SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE SUPPORT FOR PROMOTING WIN-WIN EXCHANGES
Enactment No. 6012, Oct. 08, 2015 Partial Amendment No. 7155, May. 16, 2019

Article 1 (Purpose) The purpose of this Ordinance is to contribute to balanced development between cities and rural areas and between regions; and to the improvement of living standards, by meeting citizens' demand for leisure and welfare, and by enhancing the social and economic vitality of the regions participating in exchange and cooperation through the promotion of win-win exchanges between the Seoul Metropolitan City and other regions.

Article 1 (Purpose) The purpose of this Ordinance is to contribute to balanced development between cities and rural areas and between regions and to the improvement of living standards, by meeting citizens' demand for leisure and welfare and by enhancing the social and economic vitality of the regions participating in exchange and cooperation through the promotion of win-win exchanges between the Seoul Metropolitan Government and other regions under the Promotion of Mutual Exchange between Cities and Agricultural or Fishing Villages Act and the Framework Act on the National Land.

Article 2 (Definitions) The terms used in this Ordinance shall be defined as follows:
1. The term "win-win exchanges" means exchanges of human resources between Seoul and other regions and between cities and rural areas for mutual development and the exchanges, trade, provision, etc, of commodities, experiences, culture, tourism services, etc.;
2. The term "friendly exchange agreement" means a promise to conduct certain activities for exchanges in various fields, such as economics, culture, tourism, and the distribution of agricultural products, between local governments.

Article 2 (Definitions) The terms used in this Ordinance shall be defined as follows:
1. The term "win-win exchanges" means any exchange of human resources between Seoul and other regions and between cities and rural areas for mutual development and any exchange, trade, provision, etc, of commodities including agricultural and fishery products, experiences, culture, tourism services, etc.;
2. The term "friendly exchange agreement" means a promise to conduct certain activities for exchanges in various fields, such as economics, culture, tourism, and the distribution of agricultural products, between local governments.

Article 3 (Basic Principle) The Seoul Metropolitan Government shall recognize and respect the diversity of regions and promote mutual development based on trust so as to promote mutual development through regional exchanges and support win-win cooperation programs.

Article 4 (Mayor's Responsibility) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") shall endeavor to meet citizen's demands by promoting mutual exchanges between citizens of Seoul and residents in rural areas and other regions; and to improve citizens' living standards by maintaining and developing resources in the regions; the Mayor shall also actively implement a policy on the promotion of win-win exchanges between regions.

Article 4 (Mayor's Responsibility) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") shall endeavor to meet citizen's demands by promoting mutual exchanges between citizens of Seoul and residents in rural areas and other regions and to improve citizens' living standards by maintaining and developing resources in the regions and shall actively implement a policy on the promotion of win-win exchanges between regions.

Article 5 (Formulation and Implementation of Plans) The Mayor shall formulate and implement a plan for the following matters to increase win-win exchanges between regions:
1. The basic direction in the policy on win-win exchanges between regions and the goals for the implementation of the policy;
2. The establishment and operation of a public-private cooperation system for promoting win-win exchanges between regions;
3. The execution of friendly exchange agreements with other local governments and the search for and the extension of cooperation programs;
4. Support of non-governmental organizations, research institutes, etc., for promoting win-win exchanges between regions;
5. Other matters necessary for supporting the promotion of win-win exchanges between regions.

Article 5 (Formulation and Implementation of Plans) The Mayor shall formulate and implement an annual plan including the following matters to increase win-win exchanges between regions:
1. The basic direction-setting for the policy on win-win exchanges between regions and the goals for the implementation of the policy;
2. The establishment and operation of a public-private cooperation system for promoting win-win exchanges between regions;
3. The conclusion of friendly exchange agreements with other local governments and the search for and the increase of cooperation programs;
4. Support for non-governmental organizations, research institutes, etc., for promoting win-win exchanges between regions;
5. Other matters necessary for supporting the promotion of win-win exchanges between regions.

Article 6 (Entrustment of Administrative Affairs) (1) If the Mayor deems it necessary for implementing cooperation programs for win-win exchanges between regions, he/she may entrust the programs to a relevant non-profit non-governmental organization or corporation (hereinafter referred to as "operator") in accordance with the Seoul Metropolitan Government Ordinance on Entrustment of Administrative Affairs to the Private Sector. In such cases, the Mayor may subsidize the operator for expenses incurred in operation, within the budget.
(2) The operator shall perform the following functions:
1. Search for and monitoring of programs for win-win cooperation between regions;
2. Research and surveys on win-win cooperation between regions and accumulation and provision of information;
3. The establishment of a network between local governments and a public-private cooperation system and the development of a foundation therefor;
4. The implementation of programs for win-win cooperation between regions in various aspects, including the distribution of agricultural products and back-to-the-farm and back-to-rural-life movements, and education and training therefor;
5. Counseling and consulting on the implementation of detailed programs for win-win cooperation between regions;
6. The establishment, operation, etc. of facilities for providing comprehensive information and conducting exhibitions, publicity activities, etc. for tourism, specialties, culture, etc. of regions.

Article 6 (Cooperation Programs for Win-Win Exchanges) (1) The Mayor may implement the following programs to facilitate and promote win-win exchanges between regions:
1. Search for and monitoring of programs for win-win cooperation between regions;
2. Research on and surveys of win-win cooperation between regions and accumulation and provision of information;
3. Development of a foundation through the establishment of a network between local governments, a public-private cooperation system, etc.;
4. Support for win-win cooperation between regions on the distribution of agricultural and fishery products, and back-to-the-farm and back-to-rural-life movements;
5. Education and consulting to facilitate and promote win-win cooperation between regions;
6. Establishment and operation of facilities for the provision of comprehensive information on regional tourism, specialty products, culture, etc. and for exhibitions, publicity activities, etc. thereon;
7. Other programs the Mayor deems necessary to facilitate and promote win-win cooperation between regions.
(2) The Mayor may subsidize individuals, organizations, other local governments, or public institutions under Article 2 of the Act on the Management of Public Institutions that implement and participate in the programs under the subparagraphs of paragraph (1), within budgetary limits.

Article 7 (Operator's Duties) (1) The operator shall fulfill its duties conscientiously in accordance with relevant statutes and regulations in performing entrusted administrative affairs.
(2) The operator shall not re-entrust any work related to the performance of the entrusted administrative affairs to any other corporation, organization or individual nor shall authorize any other corporation, organization, or individual to act as its agent in connection with such work.

Article 7 (Entrustment of Affairs) (1) The Mayor may entrust part of the programs under the subparagraphs of Article 6 (1) to a related organization, corporation, etc. in accordance with the Seoul Metropolitan Government Ordinance on Entrustment of Administrative Affairs to the Private Sector for the efficient implementation of cooperation programs for win-win exchanges.
(2) The Mayor may grant an entrusted entity subsidies to help it cover the whole or part of the expenses incurred in implementing entrusted cooperation programs for win-win exchanges, within budgetary limits.
(3) The Mayor may require an entrusted entity to report necessary matters in relation to the handling of entrusted affairs or inspect documents, facilities, etc. necessary for guidance for and supervision over entrusted affairs.

Article 8 (Guidance and Supervision) (1) The Mayor may require an entrusted institution to report matters necessary for performing entrusted administrative affairs or may inspect documents, facilities, etc. as necessary for guidance for and supervision over entrusted administrative affairs.
(2) If the Mayor finds any illegality or unreasonableness in the performance of entrusted administrative affairs, in the course of an inspection conducted under paragraph (1), he/she may take necessary measures.
(3) When the Mayor intends to take a measure under paragraph (2), he/she shall notify the entrusted institution thereof in writing and shall provide an opportunity to make statements thereon in advance.

Article 8 (Establishment of Cooperation System) (1) The Mayor shall establish cooperation systems with other local governments, related agencies and organizations to facilitate and promote win-win exchanges between regions.
(2) The Mayor may conclude an agreement with other local governments, related agencies and organizations to promote win-win exchanges between regions, if necessary to establish cooperation systems.

Article 9 (Establishment of Committee) (1) The Regional Win-Win Development Committee of the Seoul Metropolitan Government (hereinafter referred to as the "Committee") may be established to give advice on policies for the promotion of win-win exchanges and cooperation between regions and mutual development; and to deliberate on matters concerning exchanges and cooperation.
(2) The functions of the Committee shall be performed by the Committee for Deliberation on the Management of Funds in Domestic Cooperation Accounts of the External Cooperation Fund under Article 8 of the Seoul Metropolitan Government Ordinance on the Establishment and Operation of the External Cooperation Fund.
(3) The Committee shall deliberate on the following matters:
1. The formulation and evaluation of plans for promoting win-win exchanges between regions;
2. The entrustment and operation of programs for win-win cooperation between regions;
3. The formulation and evaluation of plans for operating entrusted programs for win-win cooperation between regions;
4. Other matters deemed necessary for supporting the promotion of win-win exchanges between regions.

Article 9 (Establishment of Committee) (1) A Regional Win-Win Development Committee of the Seoul Metropolitan Government (hereinafter referred to as the "Committee") may be established to render advice on policies for the promotion of win-win exchanges and cooperation between regions and mutual development; and to deliberate on matters concerning exchanges and cooperation.
(2) The functions of the Committee shall be performed by the committee for deliberation on the fund management of the domestic cooperation accounts of the external cooperation fund under Article 8 of the Seoul Metropolitan Government Ordinance on the Establishment and Operation of the External Cooperation Fund.
(3) The Committee shall deliberate on the following matters:
1. The formulation and evaluation of plans for promoting win-win exchanges between regions;
2. The entrustment and operation of win-win cooperation programs between regions;
3. The formulation and evaluation of plans for operating entrusted programs for win-win cooperation between regions;
4. Other matters deemed necessary for supporting the promotion of win-win exchanges between regions.

Article 10 (Relationship to Other Statutes, Regulations, etc.) Except as otherwise expressly provided for in any other statute, regulation or municipal ordinance, the provisions of this Ordinance shall apply where a policy on win-win exchanges between regions is implemented.
