SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON SUPPORT FOR ACTIVITIES TO PROTECT AND RECOVER OVERSEAS CULTURAL HERITAGE

SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON SUPPORT FOR ACTIVITIES TO PROTECT AND RECOVER OVERSEAS CULTURAL HERITAGE

Article 1 (Purpose) The purpose of this Ordinance is to prescribe matters necessary to support activities to protect and recover cultural heritage removed overseas from Seoul Metropolitan City, in accordance with Article 69 of the Cultural Heritage Protection Act.

Article 2 (Definition) For purposes of this Ordinance, the term "overseas cultural heritage" means cultural heritage, as defined in Article 2 (8) of the Cultural Heritage Protection Act, that is removed overseas from Seoul Metropolitan City.

Article 3 (Responsibilities) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") shall endeavor to fully support activities to protect and recover overseas cultural heritage in order to efficiently conserve, maintain, and utilize cultural heritage, taking into account the 2,000-year history of Seoul Metropolitan City as the capital.

Article 4 (Formulation and Implementation of Support Plan) (1) The Mayor shall formulate and implement a plan to support activities to protect and recover overseas cultural heritage and fact-finding surveys for the systematic protection, recovery, and post-recovery management of the overseas cultural heritage.
(2) The Mayor may request cooperation from institutions or organizations related to overseas cultural heritage by seeking their opinions or requesting materials, if necessary to effectively formulate and implement the support plan referred to in paragraph (1).

Article 5 (Provision of Materials) The Mayor may provide necessary materials for any institution or organization engaging in activities to protect and recover overseas cultural heritage or engaging in educational and public relations activities thereon.

Article 6 (Post-Recovery Management) The Mayor may designate and manage cultural heritage recovered from overseas, as the Seoul Metropolitan Government-designated cultural heritage in accordance with the Seoul Metropolitan Government Ordinance on the Protection of Cultural Heritage to ensure it is efficiently protected.

Article 7 (Funding) (1) The Mayor shall endeavor to secure professional personnel and budget for protecting and recovering overseas cultural heritage.
(2) The Mayor may subsidize, within the budget, any institution or organization engaging in any of the following activities to protect and recover overseas cultural heritage:
1. A project to protect and recover overseas cultural heritage;
2. Educational and public relations activities about the protection and recovery of overseas cultural heritage;
3. Other activities the Mayor deems necessary.
(3) How to apply for, grant, and adjust the subsidy referred to in paragraph (2) and other necessary matters shall be governed by the Seoul Metropolitan Government Ordinance on the Management of Local Subsidies.

Article 8 (Building Cooperative System) The Mayor may build a cooperative system with related institutions and organizations, including the Cultural Heritage Administration, the Overseas Korean Cultural Heritage Foundation, the Korea Foundation, the Overseas Koreans Foundation, and the International Council of Museums, if necessary to conduct supporting projects for activities to protect and recover overseas cultural heritage and educational and public relations activities thereon.

Article 9 (Enforcement Rule) Matters necessary for enforcing this Ordinance shall be prescribed by rule .

ADDENDUM
This Ordinance shall enter into force on the date of its promulgation.
