SEOUL METROPOLITAN GOVERNMENT RULE ON THE OPERATION OF GENERAL WELFARE CENTERS FOR THE AGED

Article 1 (Purpose) The purpose of this Rule is to prescribe matters necessary for the operation of general welfare centers of the Seoul Metropolitan Government for the aged pursuant to the Seoul Metropolitan Government Ordinance on the Establishment and Operation of Social Welfare Facilities. <Amended by Rule No. 3657, Mar. 26, 2009>

Article 2 (Principles of Operation) (1) General welfare centers of the Seoul Metropolitan Government for the aged (hereinafter referred to as "welfare centers") shall be operated to promote the welfare of the aged by providing various facilities for convenience of the aged and other comprehensive welfare services for the aged. <Amended by Rule No. 3657, Mar. 26, 2009>
(2) To be eligible for programs provided by a welfare center, a person shall be a senior citizen aged at least 60 years and registered as a resident of Seoul Metropolitan City (hereinafter referred to as the "City"): Provided, That, if the provisions concerning a specific program in Articles 5 through 14 differ from the foregoing provisions, the different provisions shall apply. <Amended by Rule No. 3657, Mar. 26, 2009>

Article 3 (Organization, etc.) When the head of a general welfare center of the Seoul Metropolitan Government for the aged (hereinafter referred to as the "head of a welfare center") intends to set up or change the organization of the welfare center, he/she shall obtain approval from the Mayor of Seoul Metropolitan City (hereinafter referred to as the "Mayor") thereof in advance. <Amended by Rule No. 3657, Mar. 26, 2009>

Article 4 (Opening Hours, etc.) (1) The opening hours of each welfare center are as follows: <Amended by Rule No. 3657, Mar. 26, 2009>
1. Weekdays: 09:00~18:00;
2. Saturday: 09:00~13:00.
(2) If the head of a welfare center deems it necessary, he/she may extend or reduce the opening hours specified in paragraph (1), In such cases, he/she shall report it to the Mayor and the head of the relevant autonomous Gu within 30 days. <Amended by Rule No. 3657, Mar. 26, 2009>
(3) Each welfare center shall be closed on holidays in accordance with the Rules on Holidays of Public Agencies. <Amended by Rule No. 3657, Mar. 26, 2009>

Article 5 (Counselling Service) (1) The head of each welfare center shall establish and operate a counselling office that shall receive and process various grievances of the aged and help the aged live a stable life, adapting themselves to the society. <Amended by Rule No. 3657, Mar. 26, 2009>
(2) The persons eligible for counselling service shall be limited to senior citizens registered as residents of the City and aged at least 60 years and their family members. <Amended by Rule No. 3657, Mar. 26, 2009>
(3) The head of each welfare center may invite persons who have expertise or seek advice from such persons from time to time for counselling service on matters that need expertise. In such cases, allowances may be paid to such persons, within the budget. <Amended by Rule No. 3657, Mar. 26, 2009>

Article 6 (Programs for Dispatching Domiciliary Care Workers) (1) The head of a welfare center may dispatch domiciliary care workers to senior citizens who suffer from a physical or mental disorder but have no family who can take care of them. <Amended by Rule No. 3657, Mar. 26, 2009>
(2) To be eligible for the service of domiciliary care workers under paragraph (1), a person shall be a beneficiary under the National Basic Living Security Act and a senior citizen registered as a resident of the City and aged at least 65 years (hereinafter referred to as "aged beneficiary"): Provided, That domiciliary care workers may be dispatched to low-income senior citizens who are not aged beneficiaries, if the head of a welfare deems it necessary. <Amended by Rule No. 3657, Mar. 26, 2009>
(3) Domiciliary care workers shall make compassionate visits, provide counselling service to the aged, provide information about the admission to, and the use of, welfare facilities for the aged, and do cleaning, laundering, cooking, errands for the aged. <Amended by Rule No. 3657, Mar. 26, 2009>
(4) A person who wishes to have a domiciliary care worker dispatched shall fill out the attached Form for requesting the dispatch of a domiciliary care worker and shall submit the written request to the head of the relevant welfare center. <Amended by Rule No. 3657, Mar. 26, 2009>

Article 7 (Long-Term Care Services) (1) The head of a welfare center may operate a long-term care institution to provide daytime and nighttime protection services to the beneficiaries of long-term care benefits: Provided, That the senior citizens who have used a daytime protection facility since before the long-term care insurance system for the aged commenced may use the long-term care institution, whether or not they are beneficiaries of long-term care benefits. <Amended by Rule No. 3657, Mar. 26, 2009>
(2) If the head of a welfare center has difficulties in operating a long-term care institution due to local conditions or the situation of facilities, he/she may establish and operate a daytime protection facility in the welfare center for senior citizens who suffer from a physical or mental disorder, infirmity in mind or body, dementia, or a stroke but have no family who can take care of them. <Amended by Rule No. 3657, Mar. 26, 2009>

Article 8 (Social and Educational Programs) (1) The head of a welfare center may conduct educational programs on adaptation to the environment, health of the aged, nursing of the aged, distinct characteristics of the aged, etc. for senior citizens, their families, and local residents. <Amended by Rule No. 3657, Mar. 26, 2009>
(2) The head of a welfare center may establish and operate classes for pastime activities and learning activities for the valuable retired life of the aged, such as reading, calligraphy, gymnastics, recreation, janggi (or Korean chess), and baduk (or Go). <Amended by Rule No. 3657, Mar. 26, 2009>
(3) The head of a welfare center shall assist senior citizens in organizing groups by functions, specialties, and pastimes and conducting active and vigorous activities in group. <Amended by Rule No. 3657, Mar. 26, 2009>
(4) The head of each welfare center may invite persons who have expertise or seek advice from such persons from time to time for educational programs that need expertise. In such cases, allowances may be paid to such persons, within the budget. <Amended by Rule No. 3657, Mar. 26, 2009>

Article 9 (Service for Welfare Benefits) In order to provide convenience to the aged and promote the stabilization of their lives, the head of a welfare center may establish and operate a cafeteria, a public bath, a barbershop, a beauty shop. etc. <Amended by Rule No. 3657, Mar. 26, 2009>

Article 10 (Programs for Recovery of Functions) The head of a welfare center shall provide physical therapies, including massage and therapies for training functions, and physical exercise therapies, such as exercise for strengthening muscles, in a facility for recovery of functions in order to help the aged recover functions. <Amended by Rule No. 3657, Mar. 26, 2009>

Article 11 (Programs for Fostering Volunteers' Activities) (1) The head of a welfare center may solicit volunteers and conduct training programs necessary for various services provided by the welfare center. <Amended by Rule No. 3657, Mar. 26, 2009>
(2) Trained volunteers shall be utilized for various services provided by the welfare center. <Amended by Rule No. 3657, Mar. 26, 2009>

Article 12 (Programs for Cooperation in Welfare) The head of a welfare center shall pro-actively participate in programs for cooperation in welfare, such as programs for setting up relationships and sponsorships and senior citizens' social service activities and contribute to the promotion of the welfare of the aged. <Amended by Rule No. 3657, Mar. 26, 2009>

Article 13 (Job Referral Programs for Aged) (1) The head of a welfare center shall provide services for counselling on employment and the referral of jobs so as to prepare jobs suitable for the aptitude and ability of the aged and help them have opportunities to enjoy leisure time and earn income. <Amended by Rule No. 3657, Mar. 26, 2009>
(2) The head of a welfare center may establish and operate a job referral center for the aged, a common workshop, etc. in connection with the programs referred to in paragraph (1). <Amended by Rule No. 3657, Mar. 26, 2009>

Article 14 (Other Programs) If the head of a welfare center deems it necessary, he/she may implement other programs in addition to the programs referred to in Articles 5 through 13 so as to promote the welfare of the aged. <Amended by Rule No. 3657, Mar. 26, 2009>

Article 15 (Use Fees) If the head of a welfare center deems it necessary, he/she may collect use fees from the persons who intend to use a program operated by the welfare center pursuant to Article 46 (7) of the Welfare of the Aged Act for the expenses incurred in the program. In such cases, the head of a welfare center shall report the receipt of expenses to the head of the relevant autonomous Gu in advance. <Amended by Rule No. 3657, Mar. 26, 2009>
