SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON URBAN PARKS
ADDENDA <Ordinance No. 4917, Jan. 7, 2010> ① (Enforcement Date) This Ordinance shall enter into force on the date of its promulgation. ② (Ordinance Repealed) Seoul Metropolitan Government Ordinance on Parks (Seoul Metropolitan Government Ordinance No. 491, Nov. 22, 1967) shall be repealed when this Ordinance enters into force. ③ (Transitional Measures) Where a person has obtained permission to use park facilities in accordance with the previous Ordinance, he/she shall be deemed to have been entrusted with management in accordance with this Ordinance. ④ (Transitional Measures) Where a park has been designated and announced as a park which may collect admissions fees in accordance with the previous Ordinance, it shall be deemed to have been designated and announced in accordance with this Ordinance. ADDENDUM <Dec. 10, 1981> This Ordinance shall enter into force on January 1, 1982. ADDENDUM <Nov. 25, 1982> This Ordinance shall enter into force on January 1, 1983. ADDENDUM <Mar. 22, 1984> This Ordinance shall enter into force on the date of its promulgation, and matters concerning Seoul Grand Park shall apply from the commencement date of use of park facilities. ADDENDUM <Jan. 22, 1985> This Ordinance shall enter into force on the date of its promulgation. ADDENDUM <May 5, 1986> This Ordinance shall enter into force on the date of its promulgation. ADDENDUM <May 8, 1987> This Ordinance shall enter into force on the date of its promulgation. ADDENDUM <May 11, 1988> This Ordinance shall enter into force on the date of its promulgation. ADDENDUM <Jul. 18, 1989> This Ordinance shall enter into force on the date of its promulgation. ADDENDA <Apr. 13, 1991> ① (Enforcement Date) This Ordinance shall enter into force on May 10, 1991. ② (Transitional Measures concerning Fee for Entrustment of Management) The previous provisions shall apply to a fee for entrustment of management to a person who is entrusted with management of park facilities in accordance with the previous provisions at the time this Ordinance enters into force until the expiration date of the period of entrustment notwithstanding the amended provisions of attached Table 3: Provided, That this shall not apply to cases where a fee for entrustment of management calculated in accordance with the previous provisions exceeds a fee for entrustment of management calculated in accordance with the amended provisions of attached Table 3. ADDENDUM <May 14, 1991> This Ordinance shall enter into force on the date of its promulgation. ADDENDUM <May 12, 1992> This Ordinance shall enter into force on the date of its promulgation. ADDENDA <Jan. 13, 1993> ① (Enforcement Date) This Ordinance shall enter into force on the date of its promulgation. ② (Transitional Measures concerning Fee for Occupation and Use) Adjustment standards of increase under the provisions of Article 7 (2) and the proviso to Article 8 (5) shall apply to the decision on a fee for entrustment of management and fee for occupation and use of park facilities after January 1, 1992. ③ (Transitional Measures concerning Permission to Use Greenbelt) Where a person has obtained permission to use a greenbelt under the provisions of the previous Article 17 or approval for restoration to the original state under the provisions of the previous Article 19 at the time this Ordinance enters into force, he/she shall be deemed to have obtained permission to use a greenbelt under the amended provisions of Article 17 or approval under the amended provisions of Article 19. ④ (Transitional Measures concerning Acquisition of Property) An autonomous Gu shall take the procedure for the acquisition of property according to division of ownership referred to in Article 26. ADDENDUM <Jan. 13, 1993> ① (Enforcement Date) This Ordinance shall enter into force on the date of its promulgation. ADDENDUM <Mar. 18, 1993> This Ordinance shall enter into force on the date of its promulgation. ADDENDA <Sep. 25, 1993> ① (Enforcement Date) This Ordinance shall enter into force on the date of its promulgation. ② (Applicability) Where a park management agency has permitted long-term occupation and use of a park and collected the total amount of fees for occupation and use in accordance with the previous provisions before this Ordinance enters into force, the previous provisions shall apply until the expiration date of the period of permission. ADDENDUM <Dec. 31, 1993> Article 1 (Enforcement Date) This Ordinance shall enter into force on the date of its promulgation. ADDENDUM <Jun. 10, 1995> This Ordinance shall enter into force on the date of its promulgation. ADDENDUM <Jul. 5, 1997> This Ordinance shall enter into force on the date of its promulgation. ADDENDUM <Dec. 5, 1997> This Ordinance shall enter into force on the date of its promulgation. ADDENDA <Jul. 31, 1999> ① (Enforcement Date) This Ordinance shall enter into force on the date of its promulgation. ② (Transitional Measures concerning Permission to Occupy and Use) The previous provisions shall apply to the conduct of business concerning facilities of which occupation and use has been permitted or which has been entrusted or the procedure therefor is in progress at the time this Ordinance enters into force, and the calculation, imposition and collection of fees for occupation and use, etc. until the period of the relevant occupation and use or entrustment expires. ADDENDUM <Oct. 30, 1999> The Supreme Court 99 Addition 85, Nullity Decided, on May 30, 2000 This Ordinance shall enter into force on the date of its promulgation. ADDENDUM <Sep. 29, 2001> This Ordinance shall enter into force on the date of its promulgation. ADDENDA <Dec. 31, 2001> Article 1 (Enforcement Date) This Ordinance shall enter into force on the date of its promulgation: Provided, That the amended provisions of Articles 8-2 (3) and 18 (3) shall enter into force on January 1, 2002. Article 2 (Applicability According to Change of Method of Calculation of Fees for Occupation and Use) A method of the calculation of fees for occupation and use of a park and greenbelt changed in accordance with the amended provisions of Articles 9 and 17 shall apply beginning with the first application for permission to occupy and use after this Ordinance enters into force. ADDENDUM <Jan. 10, 2003> This Ordinance shall enter into force on the date of its promulgation. ADDENDUM <Jun. 16, 2003> This Ordinance shall enter into force on the date of its promulgation. ADDENDA Ordinance on Urban Planning < No. 4131, Jul. 25, 2003> Article 1 (Enforcement Date) This Ordinance shall enter into force on the date of its promulgation. Articles 2 through 11 Omitted. ADDENDA Ordinance on Establishment of Administrative Organizations < No. 4284, Jun. 16, 2005> Article 1 (Enforcement Date) This Ordinance shall enter into force on the date of its promulgation. Articles 2 and 3 Omitted. ADDENDA Ordinance on Conferment of Honorary Citizenship < No. 4311, Sep. 30, 2005> Article 1 (Enforcement Date) This Ordinance shall enter into force on the date of its promulgation. Article 2 Omitted. ADDENDA <Dec. 29, 2005> ① (Enforcement Date) This Ordinance shall enter into force on the date of its promulgation. ② (Transitional Measures concerning Selection Method of Trustee) Where the procedure for selection of a trustee of convenience facilities from among urban park facilities is in progress at the time this Ordinance enters into force, the previous provisons shall apply. ③ (Transitional Measures concerning Extension of Period of Entrustment) The amended provisions of Article 11 (2) shall not apply to a trustee whose period of contract for entrustment expires within one month from the date this Ordinance enters into force. ADDENDUM <Oct. 4, 2006> This Ordinance shall enter into force on the date of its promulgation. ADDENDA <Jul. 30, 2007> Article 1 (Enforcement Date) This Ordinance shall enter into force on the date of its promulgation: Provided, That the amended provisions of Article 23 shall enter into force three months after the date of its promulgation. Article 2 (Transitional Measures concerning Management in Trust) A person who manages an urban park and park facilities in trust at the time this Ordinance enters into force shall be deemed to manage an urban park and park facilities in trust in accordance with the provisions of this Ordinance. Article 3 (Transitional Measures concerning Permission to Occupy and Use or to Use) The previous provisions shall apply to an occupant or user who has obtained a permit to occupy and use or to use before this Ordinance enters into force and is occupying and using or using until the permit expires. Article 4 (General Transitional Measures) Disposition and other acts done by the Mayor concerning urban parks, park facilities and greenbelts before this Ordinance enters into force shall be deemed disposition and other acts in accordance with this Ordinance. Article 5 Omitted. ADDENDUM <Jul. 30, 2008> This Ordinance shall enter into force one month after the date of its promulgation. ADDENDUM <Jan. 8, 2009> This Ordinance shall enter into force one month after the date of its promulgation. ADDENDA Ordinance of Establishment of Administrative Organizations <No. 4817, Jul. 30, 2009> Article 1 (Enforcement Date) This Ordinance shall enter into force on the date of its promulgation. Article 2 Omitted. ADDENDUM <Jan. 7, 2010> This Ordinance shall enter into force on the date of its promulgation.
