SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE SUPPORT FOR INFANT AND CHILD DEVELOPMENT

Article 1 (Purpose) The purpose of this Ordinance shall be to prevent developmental delay in infants and children and contribute to their healthy growth by stipulating matters necessary to support their development.



Article 1 (Purpose) The purpose of this Ordinance is to prevent developmental delays in infants and young children and to contribute to their healthy growth by prescribing measures to support their development.




Article 2 (Definitions) The terms used in this Ordinance are defined as follows:
1. The term "infants and children" refers to pre-schoolers under the age of six;
2. The term "guardian" refers to a person in parental authority, a tutor and any other person actually caring for infants or children;
3. The term "development of infants and children" means that infants and children grow healthy according to their developmental characteristics by age;
4. The term "developmental test" refers to a test that is conducted to verify and quantify how much infants and children are delayed in their development by measuring their physical characteristics, cognition, communication, psychology, social emotion, adaptability, etc.



Article 2 (Definitions) The terms used in this Ordinance are defined as follows:
1. The term “infants and young children" refers to pre-schoolers under the age of six;
2. The term “guardian" refers to a person in parental authority, a tutor, or any other person actually caring for an infant or a young child;
3. The term “child development" refers to the healthy growth of infants and young children according to age-specific developmental characteristics;
4. The term “developmental test" refers to a test conducted to identify and quantify the degree of developmental delay using measures of the physical, cognitive, communication, psychological, social emotional and adaptive skills of infants and young children appropriate for their age.




Article 3 (Duties of the Mayor) The Mayor of Seoul Metropolitan City (hereinafter referred to as the "Mayor") shall endeavor to formulate a policy that supports the development of infants and children and secure sufficient finances required therefor.



Article 3 (Duties of the Mayor) The Mayor of Seoul Metropolitan City (hereinafter referred to as the "Mayor") shall establish policies for child development and endeavor to secure necessary funding.




Article 4 (Relation with Other Ordinances) Except in cases specifically prescribed by the relevant ordinances concerning the support for the development of infants and children, what is prescribed by this Ordinance shall be followed.



Article 4 (Relationship with other Ordinances) Unless there are special provisions in other ordinances regarding the support for child development, the provisions of this Ordinance shall apply.




Article 5 (Recipients) The support under this Ordinance shall be provided for infants and children who reside and have their resident registration in Seoul Metropolitan City. Details of recipients shall be determined separately by the Mayor.



Article 5 (Persons Eligible for Support) The persons eligible for support under this Ordinance are infants and young children who are registered as residents of Seoul and actually live in Seoul, as well as their guardians, and the specific targets of support shall be determined by the Mayor.




Article 6 (Formulation of the Master Plan) (1) The Mayor shall formulate the master plan for support for the development of infants and children in Seoul Metropolitan City (hereinafter referred to as the "Master Plan") every five years to systematically and continuously promote a policy for support for the development of infants and children.
(2) The Master Plan shall include the following:
1. Matters concerning the basic direction and objective for support for the development of infants and children;
2. Matters concerning the development of projects and programs for support for the development of infants and children;
3. Matters concerning the analysis and evaluation of the policy for support for the development of infants and children;
4. Matters concerning the improvement of laws and institutions for support for the development of infants and children;
5. Matters concerning the financing necessary for support for the development of infants and children; and
6. Other matters recognized as necessary for support for the development of infants and children.
(3) The Mayor shall formulate an annual implementation plan based on the Master Plan.
(4) The Mayor shall collect opinions from guardians, experts, etc., where the Master Plan and an implementation plan are formulated.



Article 6 (Formulation of Master Plan) (1) The Mayor shall formulate and implement a Seoul Metropolitan Government young family carer support master plan (hereinafter referred to as “master plan") every 5 years to systematically and continuously promote policies supporting the development of infants and young children.
(2) The master plan shall include the following:
1. Basic objectives and direction of child development support;
2. Project and program development to support child development;
3. Analysis and evaluation of policies to support child development;
4. Improvement of laws and systems related to supporting child development;
5. Raising funds to support child development;
6. Other matters deemed necessary to support child development.
(3) The Mayor shall develop an annual implementation plan in accordance with the master plan.
(4) The Mayor shall collect opinions from guardians, relevant experts, etc. when formulating the master plan and implementation plan.




Article 7 (Survey, etc.) The Mayor may conduct a survey of the developmental delay of infants and children, treatment thereof, etc. to efficiently formulate the Master Plan and an implementation plan under Article 6 and may collect and manage statistical information necessary for support for the development of infants and children.



Article 7 (Fact-finding Research) The Mayor may conduct fact-finding research on the current status of developmental delays and treatment of infants and young children, and collect and manage the statistical information necessary to support child development in order to efficiently establish the master plan and implementation plan in accordance with Article 6.




Article 8 (Support Projects) The Mayor may promote the following projects that support the development of infants and children for healthy growth appropriate for their age:
1. Project that supports an inspection of the development of infants and children;
2. Project that supports the treatment of developmental delay in infants and children;
3. Project that supports the provision of education and information to prevent developmental delay in infants and children;
4. Project that supports consultation and psychology of guardians of infants and children; and
5. Other support projects related to the support for the development of infants and children which are recognized as necessary.



Article 8 (Support Projects) The Mayor may promote the following support projects in order to ensure the healthy, age-appropriate growth of infants and young children:
1. Child development test support projects;
2. Projects to support the treatment of infants and young children with developmental delays;
3. Projects to support education and provide information to prevent developmental delays in infants and young children;
4. Counseling and psychological support projects for guardians of infants and young children;
5. Other child development support projects deemed necessary.




Article 9 (Consignment of Tasks) The Mayor may consign professional agencies, organizations, etc. with all or part of the tasks to efficiently implement the support projects under Article 8.



Article 9 (Entrustment of Business Affairs) The Mayor may entrust all or part of the business affairs to specialized institutions and organizations to efficiently carry out support projects in accordance with Article 8.




Article 10 (Restriction on Duplicate Support) The support under this Ordinance may be restricted for a person who is receiving, from autonomous Gus, organizations, agencies, etc., support similar to what is prescribed by this Ordinance.



Article 10 (Restriction on Double Assistance) Autonomous Gus, institutions and organizations, etc. may restrict assistance in accordance with this ordinance to persons who are receiving assistance similar to the assistance provided for in this Ordinance.



Article 11 (Building of Cooperation System) The Mayor may build a cooperation system with related institutions and organizations to efficiently implement a policy that supports the development of infants and children.



Article 11 (Establishment of Cooperative System) The Mayor may establish a cooperative system with related corporations, organizations, etc. to effectively promote policies supporting the development of infants and young children.




Article 12 (Enforcement Rules) Matters required to enforce this Ordinance shall be prescribed as rules.


Article 12 (Enforcement Rule) Matters necessary to enforce this Ordinance shall be prescribed by rule of the Seoul Government.

This Ordinance shall enter into force on the date of its promulgation.
