SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON SUPPORT OF THE DISABLED, THE AGED, AND OTHER HOUSING-DISADVANTAGED PEOPLE

SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON SUPPORT OF THE DISABLED, THE AGED, AND OTHER HOUSING-DISADVANTAGED PEOPLE

Article 1 (Purpose) The purpose of this Ordinance is to contribute to promoting the residential stability and quality of housing for people disadvantaged in housingby providing for matters necessary to provide a safe and comfortable living environment to such people disadvantaged in housing in accordance with the Act on Support for Housing Disadvantaged Persons including Persons with Disabilities and the Aged.

Article 2 (Definitions) The terms used in this Ordinance shall be as defined in the Act on Support for Housing Disadvantaged Persons including Persons with Disabilities and the Aged (hereinafter referred to asthe "Act").

Article 3 (Responsibilities) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as "Mayor") shall endeavor to improve residential stability and quality of housing for housing-disadvantaged persons:
1. A pleasant and safe living environment shall be provided to housing-disadvantaged persons;
2. Housing units for housing-disadvantaged persons shall be supplied readily and managed efficiently;
3. Information necessary for a pleasant and safe living environment shall be provided readily to housing-disadvantaged persons, and convenience facilities specified in Article 9 of the Act shall be installed appropriately in housing units for housing-disadvantaged persons.

Article 4 (Formulation of Housing Support Plan) (1) The Mayor shall formulate a plan to support housing-disadvantaged persons regarding their housing; and shall include the plan in a comprehensive housing plan formulated under Article 4 of the Seoul Metropolitan Government Framework Ordinance on Residence.
(2) The housing support plan shall include the following matters.
1. Objectives of and direction-setting for the housing support plan for housing-disadvantaged persons;
2. Matters concerning the construction and supply of housing units for housing-disadvantaged persons
3. Matters concerning subsidization of costs of renovating housing units for housing-disadvantaged persons
4. Other matters deemed necessary for the residential stability for housing-disadvantaged persons, based on the demographics, the standard of living, actual housing conditions, etc.

Article 5 (Survey on Actual Housing Conditions) (1) The Mayor may survey the status of housing regarding the following matters; and where he/she intends to conduct a survey on actual housing conditions, he/she shall formulate a plan for conducting a fact-finding survey on housing which includes a date and time purpose, and contents thereof:
1. Matters concerning the residential environment of housing-disadvantaged persons;
2. Matters concerning the characteristics of households with any housing-disadvantaged person;
3. Matters concerning the satisfaction of housing-disadvantaged persons on housing units and residential environment;
4. Other matters he/she deems necessary for ascertaining the actual housing status of housing-disadvantaged persons.
(2) Matters, other than those provided for in paragraph (1), necessary for surveying actual housing conditions shall be in accordance with Article 7 of the Act.
(3) The Mayor may entrust a corporation or organization with the authority to conduct a survey on the actual housing conditions of housing-disadvantaged persons as provided for in Article 18 (2) of the Act and Article 10 of the Enforcement Decree of the Act.
(4) The Mayor may conduct a survey on actual housing conditions including the survey on actual housing conditions conducted under Article 6 of the Seoul Metropolitan Government Framework Ordinance on Residence if deemed necessary.

Article 6 (Mandatory Construction of Housing Units for Housing-Disadvantaged Persons) The Mayor shall construct housing units for housing-disadvantaged persons mandatorily as prescribed in Article 10 of the Act.

Article 7 (Subsidization for Cost of Remodeling Housing Units) (1) If any of the following persons files an application for subsidizing remodeling a housing unit (including housing units for rent) so as to make it appropriate for action competence of a housing-disadvantaged person, the Mayor may subsidize such person for the cost of remodeling:
1. A housing-disadvantaged person;
2. The head of a household owning a housing unit for the purpose of leasing it to a person specified under subparagraph 1 or 2;
3. A lessor who intends to renovate a housing unit for purposes of leasing it to a person specified under subparagraph 1 or 2;
(2) The qualifications for eligibility for support and other necessary matters shall be prescribed by Article 7 of the Enforcement Decree of the Act.

Article 8 (Establishment, etc. of Housing Support Centers) (1) The Mayor may establish a housing support center for housing-disadvantaged persons (hereinafter referred to as "center") in order to conduct the following affairs:
1. Inspection of housing units to determine eligibility for a subsidy for the cost of renovating housing units, examination of the appropriateness of renovation projects, and other affairs related to subsidization for renovating housing units;
2. Counseling on housing-disadvantaged persons' residential problems and affairs related to assistance in daily-life management, etc.;
3. Surveys on the actual conditions of housing units in which housing-disadvantaged persons reside and their residential environment;
4. Provision of information relevant to housing units for housing-disadvantaged persons;
5. Provision of support in association with relevant institutions and organizations for supporting housing-disadvantaged persons;
6. Training on and supporting renovation of housing units for housing-disadvantaged persons;
7. Publicity on the support system for housing-disadvantaged persons;
8. Any other affairs relating to housing support for housing-disadvantaged persons.
(2) The Mayor may outsource the operation of the center to a person who meets the requirements for organization, personnel, etc. appropriate to conduct affairs of providing support to persons disadvantaged in housing; and necessary matters concerning standard, procedure, method, etc. for such outsourcing shall be governed by Article 17 of the Act.
