ENFORCEMENT RULE OF THE SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON OPERATION AND MANAGEMENT OF THE CITIZENS HALL

Article 1 (Purpose) The purpose of this Rule is to prescribe matters entrusted by the Seoul Metropolitan Government Ordinance on Operation and Management of the Citizens Hall and matters necessary for enforcement thereof.

Article 2 (Temporary Holidays) Where the Mayor of the Seoul Metropolitan Government (hereinafter referred to as the “Mayor”) intends to close the citizens hall in accordance with subparagraph 3 of Article 3 of the Seoul Metropolitan Government Ordinance on Operation and Management of the Citizens Hall (hereinafter referred to as the “Ordinance”), he/she shall post such fact in the Seoul Metropolitan Government News or on the Internet homepage of the citizens hall by no later than 10 days prior to such closing.

Article 3 (Time of Use) (1) The time of use of the Citizens Halls of the Seoul Metropolitan Government (hereinafter referred to as the “citizens hall”) shall be as follows:
1. March through October: 09:00 to 21:00;
2. November through the following year’s February: 09:00 to 20:00.
(2) Notwithstanding paragraph (1), in cases of any extraordinary circumstances, the Mayor may adjust the time of use of the citizens hall. In such cases, the Mayor shall post such adjustment on the Internet homepage of the citizens hall by no later than 10 days prior to the date of the adjustment.
(3) Paragraphs (1) and (2) may apply mutatis mutandis to the time of use of space rental provided for in Article 8 of the Ordinance.

Article 4 (Procedure for Permit for Space Rental) (1) When the Mayor intends to grant a permit for space rental of the citizens hall pursuant to Article 8 (1) of the Ordinance, he/she shall formulate a plan for rent the citizens hall and publicly announce it by posting information on space rental and its schedule on in the Internet homepage of the citizens hall, during the period from three months to a month prior to the first day monthly available for space rental.
(2) Each person who intends to receive a permit for space rental shall, within a specified period set forth in a rental plan provided for in paragraph (1), submit a written application for a permit for space rental which includes the period, place, and size, etc., of space rental: Provided, That he/she may file the aforementioned application whenever an unused space becomes available due to grounds such as cancelation, etc., of a permit for space rental.
(3) When the Mayor receives an written application for a permit for space rental under paragraph (2), he/she may request the applicant to submit a master plan for space rental which includes the purposes of space rental, an introduction of participating authors (including their major experiences, etc.), space direction, methods of public relations, etc.
(4) Where the Mayor grants a permit for space rental, he/she shall notify the applicant of a written permit for the space rental which includes space rental fee and the method of payment thereof, or shall post matters on a permit for space rental on the Internet homepage of the citizens hall so that the applicant can verify the same.
(5) When a lessee intends to amend or cancel the details of a permit for space rental after receipt of the permit, he/she shall submit to the Mayor a written application for amendment or cancellation of the permit for space rental by no later than 15 days prior to the first day of use of the space.

Article 5 (Standards for Permit for Space Rental) (1) The Mayor shall proceed with the review procedure of applications for a permit for space rental in the order of filing of the applications, and shall decide as to whether space rental is permitted, based on factors such as fitness to purposes, feasibility of implementing the relevant schedule, and artistic values of an event to be held.
(2) Where applications compete for a permit for space rental, the order of a permit for space rental may be determined after consultation with the Advisory Committee for Operation of the Citizens Hall provided for in Article 13 of the Ordinance, based on factors such as conformity to the purposes of operating the citizens halls and a correlation with policy programs of the Seoul Metropolitan Government.

Article 6 (Extension of Space Rental Period) Where a lessee provided for in Article 8 of the Ordinance intends to extend the period of use, he/she shall prepare a written application for extension of the period of use to submit it to the Mayor by no later than 10 days prior to the date of expiry of the period of use.

Article 7 (Refund of Space Rental Fees) Where a lessee files an application for cancellation of a permit for space rental pursuant to Article 4 (5), the paid space rental fee shall be fully or partially refunded in accordance with the following categories:
1. Where the space rental is cancelled because it is impractical to rent the relevant space due to natural disasters or force majeure, or where the space rental is cancelled by at least 15 days prior to the first day of use of the relevant space: the full amount of the paid space rental fee;
2. Where the space rental is cancelled during the period between by no later than 14 days and by no later than 7 days prior to the first day of use of the relevant space: 80/100 of the paid space rental fee;
3. Where the space rental is cancelled during the period between by no later than 6 days and by no later than 1 day prior to the first day of use of the relevant space: 60/100 of the paid space rental fee;
4. Where the space rental is cancelled while the relevant space is being used: 50/100 of the space rental fee for the remaining days of the space rental.

Article 8 (Scope of Reduction and Exemption of Space Rental Fees) (1) The scope of reduction and exemption of space rental fees pursuant to Article 10 of the Ordinance shall be as follows:
1. For events hosted and supervised by the Seoul Metropolitan Government: the full amount of the space rental fee;
2. For events sponsored by the Seoul Metropolitan Government: 50/100 of the space rental fee.
(2) Paragraph (1) may apply mutatis mutandis to an event hosted, supervised or sponsored by a person who is entrusted with operation and management of the citizens hall pursuant to Article 18 of the Ordinance.

Article 9 (Posting of Written Applications, etc.) The Mayor shall post the following forms on the Internet homepage of the citizens hall:
1. A written application for a permit for space rental filed under Article 4 (2);
2. A master plan for space rental submitted under Article 4 (3);
3. A written permit for space rental under Article 4 (4);
4. A written application for amendment or cancellation of a permit for space rental filed under Article 4 (5);
5. A written application for extension of space rental period filed under Article 6;
