SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON CREATION OF AN IOT CITY

Article 1 (Purpose) The purpose of this Ordinance is to address urban problems in areas ranging from safety and welfare, to traffic, tourism, and the environment; to improve citizens' quality of life, and to contribute to enhancing urban competitiveness in advanced technologies by creating an IoT City in an efficient manner.

Article 2 (Definitions) The terms used in this Ordinance are defined as follows:
1. The term "The Internet of things, or IoT" means an intelligent infrastructure and service technology which enables exchange of information and communication between persons and things or between things by connecting all things based on information and communications technology;
2. The term "IoT city" means a city created based on an IoT environment.

Article 3 (Relationship to Other Statutes and Regulations, and Ordinances of the Seoul Metropolitan Government) Except as otherwise provided in other statutes, regulations, or Ordinances of the Seoul Metropolitan Government, creation of an IoT city shall be governed by this Ordinance.

Article 4 (Responsibilities) (1) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") shall endeavor to actively utilize IoT technology in citizens' everyday life and in public administration in order to address urban issues such as safety, welfare, traffic, tourism, and the environment.
(2) The Mayor shall endeavor to formulate and implement policies necessary to create an IoT city and to secure financial resources necessary for such policies.

Article 5 (Formulation and Implementation of IoT City Master Plans) (1) The Mayor shall formulate a master plan to create an IoT city (hereinafter referred to as "master plan") every five years to ensure creation of an IoT city in an efficient and systematic manner.
(2) The master plan shall include the following matters:
1. Basic direction-setting for an IoT city;
2. Goals and strategies for creating an IoT city and a system to advance such goals and strategies;
3. Matters relating to a project to create an IoT city (including a pilot project) and support for such project;
4. Matters relating to securing and managing financial resources to create an IoT city;
5. Other matters necessary for creating an IoT city.
(3) The master plan under paragraphs (1) and (2) shall be formulated in connection with the master plans for the smart city and informatization of the Seoul Metropolitan Government under the Seoul Metropolitan Government Ordinance on Smart City and Informatization. <Amended on Mar. 28, 2019; Dec. 31, 2020>
(4) The Mayor shall annually formulate and implement an action plan based on a master plan.

Article 6 (Advisory Groups) (1) The Mayor may establish an advisory group on the creation of an IoT city that consists of experts in IoT or high-tech digital technologies in order to create an IoT city in an efficient and systematic manner including by setting out a vision and strategy for an IoT city and proactively introducing and applying IoT technologies.
(2) The Mayor may authorize the Smart City Committee of the Seoul Metropolitan Government established under Article 7 of the Seoul Metropolitan Government Ordinance on Smart City and Informatization to perform some functions of the advisory group under paragraph (1). <Amended on Mar. 28, 2019; Dec. 31, 2020>

Article 7 (Projects to Create IoT City) The Mayor may promote the following projects to create an IoT city:
1. Projects relating to the establishment of infrastructure to apply IoT technologies;
2. Projects relating to the experimental application and demonstration of IoT technologies;
3. Projects relating to promoting the branding of an IoT city;
4. Projects relating to the advancement of functions of IoT platforms;
5. Projects relating to support for IoT-related businesses;
6. Other projects necessary for creating an IoT city.

Article 8 (Implementation of Pilot Project) (1) Where deemed necessary to create an IoT city, the Mayor may implement a pilot project that applies IoT technologies under the jurisdiction of the Seoul Metropolitan Government (hereinafter referred to as the "Seoul Government").
(2) The Mayor may provide, among other things, for the administrative, financial, and technical support necessary to create an IoT city under paragraph (1).
(3) The Mayor shall incorporate the results of a pilot project under paragraph (1) into expanding the project to create an IoT city.

Article 9 (Support for IoT-Related Businesses) (1) The Mayor may provide the following support to ensure the stable operation and enhanced technical capabilities of an IoT-related new venture business (referring to a business which meets the requirements of Articles 2-2 and 3 of the Act on Special Measures for the Promotion of Venture Businesses; hereinafter the same shall apply), the main place of business of which is located under the jurisdiction of the Seoul Government:
1. Consultation on the establishment and management of an enterprise;
2. Support for technology development and commercialization of outstanding ideas;
3. Support for the establishment of infrastructure;
4. Support for the arrangement of loans for the operation of businesses and technology development;
5. Other matters deemed necessary by the Mayor.
(2) The Mayor may establish and operate an IoT incubation center in order for the developers of IoT-related technologies, such as citizens and new venture businesses related to IoT, to explore, to experiment with and to materialize ideas utilizing IoT to address urban issues.

Article 10 (Education and Training of Specialized Human Resources) (1) The Mayor shall endeavor to train specialized human resources in fields necessary for the creation of an IoT city and to formulate policies for specialized education and training.
(2) The Mayor may support the following projects:
1. Training of human resources who specialize in IoT city;
2. Development and dissemination of educational programs about IoT city for citizens;
3. Projects for educational support concerning IoT at schools under Article 2 of the Elementary and Secondary Education Act in consultation with the Superintendent of the Seoul Metropolitan Office of Education;
4. Other projects deemed necessary by the Mayor for creating an IoT city.

Article 11 (Establishment of Cooperation System) (1) The Mayor shall establish a close cooperation system with the central government, autonomous Gus, corporations, organizations, etc. for the creation of an IoT city.
(2) Where necessary for paragraph (1), the Mayor may enter into a joint cooperation agreement with the private sector such as a corporation or an organization.

Article 12 (Entrustment of Affairs) The Mayor may entrust the following matters to relevant corporations or organizations having expertise, as prescribed by the Seoul Metropolitan Government Ordinance on Entrustment of Administrative Affairs to the Private Sector:
1. Projects to create an IoT city under Article 7;
2. Operation and management of an IoT incubation center under Article 9 (2);
3. Development and dissemination of educational programs about IoT city, education on the programs, and the training of specialized human resources under Article 10.

Article 13 (Enforcement Rules) Matters necessary for the enforcement of this Ordinance shall be prescribed by rule of the Seoul Government.
