SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON SUPPORT FOR IMPROVING QUALITY OF LIVES OF TENANTS IN PERMANENT RENTAL HOUSING

SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON SUPPORT FOR IMPROVING QUALITY OF LIVES OF TENANTS IN PERMANENT RENTAL HOUSING

Article 1 (Purpose) The purpose of this Ordinance is to contribute to improving the quality of lives of tenants in long-term public rental housing in Seoul Metropolitan City by improving their living conditions and providing them with social welfare services. <Amended by Ordinance No. 7094, Mar. 28, 2019>

Article 2 (Definitions) The terms used in this Ordinance shall be defined as follows: <Amended by Ordinance No. 7094, Mar. 28, 2019; Ordinance No. 7156, May 16, 2019>
1. The term "long-term public rental housing" means housing under subparagraph 1 of Article 2 of the Act on the Support for Improving the Quality of Lives of Tenants in Long-Term Public Rental Housing (hereinafter referred to as the "Act");
2. The term "permanent rental housing" means housing under Article 2 (1) 1 of the Enforcement Decree of Special Act on Public Housing;
3. The term "project owner" means the Korea Land and Housing Corporation (including a person who conducts the duties for the management of long-term public rental housing through entrustment) which builds, supplies, and manages long-term public rental housing under the Korea Land and Housing Corporation Act; and a public corporation established by Seoul Metropolitan Government to implement a housing project under Article 49 of the Local Public Enterprises Act;
4. The term "welfare service facility" means a facility for welfare services as prescribed in subparagraph 4 of Article 2 of the Act.

Article 3 (Basic Direction-Setting) The basic direction-setting for the implementation of, and support for, a project under this Ordinance shall be as follows: <Amended by Ordinance No. 7094, Mar. 28, 2019>
1. Realizing housing welfare;
2. Facilitating the self-sufficiency of tenants in long-term public rental housing (hereinafter referred to as "tenants");
3. Building sound local communities based on mutual consideration and coexistence.

Article 4 (Responsibilities) (1) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") and a project owner shall establish and actively implement policies for efficient administrative and financial support in order to improve the quality of lives of tenants. <Amended by Ordinance No. 7094, Mar. 28, 2019>
(2) Tenants shall endeavor to create the pleasant environment of a complex in cooperation with a project owner.

Article 5 (Formulation of Plans) (1) In order to systematically support improving the quality of lives of tenants, the Mayor shall formulate and execute a basic plan every five years for improving the quality of lives of tenants of long-term public rental housing (hereinafter referred to as "basic plan"), which shall include the following matters: <Amended by Ordinance No. 7094, Mar. 28, 2019>
1. Basic direction-setting for support for tenants;
2. Status of the residence of, and welfare support for, tenants;
3. Improvement of the environment for welfare service facilities, as well as social and economic conditions;
4. Housing welfare support for tenants;
5. Support system for efficiently providing support;
6. Evaluation of projects for improving the quality of lives of tenants;
7. Other matters necessary to improve the quality of lives of tenants.
(2) The Mayor shall formulate and execute an annual implementation plan based on a basic plan in cooperation with project owners. <Amended by Ordinance No. 7094, Mar. 28, 2019>
(3) The Mayor shall conduct a fact-finding survey to formulate a basic plan under paragraph (1).
(4) The costs incurred in implementing a project under a basic plan and annual implementation plan shall be borne by the entity in charge of the relevant duties under related statutes. <Amended by Ordinance No. 7094, Mar. 28, 2019>
(5) When the mayer formulates the basic plan under paragraph (1), he or she shall report such to the competent standing committee of the Seoul Metropolitan Council. <Newly Inserted by Ordinance No. 6846, Mar. 22, 2018>

Article 6 (Support for Facility Enhancement) In order to improve the quality of lives of tenants, the Mayor may support the following projects, within budgetary limits, in consultation with a project owner:
1. Barrier-free projects for improving the convenient movement of the elderly, the weak, people with disabilities, etc.;
2. Projects for the maintenance, repair, and functional improvement of dilapidated facilities or public facilities;
3. Other projects deemed necessary by the Mayor for facility enhancement.

Article 7 (Support for Utility Expenses, etc.) (1) The Mayor may provide support to tenants of permanent rental housing within budgetary limits for the following:
1. Common utility expenses for commonly-used electricity, water, public sewage, and water use charge, etc.;
(2) Eligibility for and methods of support under paragraph (1) shall be determined by the Mayor.

Article 8 (Enhancement of Economic Competence) The Mayor may support each of the following projects to strengthen the economic competence of tenants and facilitate their self-sufficiency:
1. Provision of employment information, vocational consultation, and the development and operation of vocational education and training programs to promote employment;
2. Development of social work opportunities, including the operation of common workshops, to create jobs;
3. Counseling on financial recovery, including debt, bankruptcy;
4. Other projects necessary to facilitate self-sufficiency.

Article 9 (Enhancement of Health and Welfare Services) (1) The Mayor shall establish a cooperative system with health and welfare service agencies, in order to improve the health of tenants.
(2) The Mayor may support each of the following projects in order to promote the health of tenants:
1. Counseling and education for people with mental disorders, alcoholics, suicide prevention, etc. and the development of support programs;
2. Operation of support programs through social welfare centers, etc.;
3. Establishment of facilities and equipment to improve health;
4. Care services for tenants in need of protection, including the placement of visiting professional counsellors.
(3) The Mayor shall closely cooperate with project owners to look after and protect the household of a lone senior citizen and the elderly with dementia.

Article 10 (Support for Healthy Growth of Children) The Mayor may support each of the following projects to promote the healthy growth of child tenants:
1. Child care services;
2. Support for self-motivation for learning and learning conditions, and vocational guidance and counseling;
3. Promotion of sponsorship with corporations, organizations, etc. for children from broken families, including households headed by a child;
4. Other projects for supporting the healthy growth of children.

Article 11 (Support of Cultural and Sports Activities) The Mayor may provide support for projects necessary to promote the cultural and physical activities of tenants and for the installation, improvement, etc. of facilities within in a complex which are open to residents in nearby areas.

Article 12 (Promotion of Tenant Communities) The Mayor and project owners may support each of the following projects in order to promote a communal spirit among tenants and to facilitate communication among them: Provided, That this shall not apply to cases where support is provided pursuant to other statutes or regulations, which is similar to any of the following projects: <Amended by Ordinance No. 7094, Mar. 28, 2019>
1. Residents' autonomous activities, including the operation of meetings of tenant representatives;
2. Development and operation of programs to promote communities;
3. Securing space to promote communities;
4. Creation of a community environment for mutual consideration and coexistence.

Article 13 (Cooperation with Project Owners) The Mayor shall consult and cooperate with project owners while conducting projects for improving the quality of lives of tenants.

Article 14 (Utilization of Private Resources) The Mayor shall endeavor to actively utilize private resources so as to efficiently conduct projects for improving the quality of lives of tenants.

Article 15 (Entrustment of Duties) The Mayor may partially entrust projects for improving the quality of lives of tenants, to related institutions or organizations in accordance with the Seoul Metropolitan Government Ordinance on the Entrustment of Administrative Affairs to the Private Sector.

Article 16 (Establishment and Operation of Council) (1) A private expert council (hereinafter referred to as the "Council") may be established under the jurisdiction of the Mayor to deliberate and render advice on projects for improving the quality of lives of tenants.
(2) Detailed matters concerning the establishment and operation of the Council under paragraph (1) shall be determined by rule of the Seoul Mteropolitan Government.

Article 17 (Enforcement Rule) Matters necessary for the enforcement of this Ordinance shall be prescribe by rule of the Seoul Mteropolitan Government.

ADDENDA
Article 1 (Enforcement Date)
This Ordinance shall enter into force on the date of its promulgation.
Article 2 (Repeal of Other Ordinance)
The Seoul Metropolitan Government Ordinance of Special Support on Permanent Rental Housing are hereby repealed.
Article 3 (Transitional Measures)
Any support provided under the Seoul Metropolitan Government Ordinance of Special Support on Permanent Rental Housing as at the time this Ordinance enters into force, shall be deemed provided pursuant to this Ordinance.

This Ordinance shall enter into force on the date of its promulgation.
