SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON JUVENILE ACTIVITY PROMOTION

Article 1 (Purpose) The purpose of this Ordinance is to provide for matters necessary to expand and proactively promote opportunities for youth to participate in activities so that they grow up to be world citizens by strengthening their ability to lead a self-directed life and enhancing democratic life.

Article 2 (Definitions) The definitions of terms used in this Ordinance shall be as follows: <Amended by Ordinance No. 6994, Jan. 3, 2019>
1. The term "youth" means youth under subparagraph 1 of Article 3 of the Framework Act on Youth;
2. The term "youth activities" means youth activities under subparagraph 3 of Article 3 of the Framework Act on Youth;
3. The term "facilities for youth activities" means facilities under Article 10 of the Youth Activity Promotion Act (hereinafter referred to as the “Act”), which are provided for youth activities, such as youth training activities, youth exchange activities and youth cultural activities;
4. The term "youth exchange activities" means experiential activities under subparagraph 4 of Article 2 of the Act;
5. The term "certified youth leaders" means persons under subparagraph 7 of Article 3 of the Framework Act on Youth.

Article 3 (Responsibility of the Mayor) (1) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the “Mayor”) shall formulate and execute comprehensive policies and development plans for facilities for youth activities, youth activity programs, certified youth leaders, etc. necessary for facilitating youth activities under Article 5 of the Act. <Amended by Ordinance No. 7185, May 16, 2019>
(2) The Mayor may provide administrative and financial support necessary for taking responsibility under paragraph (1). <Amended by Ordinance No. 7185, May 16, 2019>

Article 4 (Formulation of Action Plan for Promotion of Youth Activities) (1) The Mayor shall formulate an action plan (hereinafter referred to as "action plan") for the promotion of youth activities every year. <Amended by Ordinance No. 6994, Jan. 3, 2019>
(2) An action plan shall include the following: <Amended by Ordinance No. 6994, Jan. 3, 2019; Ordinance No. 7185, May 16, 2019>
1. Analysis of and evaluation on the previous action plans;
2. Research on the promotion of youth activities and the formulation of a plan for the promotion thereof;
3. Implementation of surveys on demand concerning the promotion of youth activities;
4. Surveys on the current status of facilities for youth activities and information management;
5. Connection among institutions and facilities related to youth activities and the management of support for joint projects among them;
6. Securing of organizations that support youth activities and the management of support therefor;
7. Management of support for youth training activities, exchange activities and cultural activities;
8. Matters concerning qualification improvement, enhancement of working conditions, and reasonable remuneration of certified youth leaders;
9. Matters concerning the procurement of funds for the promotion of youth activities;
10. Other matters deemed necessary for the promotion of youth activities.
(3) The Mayor shall analyze and evaluate performance achieved based on the action plan of the preceding year and report the result thereof to the competent standing committee of the Seoul Metropolitan Council. <Newly Inserted by Ordinance No. 5876, May 14, 2015>
(4) The Mayor shall reflect the result of analysis and evaluation under paragraph (3) in the action plan of the following year. <Newly Inserted by Ordinance No. 5876, May 14, 2015>

Article 5 (Seoul Municipal Youth Work Center) (1) The Mayor may establish and operate the Seoul Municipal Youth Work Center under Article 7 of the Act for the promotion of youth activities. <Amended by Ordinance No. 6994, Jan. 3, 2019>
(2) The Seoul Municipal Youth Work Center shall perform the following activities:
1. Development and dissemination of programs for youth activities;
2. Revitalization of youth activities;
3. Provision of information concerning youth activities;
4. Provision of places, equipment, etc. necessary for youth activities;
5. Education and advertising for safe youth activities;
6. Support for youth activity festivals;
7. Other activities necessary for the promotion of youth activities.

Article 6 (Support for Youth Activities) (1) Where individuals, corporations or organizations support the following projects to promote youth activities, the Mayor may fully or partially subsidize expenses incurred therein within budgetary limits:
1. A project to develop and operate programs for youth exchange activities;
2. A project to support youth exchange activities in the Republic of Korea and abroad;
2. A project to support inter-Korean youth exchange activities and unification education;
4. A project to support visits of overseas Korean youth to the Republic of Korea and their cultural experience and exchange activities with Korean youth;
5. A project to promote youth cultural activities and to support the development of programs;
6. A project to support youth club activities;
7. Other projects the Mayor deems necessary for the promotion of youth activities.
(2) Procedures, methods, conditions, etc. for subsidizing the expenses under paragraph (1) shall be separately determined by the Mayor.

Article 7 (Enhancement of Rights and Interests of Certified Youth Leaders) The Mayor may conduct research and surveys to improve qualifications, rights and interests of certified youth leaders. In such cases, the Mayor may subsidize the necessary expenses within budgetary limits. <Amended by Ordinance No. 7185, May 16, 2019>

Article 8 (Securing of Facilities for Youth Activities) (1) The Mayor shall endeavor to secure facilities, such as exclusive spaces or special experience spaces, where youth may gain easy access at any time and enjoy leisure and experience for their balanced growth.
(2) The Mayor shall endeavor to open and utilize public facilities to secure facilities for youth activities.

Article 9 (Creation of Youth Street) The Mayor may create a youth street so that youth may usually enjoy and experience activities.

Article 10 (Youth Activity Day) (1) The Mayor may designate Youth Activity Day to expand interest and participation in youth activities.
(2) The Mayor shall endeavor to hold events, etc. meeting the purpose of Youth Activity Day.

Article 11 (Subsidization for Non-Governmental Organizations) (1) The Mayor may subsidize corporations or organizations that implement projects to support or facilitate youth activities, within budgetary limits: Provided, That corporations or organizations in this Article mean youth organizations under subparagraph 8 of Article 3 of the Framework Act on Youth, and non-governmental organizations under the Assistance for Non-profit, Non-governmental Organizations Act. <Amended by Ordinance No. 6994, Jan. 3, 2019>
(2) Where any person who has received a subsidy falls under any of the following, the Mayor may require him or her to return all or part of such subsidy:
1. Where he or she uses the subsidy for the purposes other than the purpose of the subsidy;
2. Where he or she fully or partially suspends the relevant project;
3. Where he or she is deemed unable to achieve the purpose of the relevant project;
4. Where he or she commits fraud or gross negligence in relation to the relevant project.

Article 12 (Establishment of Cooperation System) To facilitate youth activities, the Mayor shall endeavor to maintain cooperation with the Seoul Metropolitan Office of Education, autonomous Gus, schools at all levels, and the private sector.

Article 13 (Enforcement Rules) Matters necessary for the enforcement of this Ordinance shall be prescribed by rule of the Seoul Metropolitan Government.
