SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON EMPLOYMENT SUPPORT FOR UNEMPLOYED YOUTH TO SMALL AND MEDIUM ENTERPRISE

Article 1 (Purpose) The purpose of this Ordinance is to contribute to the employment promotion of unemployed youths, enhancement of competitiveness of small and medium enterprises, society stability and development of national economy through employment support to small and medium enterprise undergoing labor shortage with the method of directly supporting unemployed youth parties pursuant to the Special Act on the Promotion of Youth Employment.

Article 2 (Definition) The terms used in this Ordinance shall be defined as follows:
1. The term "unemployed youth" means a person of the age of over 18 and under 29, having registered his/her resident in Seoul Metropolitan Government, who has been unemployed notwithstanding his/her intention to work.
2. The term "small and medium enterprise" means an enterprise which is located in Seoul Metropolitan Government and determined by Seoul Metropolitan Government Mayor (hereinafter referred to as "Mayor") in enterprises under Article 2 of the Framework Act on Small and Medium Enterprises.

Article 3 (Responsibilities of Mayor) The Mayor shall endeavor to arrange the social and economic environment for the employment promotion of unemployed youth to small and medium enterprise.

Article 4 (Establishment of Countermeasure on the Promotion of Youth Employment to Small and Medium Enterprise) (1) The Mayor shall endeavor to establish and implement the countermeasure on the employment support of unemployed youth to small and medium enterprise, and promote the employment of unemployed youth.
(2) Small and medium enterprise shall actively cooperate in the countermeasure of the city to promote the employment of unemployed youth.

Article 5 (Grants Payment for an Employee) (1) The Mayor may pay employment grants within the scope of budget to unemployed youth when he/she is employed by the small and medium enterprise determined by the Mayor.
(2) The support period under Article 1 shall be within 2 years.

Article 6 (Eligibility of Payment for Employment Grants) Eligibility of payment for employment grants shall mean a person as an unemployed youth falling under subparagraph 1 of Article 2 who is employed by small and medium enterprise determined by the Mayor.

Article 7 (Exclusion of Payment of Employment Grants) Exclusion of payment of employment grants shall be as follows:
1. Any person who has been employed by small and medium enterprise prescribed by Article 8 while in college falling under Article 2 of the Higher Education Act. Provided, That the student of being on vacation just before graduation or of broadcasting, home study, cyber and evening college shall be excluded.
2. Any person who has been directly or indirectly paid grants or subsidies pursuant to other Acts or Ordinances for employment support of unemployed youth to small and medium enterprise.
3. Any person who has been paid the employment grants by any fraud or other unjustifiable means.

Article 8 (Enterprise Eligible for Employment Grants) (1) The Mayor shall determine the scope of enterprises eligible for employment grants to unemployed youth pursuant to Article 6, comprehensively considering type and scale of business, employment situation in enterprises pursuant to Article 2 of the Framework Act on Small and Medium Enterprises, and impact, etc. for preservation and fosterage, etc. in the skill and technology of national industry.
(2) Small enterprise, employing full workers of over 5 and less than 50 prescribed by Article 11 of the Labor Standards Act, Article 2 of the Framework Act on Small and Medium Enterprises and Article 8 of the Enforcement Decree of the same Act, shall be designated when he/she designate the enterprise eligible for employment grants under Article 1.

Article 9 (Establishment of Deliberative Committee for Employment Support, etc.) (1) The Mayor may establish the deliberative committee for employment support to deliberate amount of employment support and standards, etc. of the enterprise eligible for payment.
(2) The Deliberative committee shall conduct as follows.
1. Matters concerning establishment of the standards for the eligible enterprise
2. Matters concerning selection of the eligible enterprise.
3. Matters concerning amount of employment support
4. Matters concerning regular review of addition and deletion, etc. of eligible enterprise.
5. Other matters necessary for selection of the eligible enterprise
(3) Matters necessary for establishment and operation of the deliberative committee for employment support shall be determined by Rule.

Article 10 (Support for Establishment) (1) When a person, being paid employment grants for 2 years under Article 5, intends to establish a business, he/she may have necessary support for establishment.
(2) Necessary matters concerning contents of support for establishment and selection of eligibility, etc. under Article 1 shall be determined by rule.

Article 11 (Refund of the Support Fund) The Mayor may order one, using the budget under Article 5 in other purposes or supported by fraud request or other unjustified means, to refund all or part of supported amount.

Article 12 (Enforcement Rule) Necessary matters concerning this Ordinance shall be determined by rule.
