SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE ESTABLISHMENT AND OPERATION OF WORKERS' WELFARE FACILITIES

Article 1 (Purpose) The purpose of this Ordinance is to contribute to stabilizing workers' lives and promoting workers' welfare by prescribing matters concerning the establishment and operation of workers' welfare facilities of the Seoul Metropolitan Government pursuant to Article 28 of the Framework Act on Labor Welfare and Article 144 of the Local Autonomy Act. <Amended by Ordinance No. 5274, Mar. 15, 2012; Corrected on Sep. 2, 2013; Amended by Ordinance No. 6386, Jan. 5, 2017; Ordinance No. 7044, Mar. 28, 2019>

Article 2 (Scope of Application) Except as otherwise provided by any other statute, regulation, or Ordinance of the Seoul Metropolitan Government, the provisions of this Ordinance shall apply to the establishment and operation of workers' welfare facilities of the Seoul Metropolitan Government (referring to workers' welfare facilities under Article 28 of the Framework Act on Labor Welfare; hereinafter referred to as "welfare facilities"). <Amended by Ordinance No. 5274, Mar. 15, 2012; Ordinance No. 7044, Mar. 28, 2019>

Article 3 (Establishment and Operation) The names and functions of the welfare facilities established and operated under this Ordinance shall be as specified in attached Table 1. <Amended by Ordinance No. 5677, Mar. 20, 2014; Ordinance No. 7144, May 16, 2019>

Article 4 (Eligibility for Use) Persons eligible to use welfare facilities shall be limited to those who reside in Seoul Metropolitan City and render his or her labor for wages. <Amended by Ordinance No. 7044, Mar. 28, 2019>

Article 5 (Use of Welfare Facilities) In order to prevent damage to a welfare facility, the Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") may issue an order against any of the following users to leave a facility or may take any necessary measure to restrict their use of a facility:
1. A person who alters and damages a facility or structure without authorization;
2. A person who sells or lends his or her access card to another person;
3. A person who creates a disturbance, drinks alcoholic beverage, or gambles in a facility;
4. A person who steals another person's belongings or inflicts a loss on another person by fraud in a facility;
5. A person who brings in sleeping gear, inflammables, explosives, or any other commodity subject to restriction on bringing into a facility;
6. A person who violates any regulation relevant to the operation of a welfare facility.

Article 6 (Entrustment of Management and Operation) (1) In order to efficiently operate welfare facilities, the Mayor may entrust the management and operation of the welfare facilities under Article 3 to a corporation, organization, institution, or individual having good capability. In such cases, among the affairs of the Mayer under this Ordinance, those regarding restriction on the use of welfare facilities under Article 5 shall be deemed to be entrusted to the head of the entrusted institution.
(2) Articles 7 through 19 of the Seoul Metropolitan Government Ordinance on Entrustment of Administrative Affairs to the Private Sector shall apply mutatis mutandis to the procedures and methods necessary for the entrustment of management and operation of welfare facilities. <Amended by Ordinance No. 4818, Jul. 30, 2009>

Article 7 (Assistance to Workers' Welfare Facilities of Autonomous Gus) The Mayor may partially subsidize autonomous Gus for necessary expenses incurred in establishing and operating workers' welfare facilities in autonomous Gus, within the budget. <Amended by Ordinance No. 7044, Mar. 28, 2019>

Article 8 (Imposition and Collection of Fees) Fees, etc, may be imposed on and collected from a person who uses workers' welfare facilities, as prescribed by attached Table 2.

ADDENDA
Article 1 (Enforcement Date)
This Ordinance shall enter into force on the date of its promulgation.
Article 2 (Transitional Measure)
An institution entrusted with the management and operation of welfare facilities under the provisions of the Seoul Metropolitan Government Ordinance on Entrustment of Administrative Affairs to the Private Sector and the Seoul Metropolitan Government Ordinance on Establishment of Public Facilities before this Ordinance enters into force shall be deemed entrusted with the management and operation under this Ordinance during the entrustment period, and any disposition or permission related to the management and operation of welfare facilities shall be deemed a disposition or permission under this Ordinance.

This Ordinance shall enter into force on the date of its promulgation.

Article 1 (Enforcement Date)
This Ordinance shall enter into force three months after the date of its promulgation.
Article 2 (Applicability to Users of Workers’ Shelters)
A person who is using or intends to use workers’ shelters before this Ordinance enters into force shall not be governed by the previous provisions but by the provisions prescribing the matters related to the management and operation of facilities for protection of homeless persons.

This Ordinance shall enter into force on the date of its promulgation.
※ Corrections:
1. Date: September 2, 2013;
2. Details: "The Framework Act on Worker’s Welfare" referred to in Article 1 is corrected into "The Framework Act on Labor Welfare";
3. Reason: From the contents of partially amended Ordinance promulgated by the Official Gazette of the Seoul Metropolitan Government (No. 3097, Mar. 15, 2012), matters erroneously put into the Administrative Legal System are corrected.

Article 2 (Transitional Measures concerning Change of Name of the Committee)
The Workers' Rights Protection Committee and its members organized pursuant to Article 12 of the previous Seoul Metropolitan Government Ordinance on the Protection and Furtherance of Workers' Rights as at the time this Ordinance enters into force shall be deemed the Workers' Rights Protection Committee and its members under the amended provisions of Article 12 of the Seoul Metropolitan Government Ordinance on the Protection and Furtherance of Workers' Rights.
Article 3 (Transitional Measures concerning Change of Name of Worker Director System)
Worker directors appointed pursuant to Article 5 of the previous Seoul Metropolitan Government Ordinance on the Operation of Worker Director System as at the time this Ordinance enters into force shall be deemed worker directors appointed pursuant to the amended provisions of Article 5 of the Seoul Metropolitan Government Ordinance on the Operation of Worker Director System.
Article 4 (Transitional Measures concerning Change of Name of Workers’ Welfare Facilities)
Workers’ welfare facilities under the attached Table that have been established and operated pursuant to Article 3 of the previous Seoul Metropolitan Government Ordinance on the Establishment and Operation of Workers’ Welfare Facilities as at the time this Ordinance enters into force shall be deemed workers’ welfare facilities that are established and operated pursuant to the amended provisions of the Seoul Metropolitan Government Ordinance on the Establishment and Operation of Workers’ Welfare Facilities.

This Ordinance shall enter into force on the date of its promulgation.
