SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON EMERGENCY MEDICAL SERVICE ASSISTANCE

Article 1 (Purpose) The purpose of this Ordinance is to provide for matters regarding assistance necessary to enable citizens to obtain prompt and adequate emergency medical services under emergency conditions, and regarding the establishment, management, etc. of emergency equipment.

Article 2 (Definitions) The definitions of terms used in this Ordinance shall be as follows:
1.The term ¡°emergency patient¡± means a patient incapable of preserving his/her own life or facing the possibility of suffering a grave mental or physical harm unless he/she promptly undergoes a required first-aid treatment, or a person under a corresponding case, due to any disease, childbirth, injury or other emergency conditions caused by any accident or disaster, who is prescribed by Ordinance of the Ministry of Health and Welfare;
2.The term ¡°emergency medical service¡± means such measures as consultation, rescue, transfer, first-aid treatment, and medical examination and treatment that are performed for emergency patients during the process from the occurrence of emergency patients to the recovery from the risk of death or to the removal of a grave mental or physical harm;
3.The term ¡°first-aid treatment¡± means an urgently required treatment for the purpose of preventing risks of death or significant aggravation of symptoms, including the securing of airways, restoration of heartbeat, etc. that are applied to emergency patients as kinds of emergency medical service activities;
4.The term ¡°person engaged in emergency medical service¡± means a physician or paramedic who provides emergency medical services for emergency patients within the scope of license or qualification obtained under conditions determined by related Acts and subordinate statutes;
5.The term ¡°emergency medical institutions¡± means the National Emergency Medical Center, regional emergency medical centers, specialized emergency medical centers, local emergency medical centers, and local emergency medical institutions, which are designated in conformity with this Act, from among medical institutions under Article 3 of the Medical Service Act;
6.The term ¡°ambulances, etc.¡± means such means of transportation as automobiles, ships and aircraft used for emergency medical services including for the transfer of emergency patients;
7.The term ¡°emergency medical institutions, etc.¡± means emergency medical institutions, operators of ambulances, etc., and emergency medical service information centers;
8.The term ¡°business for transferring emergency patients¡± means the business of transferring emergency patients, etc. by ambulance, etc.;
9.The term ¡°automated external defibrillator (AED)¡± means a medical device that is designed to revive the heart of a patient suffering sudden cardiac arrest by administering an electrical impulse to his/her heart.

Article 3 (Provision of Emergency Medical Services) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the ¡°Mayor¡±) shall devise and implement policies to provide emergency medical services such as the protection of emergency patients, the establishment and operation of and assistance to emergency medical institutions, etc., the training of persons engaged in emergency medical services, and the securing of the means of transportation for emergency transfer.

Article 4 (Establishment and Implementation of Seoul Metropolitan Government Implementation Plan for Emergency Medical Services) (1) The Mayor shall establish and implement a Seoul Metropolitan Government Implementation Plan for Emergency Medical Services in accordance with a master plan for emergency medical services under Article 13-2 (1) of the Emergency Medical Service Act (hereinafter referred to as the ¡°Act¡±).
(2) Where it is necessary to establish and implement the Seoul Metropolitan Government Implementation Plan for Emergency Medical Services under paragraph (1), the Mayor may require institutions, organizations, etc. related to emergency medical services to render cooperation such as the submission of materials.

Article 5 (Establishment, etc. of Plans for Education and Publicity on Rescue and First-Aid Treatment) The Mayor shall establish and implement an annual plan for the education and publicity of the essentials, etc. of rescue and first-aid treatment in accordance with Article 14 (2) of the Act.

Article 6 (Assistance) (1) The Mayor may provide necessary financial assistance based on Article 16 of the Act to the facilities, etc. required to be equipped with automated external defibrillators and other emergency equipment for cardiopulmonary resuscitation, within budgetary limits.
(2) Facilities subject to financial assistance shall be the facilities described in Article 47-2 of the Act.

Article 7 (Enforcement Rule) Necessary matters regarding the enforcement of this Ordinance shall be prescribed by the Enforcement Rule.
