shall separately prescribe matters necessary for the survey, method of survey, etc. under paragraph (1) above.

Article 11 (Citations) The Mayor may honor individuals, public officials, organizations, corporations, etc. that are recognized as substantially contributing to drone R&D, advancement of the drone industry, etc. <Amended on Dec. 31, 2020>

Article 12 (Enforcement Rules) Matters required to enforce this Ordinance shall be prescribed as rules.
