SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON ESTABLISHMENT AND OPERATION OF THE SAFETY EXPERIENCE CENTER
Amendment of Other Laws No. 6386, Jan. 05, 2017 Partial Amendment No. 7205, May. 16, 2019

Article 1 (Purpose) The purpose of this Ordinance is to prescribe the matters necessary for establishing and operating the Seoul Metropolitan Government Safety Experience Center in order to develope citizens' ability to cope with emergencies, including various disasters, accidents, and other urgent situations and arouse their attention to safety accidents. <Amended by Ordinance No. 4555, Oct 1, 2007; Ordinance No. 6386, Jan. 5, 2017>

Article 1 (Purpose) The purpose of this Ordinance is to prescribe matters necessary for establishing and operating Seoul Metropolitan Government safety experience centers in order to develop citizens' ability to cope with emergencies, including various disasters, accidents, and other urgent situations and to increase their attention to safety accidents. <Amended by Ordinance No. 4555, Oct 1, 2007; Ordinance No. 6386, Jan. 5, 2017>

Article 2 (Establishment and Function) The name and location, etc. of the Seoul Metropolitan Government Safety Experience Center (hereinafter referred to as "Experience Center") to be established pursuant to this Ordinance shall be prescribed by the Enforcement Rule of this Ordinance, and the Experience Center shall conduct a disaster-prevention training and daily safety education for citizens through providing them with virtual experience against various disasters. <Amended by Ordinance No. 4555, Oct 1, 2007; Ordinance No. 6249, May 19, 2016; Ordinance No. 6386, Jan. 5, 2017>

Article 2 (Establishment and Function) (1) The name, location, etc. of a Seoul Metropolitan Government safety experience center to be established pursuant to this Ordinance (hereinafter referred to as "experience center") shall be prescribed by rule of the Seoul Metropolitan Government. <Amended by Ordinance No. 4555, Oct. 1, 2007; Ordinance No. 6249, May 19, 2016; Ordinance No. 6386, Jan. 5, 2017; Ordinance No. 7205, May 16, 2019>
(2) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") shall endeavor to establish an experience center in each region, in consideration of convenience, accessibility, etc. of citizens. <Newly Inserted by Ordinance No. 7205, May 16, 2019>
(3) An experience center shall conduct disaster-prevention training and daily safety education for citizens by providing them with virtual experience against various disasters. <Newly Inserted by Ordinance No. 7205, May 16, 2019>

Article 3 (Open and Closure) (1) The Experience Center shall be daily open to the general public, except the date of closure as prescribed in paragraph (2).
(2) The Experience Center shall close on the date under each of the following subparagraphs: <Amended by Ordinance No. 6249, May 19, 2016; Ordinance No. 6386, Jan. 5, 2017>
1. Each January 1st, Lunar New Year's Day, Chuseok;
2. Each Monday;
3. The date of closure as designated by the Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor").
(3) The Experience Center shall be open from 9:00 A.M. till 5:00 P.M. <Amended by Ordinance No. 4555, Oct 1, 2007>

(5) Where any inevitable circumstance arises, the Mayor may alter the opening time in paragraph (3) for a certain period of time. <by Ordinance No. 4555, Oct 1, 2007>
(6) When the Mayor intends to close the Experience Center temporarily under paragraph (2) 3 or alter the opening time under paragraph (3), he/she shall make a prior public notification thereof by posting it on the official gazette or the Internet. <Amended by Ordinance No. 4555, Oct 1, 2007; Ordinance No. 6386, Jan. 5, 2017>

Article 3 (Opening and Closure) (1) An experience center shall be daily open to the general public, except on the dates of closure prescribed in paragraph (2).
(2) An experience center shall be closed on the following dates: <Amended by Ordinance No. 6249, May 19, 2016; Ordinance No. 6386, Jan. 5, 2017; Ordinance No. 7205, May 16, 2019>
1. Each January 1st, Lunar New Year's Day, and Chuseok;
2. Each Monday;
3. The date of closure designated by the Mayor.
(3) An experience center shall be open from 9:00 A.M. until 5:00 P.M. <Amended by Ordinance No. 4555, Oct. 1, 2007>

(5) Where any inevitable circumstance arises, the Mayor may alter the opening time referred to in paragraph (3) for a certain period of time. <Amended by Ordinance No. 4555, Oct. 1, 2007>
(6) When the Mayor temporarily determines the date of closure of an experience center under paragraph (2) 3 or alters the opening time under paragraph (5), he or she shall publicly announce such determination or alteration in the public gazette or on the Internet. <Amended by Ordinance No. 4555, Oct. 1, 2007; Ordinance No. 6386, Jan. 5, 2017>

Article 4 (Eligible Users) (1) Those who are eligible to use the Experience Center shall be limited to the citizens of the Seoul Metropolitan Government: Provided, That the Mayor may restrict use of the Experience Center with respect to any of the following persons: <Amended by Ordinance No. 6386, Jan. 5, 2017>
1. A person who possesses any article which is dangerous, nasty-smelling or disgusting;
2. A person deemed by the Mayor necessary to be restricted, to protect the Experience Center and maintain order while the users are using the Experience Center;
3. The elderly, the infirm and other persons who are deemed, out of safety concerns, unsuitable to use the Experience Center.
(2) Notwithstanding the main sentence of paragraph (1), when the Mayor deems it necessary to operate the Experience Center, he/she may authorize citizens of other city or Do, etc. to use the Experience Center. <Amended by Ordinance No. 6386, Jan. 5, 2017>

Article 4 (Eligible Users) (1) Those who are eligible to use experience centers shall be limited to the citizens of Seoul: Provided, That the Mayor may restrict the following persons from using such experience centers: <Amended by Ordinance No. 6386, Jan. 5, 2017>
1. A person who possesses any article which is dangerous, nasty-smelling or disgusting;
2. A person deemed by the Mayor necessary to be restricted, to protect the experience centers and maintain order therein;
3. The elderly, the infirm and other persons who are deemed, out of safety concerns, unsuitable to use the experience centers.
(2) Notwithstanding the main sentence of paragraph (1), when the Mayor deems it necessary to operate experience centers, he or she may authorize citizens of other city or Do, etc. to use the experience centers. <Amended by Ordinance No. 6386, Jan. 5, 2017>

Article 5 (Method, Etc. of Use) (1) In principle, a group of at least ten users may use the Experience Center. <Amended by Ordinance No. 6386, Jan. 5, 2017>
(2) Notwithstanding paragraph (1), where individual persons wish to use the Experience Center, the Mayor may authorize them to use, as a group of certain number of users, the Experience Center. <Amended by Ordinance No. 6386, Jan. 5, 2017>
(3) A child of up to 12 years old who intends to use the Experience Center shall accompany an adult leader. In this case, if the child is using the Experience Center within a group of up to 20 children, he/she may be accompanied by one adult user, and there shall be one additional adult user for each and every five children exceeding 20 children.
(4) A person who intends to use the Experience Center may, by phone, the Internet or other means of communication, make a reservation of the date and time, etc. of his/her intended use, no later than two days prior to the date of his/her expected use.

Article 5 (Method of Use) (1) In principle, a group of at least 10 persons shall be permitted to use an experience center. <Amended by Ordinance No. 6386, Jan. 5, 2017>
(2) Notwithstanding paragraph (1), where individual persons intend to use an experience center, the Mayor may authorize them to use, as a group of certain number of users, the experience center. <Amended by Ordinance No. 6386, Jan. 5, 2017>
(3) A child of not more than 12 years of age who intends to use an experience center shall be accompanied by an adult leader. In such cases, if a group of up to 20 children use the experience center, they may be accompanied by one adult, and one more adult shall be added for each and every five children exceeding 20 children.
(4) A person who intends to use an experience center may, by phone, the Internet or other means of communication, make a reservation of the date and time, etc. of his or her intended use, no later than two days prior to the date of his or her expected use.
(5) No fee shall be charged to use an experience center. <Newly Inserted by Ordinance No. 6249, May 19, 2016>

Article 6 (Restriction on Service Hours, Etc.) When the Mayor deems it necessary to operate the Experience Center, he/she may restrict the service time, frequency of use, opening time, etc. of the Experience Center; and the aforementioned restriction shall be prescribed by the Enforcement Rule of this Ordinance. <Amended by Ordinance No. 6249, May 19, 2016>

Article 6 (Restriction on Service Hours) When the Mayor deems it necessary to operate an experience center, he or she may restrict the service time, frequency of use, opening time, etc. of the experience center, and in such cases matters regarding such restriction shall be prescribed by rule of the Seoul Metropolitan Government. <Amended by Ordinance No. 6249, May 19, 2016>

Article 7 (Prohibited Behaviors) (1) While using the Experience Center, the users may not engage in the behaviors falling under any of the following subparagraphs: <Amended by Ordinance No. 6386, Jan. 5, 2017>
1. Smoking a cigarette, drinking alcoholic beverage and eating food;
2. Leaving the group without permission of the guide;
3. Arbitrarily touching or operating the equipment within the Experience Center;
4. Refusing to comply with the guide's legitimate control;
5. Other behaviors threatening other users' safety.
(2) With respect to the person who has committed the behaviors falling under any of the subparagraphs of paragraph (1), the Mayor may order him/her to leave the Experience Center. <Amended by Ordinance No. 6386, Jan. 5, 2017>

2. Leaving the group without permission of the guide;
3. Arbitrarily touching or operating the equipment within the experience centers;
4. Refusing to comply with the guide's legitimate control;
5. Other behaviors threatening other users' safety.
(2) With respect to the person who has engaged in a behavior falling under any of the subparagraphs of paragraph (1), the Mayor may order him or her to leave the experience center. <Amended by Ordinance No. 6386, Jan. 5, 2017>

Article 10 (Management of Properties and Articles) (1) When a user of the Experience Center destroys, damages or stains the exhibit and/or facilities within the Experience Center, he/she may be liable to compensate the damages equivalent thereto.
(2) The matters not provided for in this Ordinance with respect to management of the properties and articles of the Experience Center shall be prescribed by the Seoul Metropolitan Government Ordinance on Management of Public Properties and Articles. <Amended by Ordinance No. 4555, Oct 1, 2007; Ordinance No. 6386, Jan. 5, 2017>

Article 10 (Management of Property and Commodities) (1) When a user of an experience center destroys, damages or stains its exhibits or facilities, he or she may be liable to compensate for the relevant damage.
(2) The matters not provided in this Ordinance with respect to the management of the property and commodities of experience centers shall be prescribed by the Seoul Metropolitan Government Ordinance on Public Property and Commodity Management. <Amended by Ordinance No. 4555, Oct. 1, 2007; Ordinance No. 6386, Jan. 5, 2017>

Article 11 (Insurance) Where necessary to prepare against possible breakdown of properties and articles of the Experience Center and users' safety accidents, the Mayor may purchase a property insurance.

Article 11 (Purchase of Insurance) Where necessary to prepare against a destruction of the property and commodities of experience centers and users' safety accidents, the Mayor may purchase a non-life insurance.

Article 12 (Establishment and Operation of Convenient Facilities) (1) To promote safety of the users of the Experience Center, the Mayor may establish and operate the convenient facilities falling under each of the following subparagraphs: <Amended by Ordinance No. 6386, Jan. 5, 2017>
1. Cafeteria;
2. Gift shop;
3. Other facilities that the Mayor deems necessary.
(2) When it is necessary to efficiently manage and operate the convenient facilities under paragraph (1), the Mayor may entrust the management and operation to a corporation or group or its institutions or individuals.
(3) Other matters not provided for in this Ordinance with respect to management and operation and entrustment of the convenient facilities shall be prescribed by the Seoul Metropolitan Government Ordinance on Management of Public Properties and Articles. <Amended by Ordinance No. 4555, Oct 1, 2007; Ordinance No. 6386, Jan. 5, 2017>

Article 12 (Establishment and Operation of Convenient Facilities) (1) To promote convenience of the users of experience centers, the Mayor may establish and operate the following convenient facilities: <Amended by Ordinance No. 6386, Jan. 5, 2017>
1. Cafeteria;
2. Gift shop;
3. Other facilities that the Mayor deems necessary.
(2) When it is necessary to efficiently manage and operate the convenient facilities under paragraph (1), the Mayor may entrust the management and operation of such facilities to a corporation, an organization, or an affiliated institution of such corporation or organization, or an individual.
(3) Other matters not provided in this Ordinance with respect to the management, operation, and entrustment of the convenient facilities shall be governed by the Seoul Metropolitan Government Ordinance on Public Property and Commodity Management. <Amended by Ordinance No. 4555, Oct. 1, 2007; Ordinance No. 6386, Jan. 5, 2017>

Article 13 (Enforcement Rules) The matters necessary for enforcement of this Ordinance shall be provided for by the Enforcement Rule of this Ordinance.
