SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON INDOOR AIR QUALITY CONTROL

Article 1 (Purpose) The purpose of this Ordinance is to prescribe matters necessary for adequately maintaining and controlling the indoor air quality of public-use facilities, newly-built multi-family housing, and mass transit vehicles.

Article 2 (Definitions) The terms used in this Ordinance are as defined in Article 2 of the Indoor Air Quality Control Act (hereinafter referred to as the "Act").

Article 3 (Responsibilities of Mayor) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") shall formulate and implement policies necessary for controlling the indoor air quality of public-use facility, newly-built multi-family housing, and mass transit vehicles in order to protect citizens' health and create a pleasant indoor environment.

Article 4 (Establishment of Standards for Maintaining Indoor Air Quality) The standards for maintaining indoor air quality under Article 5 (3) of the Act shall be as specified in the attached Table.

Article 5 (Control of Indoor Air Quality of Mass Transit Vehicles) (1) The Mayor may recommend the transportation business entities of mass transit vehicles to control and operate mass transit vehicles in compliance with management guidelines concerning the manufacturing, operation, etc. of mass transit vehicles under Article 9-3 (1) of the Act (hereinafter referred to as "management guidelines"). <Amended by Ordinance No. 7639, Jul. 16, 2020>
(2) The Mayor may provide the manufacturers or transportation business entities of mass transit vehicles with technical or financial support necessary for maintaining and controlling the indoor air quality of mass transit vehicles according to the management guidelines.

Article 6 (Support for Facilities Used by Vulnerable People) (1) To properly maintain, control, and improve indoor air quality of public-use facilities mainly used by those who are more vulnerable to air pollutants, such as children, senior citizens, and pregnant women, the Mayor may provide the following support to persons responsible for managing public-use facilities, such as the owners, occupants, or managers:
1. Consulting on the methods for maintaining and controlling indoor air quality suited to the scale and characteristics of the relevant public-use facilities;
2. Technical support and funding to improve indoor air quality of the relevant public-use facilities;
3. Any other technical, administrative, and financial support deemed necessary to maintain, control, and improve indoor air quality of the relevant public-use facilities.
(2) If deemed necessary, the Mayor may also provide support under the subparagraphs of paragraph (1) to persons responsible for managing public-use facilities, such as the owners, occupants, or managers, the scale of which is less than that of public-use facilities under Article 2 (1) of the Enforcement Decree of the Indoor Air Quality Control Act, within the budget.

Article 7 (Selection of Facilities with Excellent Indoor Air Quality) (1) The Mayor may select facilities with excellent indoor air quality to create a healthy indoor environment and an environment of voluntarily controlling indoor air quality.
(2) The effective period for selecting facilities with excellent indoor air quality shall be two years from the date of selection.
(3) Where a facility selected as those with excellent indoor air quality fails to meet the standards for selecting excellent facilities, such as the compliance with standards for field inspections and for air quality by each pollutant, during the period of selection, the Mayor may cancel the selection of the facility.

Article 8 (Enforcement Rules) Matters necessary for the enforcement of this Ordinance shall be prescribed by rule of the Seoul Metropolitan Government.

This Ordinance shall enter into force on the date of its promulgation.
