SEOUL METROPOLITAN CITY ORDINANCE ON SUPPORT FOR USE OF FOOD MATERIALS SAFE FROM RADIATION FOR FEEDING IN INFANT CARE CENTERS

SEOUL METROPOLITAN CITY ORDINANCE ON SUPPORT FOR USE OF FOOD MATERIALS SAFE FROM RADIATION FOR FEEDING IN INFANT CARE CENTERS

Article 1 (Purposes) This Ordinance is enacted to prepare a basis for relevant regulations and support to encourage the use of food materials safe from radiation, for feeding by infant care centers in Seoul Metropolitan City.

Article 2 (Definitions) The definitions of terms used in this Ordinance shall be as follows:
1. The term "radioactive substances" means radioactivity stipulated in Article 2 (1) of the Agricultural and Fishery Products Quality Control Act, and refers to cesium, iodine, etc. which are artificial radionuclides distinguished from natural radioactive substances;
2. The term "infant care centers" means child care centers under Article 10 of the Infant Care Act;
3. The term "sample test" means the testing of samples by selecting some of all food materials subject to testing.

Article 3 (Responsibilities and Duties of Mayor) The Mayor of Seoul Metropolitan City (hereinafter referred to as the "Mayor") may provide administrative and financial support to ensure that food materials safe from radioactive substances are supplied by conducting tests of radioactive substances on food materials supplied to infant care centers and establishing a quarantine system on radioactive substances involved in production, and distribution management to ensure the health of infants to whom feeding is provided as first priority.

Article 4 (Establishment and Operation of Committee on Support of Feeding Safe from Radiation) (1) The Mayor may establish the Committee on the Support of Feeding Safe from Radiation of Seoul Metropolitan City (hereinafter referred to as the "Committee") to supply food materials safe from radioactive substances.
(2) The Committee shall deliberate on the following:
1. Items, quantities, testing cycle, means of testing, etc. of food materials subject to testing of radioactive substances;
2. Effective radioactivity test system connected with the process of production and distribution of food materials for feeding;
3. Plan for education and public relations related to radioactivity, to persons concerned with feeding, such as parents, local residents, dietitians, cooks, etc.;
4. Investigation and research services for the establishment of a feeding management system safe from radiation;
5. Directions for operation and evaluation of an agency assuming full responsibility for food radioactivity safety management under Article 5.
(3) The Food Safety Countermeasure Committee of Seoul Metropolitan City shall perform functions of the Committee on it behalf.

Article 5 (Establishment of Agency Assuming Full Responsibility for Food Radioactivity Safety Management) (1) The Mayor may establish an agency assuming full responsibility for food radioactivity safety management (hereinafter referred to as "agency assuming full responsibility") as a working organization to supply safe food materials in response to radioactivity.
(2) An agency assuming full responsibility shall ensure safety from radioactive substances concerning food materials used for feeding.
(3) Food materials subject to tests on samples to ensure safety, shall be as follows:
1. Agricultural and fishery products supplied as food materials for mass feeding through the Agro-Fisheries & Food Corporation of Seoul Metropolitan City;
2. Agricultural and fishery products supplied to mass feeding facilities by distribution corporations of food materials for mass feeding;
3. Other agricultural and fishery products provided for feeding, deliberated upon by the Committee.
(4) Tests of samples shall be conducted first on agricultural and fishery products which have resulted in a high frequency of detection of radioactive substances based on the results of safety tests conducted by the Ministry of Food and Drug Safety and the Health and Environment Research Institute of Seoul Metropolitan City pursuant to Article 61 of the Agricultural and Fishery Products Quality Control Act.
(5) The result of tests and the quarantine system shall be reported to the Committee so that they may be reflected in the formulation of a future plan.
(6) An agency assuming full responsibility may have equipment and facilities necessary to conduct tests on samples under paragraph (3).

Article 6 (Support to Infant Care Centers) (1) The Mayor may provide administrative and financial support to infant care centers to expand the use of food materials for feeding safely from radiation.
(2) The Mayor shall conduct regular inspections on matters supported pursuant to paragraph (1).

Article 7 (Disclosure and Provision of Information) (1) The Mayor may disclose the results of various surveys and research.
(2) The Mayor shall provide information on safety tests of food materials used, to the guardians of infants to whom food materials for feeding safely from radiation pursuant to Article 4.

Article 8 (Enforcement Rules) Matters necessary for the enforcement of this Ordinance shall be prescribed by the Rules.
