SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON CONSERVATION, MANAGEMENT AND UTILIZATION OF FUTURE HERITAGE

SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON CONSERVATION, MANAGEMENT AND UTILIZATION OF FUTURE HERITAGE

CHAPTER 1 GENERAL PROVISIONS Article 1 (Purpose) The purpose of this Ordinance is to contribute to improving the cultural lifestyles of the citizens and the development of local culture by prescribing matters necessary to systematically conserve, manage, and utilize modern and contemporary cultural heritage located in Seoul Metropolitan City.

Article 2 (Definitions) The terms used in this Ordinance shall be defined as follows:
1. The term "future heritage" means tangible or intangible heritage embodying events, people, or stories that a number of citizens have experienced or remember in modern and contemporary Seoul, which is recognized as worthy of being transmitted to future generations by the Future Heritage Conservation Committee of the Seoul Metropolitan Government: Provided, That cultural heritage designated and registered under the Cultural Heritage Protection Act shall be excluded;
2. The term "Seoul future heritage" means future heritage selected by the Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") by acquiring the consent of its owner, holder, or manager; from among the future heritage which has undergone deliberation by the Future Heritage Conservation Committee of the Seoul Metropolitan Government;
3. The term "owner, etc." means the owner, holder, or manager of future heritage.

Article 3 (Principle for Conserving, Managing or Utilizing Future Heritage) Future heritage shall be voluntarily conserved and managed by its owner, etc., and the original function of future heritage shall be maintained and utilized.

Article 4 (Mayor’s Responsibility) The Mayor shall provide the citizens with active support for the voluntary conservation, management, and utilization of future heritage, and continuously pursue policies for establishing a system for the identification and management of future heritage.

CHAPTER 2 DEVELOPMENT AND IMPLEMENTATION OF POLICIES Article 5 (Formulation of Master Plans) (1) For the conservation, management, and utilization of future heritage, the Mayor shall formulate a master plan on the conservation, management, and utilization of future heritage of the Seoul Metropolitan Government (hereinafter referred to as "master plan") every five years, which shall include the following matters:
1. Master direction-setting and objectives in the pursuit of the conservation, management, and utilization of future heritage;
2. Efficient implementation system for the conservation, management, and utilization of future heritage, and incremental implementation measures;
3. Matters related to the continuous identification and recording of future heritage;
4. Other matters necessary for the conservation, management and utilization of future heritage.
(2) Where the Mayor establishes a master plan, he/she shall hear the opinions of relevant experts, owners, etc.

Article 6 (Formulation of Implementation Plans) The Mayor shall formulate and execute a yearly implementation plan on the basis of a master plan prescribed in Article 5 (1) (hereinafter referred to as "implementation plan").

CHAPTER 3 ESTABLISHMENT AND OPERATION OF FUTURE HERITAGE CONSERVATION COMMITTEE OF THE SEOUL METROPOLITAN GOVERNMENT Article 7 (Establishment of Committee) (1) The Future Heritage Conservation Committee of the Seoul Metropolitan Government (hereinafter referred to as the "Committee") shall be established to deliberate and render advice on the following matters related to the conservation, management and utilization of future heritage:
1. Matters related to deliberation on, and the selection or ceasing recognition of, future heritage;
2. Matters related to the formulation of a master plan and an implementation plan;
3. Other matters recognized as necessary by the Mayor for the conservation, management and utilization of future heritage.
(2) A subcommittee may be established under the Committee to deliberate or consult on each of the relevant fields, such as culture and arts, industrial labor, politics and history, urban management, civic life, etc.
(3) Any matter determined by a subcommittee shall be deemed determined by the Committee: Provided, That this shall not apply to matters related to the overall affairs of the Committee.
(4) Where it is necessary for investigation, deliberation, etc., a subcommittee prescribed in paragraph (2), may operate a joint subcommittee in cooperation with other subcommittees.

Article 8 (Composition of Committee) (1) The Committee shall be comprised of up to 50 members including the Chairperson.
(2) The members of the Committee shall be commissioned by the Mayor from among those who have knowledge and expertise in the fields of social sciences.
(3) Each member shall hold office for a term of two years and may be reappointed consecutively: Provided, That the term of office of a member filling a vacancy shall be the remainder of his/her predecessor's term of office.

Article 9 (Chairperson) (1) The Chairperson shall be elected from among and by the members of the Committee.
(2) The Chairperson shall represent the Committee, and convene and preside over Committee meetings.
(3) Where the Chairperson is unable to perform any of his/her duties in extenuating circumstances, a member pre-designated by the Chairperson shall act on his/her behalf: Provided, That when there is no member designated by the Chairperson, the most senior in age from among the members, shall act on behalf of the Chairperson.

Article 10 (Meetings) (1) A majority of the members of the Committee shall constitute a quorum, and any decision thereof shall require the concurring vote of a majority of those present.
(2) Minutes of each Committee meeting shall be prepared and kept.

Article 11 (Composition of Subcommittees) Articles 9 and 10 shall apply mutatis mutandis to the operation of subcommittees, including the appointment of chairpersons, etc.

Article 12 (Dismissal of Members) Where any member of the Committee falls under any of the following, the Mayor may dismiss him/her:
1. When a member himself/herself submits his/her written resignation;
2. When it is difficult for a member to conduct his/her duties due to mental or physical incapacity which require long-term medical treatment, or other reasons;
3. When a member is deemed unsuited to conduct his/her duties as a member due to such reasons as damage to dignity, long-term absence, etc.

Article 13 (Allowances and Travel Expenses, etc.) Allowances and travel expenses may be paid to members of the Committee, experts, etc. who participate in the investigation or deliberation of the Committee or a subcommittee, within the budget.

CHAPTER 4 SELECTION AND MANAGEMENT OF FUTURE HERITAGE Article 14 (Selection of Seoul Future Heritage) (1) Any one, including any citizen, organization, etc., may make a proposal to the Mayor for the selection of a certain object as Seoul future heritage.
(2) The Mayor may select an object proposed under paragraph (1), as Seoul future heritage after deliberation by the Committee and by acquiring the consent of its owner, etc.: Provided, That when it is difficult to specify the owner, etc. of an object, such as in the case of a village, etc., the Mayor may, by way of exception, select such object as Seoul future heritage without the consent of the owner, etc.
(3) The Mayor shall issue written certification and a mark to the owner, etc. of Seoul future heritage selected pursuant to paragraph (2).

Article 15 (Revocation of Selection of Seoul Future Heritage) Where any Seoul future heritage selected pursuant to Article 14 (2) falls under any of the following, the Mayor may cancel its selection as Seoul future heritage:
1. When its owner, etc. so requests the cancellation of selection;
2. When it is designated and registered as cultural heritage under the Cultural Heritage Protection Act;
3. When it ceases to have value for conservation due to destruction, etc.;
4. Otherwise where the Committee recognizes that it ceases to have value for conservation.

Article 16 (Entrustment of Operation of Seoul Future Heritage Owned by Seoul Government) (1) For the efficient management and operation of Seoul future heritage owned by the Seoul Government, the Mayor may delegate or entrust the management and operation of such future heritage to a corporation, organization, or autonomous Gu.
(2) With respect to the procedures, etc. for the entrustment of the operation of Seoul future heritage owned by the Seoul Government, the Seoul Metropolitan Government Ordinance on Entrustment of Administrative Affairs to the Private Sector shall apply mutatis mutandis.

Article 17 (Recording and Promotion) In order to promote citizens' understanding of future heritage, the Mayor shall record the values, current conditions, and other data of Seoul future heritage and actively publicize such information.

Article 18 (Administrative and Financial Support) The Mayor may provide administrative and financial support for the identification, conservation, management, utilization, etc. of future heritage.

Article 19 (Enforcement Rule) Necessary matters concerning the selection of Seoul future heritage, the issuance of written certification and marks, the cancellation of selection, etc., shall be prescribe by rule.
