SEOUL METROPOLITAN GOVERNMENT FRAMEWORK ORDINANCE ON CARBON NEUTRALITY AND GREEN GROWTH FOR CLIMATE ACTION

CHAPTER I GENERAL PROVISIONS Article 1 (Purpose) The purpose of this Ordinance shall be to prescribe matters delegated by the Framework Act on Carbon Neutrality and Green Growth For Coping with Climate Crisis, the Enforcement Decree of the same Act and matters necessary for enforcing the same.


Article 2 (Definitions) The terms used in this Ordinance are defined as follows:
1. The term "climate change" refers to a change in the climate system caused by increased concentrations of greenhouse gases as a consequence of human activities, which occurs in addition to natural climate change that has been observed during a considerable period of time.
2. The term "climate crisis" refers to a state wherein radical reduction of greenhouse gases is needed because climate change is posing an irreversible risk to human civilization, including water deficiency, food shortage, ocean oxidization, sea level rise, ecosystem collapse as well as extreme weather conditions.
3. The term “carbon neutrality” refers to a state wherein greenhouse gases emitted, released, or leaked out into the atmosphere become net-zero as they are offset by greenhouse gas absorption elsewhere.
4. The term "carbon neutral society" refers to a society in which people lower or eliminate dependence on fossil fuels and lay a foundation for finances, technologies, systems, etc. for adaptation to climate crisis and just transition to smoothly achieve carbon neutrality and prevent and minimize damage and adverse effects that may arise in the process.
5. The term "greenhouse gas" refers to any gaseous matter in the atmosphere which absorbs or re-emits radiant heat to cause greenhouse effects, including carbon dioxide (CO2), methane (CH4), nitrous oxide (N2O), hydrofluorocarbon (HFCs), perfluorocarbon (PFCs), sulfur hexafluoride (SF6), and other substances specified by the Presidential Decree.
6. The term "greenhouse gas emission" refers to direct emission of greenhouse gases, which are emitted, released, or leaked out in the course of human activities, as well as indirect emission of greenhouse gases, which are induced by using electricity or heat (limited to heat using fuels or electricity as a heat source) supplied from other persons.
7. The term "greenhouse gas reduction" refers to all kinds of activities aimed at reducing or absorbing greenhouse gas emissions to alleviate or delay climate change.
8. The term "greenhouse gas absorption" means that greenhouse gases are removed from the atmosphere by means of land utilization, changes in land utilization, forestry activities, etc.
9. The term "new and renewable energy" refers to new and renewable energy defined in subparagraphs 1 and 2 of Article 2 of the Act on the Promotion of the Development, Use and Diffusion of New and Renewable Energy.
10. The term "energy conversion" means converting the entire system of producing, transferring, and consuming energy to cope with climate crisis (referring to a series of activities to address climate crisis, such as the reduction of greenhouse gases, adaptation to climate change, and the establishment of related infrastructure; hereinafter the same shall apply) and to pursue environmental protection, safety, energy security, and sustainability.
11. The term "adaptation to climate crisis" refers to all kinds of activities which reduce vulnerability to climate crisis and enhance adaptability and resilience to health damage and natural disasters caused by climate crisis, to minimize the current or foreseeable ripple effects and impacts of the climate crisis or to turn them into opportunities to take advantage of the climate crisis.
12. The term "just transition" refers to a policy direction-setting for protecting workers, farmers, small and medium entrepreneurs, etc. in regions or industries that could suffer direct or indirect damage in the course of transitioning to a carbon neutral society, to make the society share the burden caused in the transition process and minimize damage caused to vulnerable social groups.
13. The term "green growth" refers to an economic growth in harmony with the environment, which can be achieved by saving and efficiently using energy and resources to mitigate climate change and environmental damage, and securing new growth engines and creating job opportunities through research and development of clean energy and green technology.
14. The term "green technology" refers to a technology used to achieve carbon neutrality and promote green growth by replacing the use of fossil fuels and using energy and resources more efficiently throughout the entire process of social and economic activities, which includes a technology to cope with climate change (referring to technology for coping with climate change defined in subparagraph 6 of Article 2 of the Act on the Promotion of Technological Development for Climate Change), technology for efficient use of energy, clean production technology, technology for new and renewable energy, technology for resource circulation (referring to resources circulation defined in subparagraph 1 of Article 2 of the Framework Act on Resources Circulation; hereafter the same shall apply), and environment-friendly technology (including related convergence technologies).
15. The term "green industry" refers to all kinds of industries which realize carbon neutrality and facilitate green growth by replacing the use of fossil fuels generating greenhouse gas emissions, enhancing the efficient use of energy and resources, and producing goods and providing services to improve the environment.


Article 3 (Principles) Seoul Metropolitan City (hereinafter referred to as the "City") shall promote the transition to a carbon neutral society and green growth under the following fundamental principles:
1. Promote the transition to a carbon neutral society as a comprehensive confrontation strategy against the global climate crisis;
2. Establish and enforce the policy for the reduction of greenhouse gas emissions and adaptation to climate crisis in light of all areas and fields related to the economy, society, or environment;
3. Realize the just transition to protect vulnerable classes, fields, and areas that may be damaged during the transition to a carbon neutral society;
4. Use as an opportunity to expand a growth engine and create jobs by reinforcing the investment in and support for green technology and green industries; and
5. Secure all citizens to participate and cooperate with businesses, economic organizations and citizen organizations in the transition process to a carbon neutral society and the promotion of green growth.


Article 4 (Duties of the City) (1) The City shall endeavor to cause the fundamental principles under Article 3 to be reflected in all fields, such as the economy, the society, education, culture, etc.
(2) The City shall formulate and enforce a policy for the transition to a carbon neutral society and the promotion of green growth in light of regional characteristics, conditions, etc.
(3) The City shall endeavor to minimize the emission of greenhouse gases from projects that it implements as a principal.
(4) The City shall prepare measures necessary for the following to be able to efficiently reduce greenhouse gas emissions and adapt themselves to climate crisis: government-invested public corporations under Article 49 of the Local Public Enterprise Act; public agencies, business operators, and citizens under Article 76 of the same Act. Also, the City may provide administrative, financial, and technical support necessary therefor.
(5) The City shall endeavor to provide necessary assistance, such as the provision of climate crisis-related information with business operators and citizens in order to promote the reduction of greenhouse gas emissions and adaptation to the climate crisis.


Article 5 (Duties of Citizens) (1) Citizens shall practice the green life under Article 67(1) of the Framework Act on Carbon Neutrality and Green Growth for Coping with Climate Crisis (hereinafter referred to as the "Act") in their homes, schools and business places, etc. and actively participate and cooperate on the policy of the City.
(2) Citizens shall endeavor to suppress the emission of greenhouse gases generated in their everyday lives.


Article 6 (Relation with Other Ordinances) Except in cases specifically prescribed by relevant ordinances concerning the transition to carbon neutrality and the promotion of green growth, what is prescribed by this Ordinance shall be followed.



CHAPTER II TARGETS AND PLANS FOR THE REDUCTION OF GREENHOUSE GAS EMISSIONS Article 7 (Setting of Targets to Reduce Greenhouse Gas Emissions) (1) The City shall set its vision to achieve carbon neutrality by 2050 in order to overcome the global climate crisis (hereinafter referred to as the "Seoul Carbon Neutrality Vision").
(2) The City shall set a target to reduce greenhouse gas emissions in the medium and long term (hereinafter referred to as the "Reduction Target") that shall include its master plan for carbon neutrality and green growth (hereinafter referred to as the "Master Plan") under Article 8(1) herein.
(3) The Mayor of the City (hereinafter referred to as the "Mayor") shall, when setting or modifying the Reduction Target, consider the following:
1. The Seoul Carbon Neutrality Vision;
2. A medium and long term national greenhouse gas emission reduction target under Article 8(1) of the Act and Article 3(1) of the Enforcement Decree of the Act (hereinafter referred to as the "Enforcement Decree");
3. Status and prospects for the emission and absorption of greenhouse gases by fields in regions;
4. Attainability of the Reduction Target;
5. Technical prospect for the reduction of greenhouse gas emissions; and
6. Trend for coping with climate crisis by international societies, such as overseas local governments.


Article 8 (Formulation of Master Plan for Carbon Neutrality and Green Growth) (1) The Mayor shall formulate and enforce, every five years, the Master Plan for carbon neutrality and green growth of the City under Article 10(1) of the Act with ten years as its planning period in light of the following: the national master plan for carbon neutrality and green growth; regional characteristics; various opinions of communities, etc.
(2) The Master Plan shall include the following:
1. Status and prospects for the emission and absorption of greenhouse gases in regions;
2. Medium and long term reduction target and implementation plans by field and year;
3. Coping measures, such as monitoring, prediction, impact assessment, vulnerability assessment, disaster prevention, etc. in relation to regional climate change;
4. Education and publicity of the transition to a carbon neutral society and the promotion of green growth;
5. Promotion of green growth, such as the development of green technology, green industries, etc.; and
6. Other matters that the Mayor recognizes as necessary for the transition to a carbon neutral society and the promotion of green growth.
(3) When formulating or modifying the Master Plan, the Mayor shall report such facts to the Seoul Metropolitan Council (hereinafter referred to as the "Council") after being deliberated by the City's 2050 Carbon Neutrality and Green Growth Committee under Article 10(1) herein, and shall file the report with the Minister of Environment no later than one month from the date when the deliberation is completed.
(4) The Mayor shall publicly announce the Master Plan when finalized.


Article 9 (Checking the Implementation of the Target and Plan) (1) The Mayor shall check every year the implementation by field and year in order to achieve the medium and long term reduction target under Article 8(2)2 herein.
(2) The Mayor qualitatively and quantitatively shall check the implementation and major achievement of the Master Plan under Article 8(1) every year.
(3) The Mayor shall prepare the findings report for the check under paragraphs (1) and (2) above and file the same with the Minister of Environment by May 31 every year after being deliberated by the 2050 Carbon Neutrality and Green Growth Committee.



CHAPTER III SEOUL METROPOLITAN GOVERNMENT 2050 CARBON NEUTRALITY AND GREEN GROWTH COMMITTEE Article 10 (Organization and Operation of the 2050 Carbon Neutrality and Green Growth Committee) (1) The 2050 Carbon Neutrality and Green Growth Committee (hereinafter referred to as the "Committee") may be established under Article 22 of the Act to deliberate and resolve the City's major policies and plans for the transition to a carbon neutral society and the promotion of green growth and the implementation thereof.
(2) The Committee shall comprise about 20 members, including 1 chairperson.
(3) The chairperson shall be the Vice-Mayor I for Administrative Affairs, and where the chairperson cannot perform his/her duties due to unavoidable reasons, the vice-chairperson shall become an acting chairperson.
(4) The chairperson shall supervise the affairs of the Committee and represent the Committee to the public.
(5) Members are appointed or commissioned in light of their gender by the Mayor from among persons that fall under any of the following subparagraphs:
1. The City's public officials equivalent to a head of division or higher;
2. Members of the Council who are recommended by the Council chairperson; or
3. Persons with efficient knowledge and experience in carbon neutrality policies, such as climate science, greenhouse gas emission reduction, prevention and adaptation to climate crisis, energy and resources, green technology, green industries, just transition, etc.
(6) The term of office for commissioned members shall be 2 years and such members may serve consecutive terms only twice; Provided, That the term of office of a supplementary member shall be the remaining term of office of the preceding member.
(7) The Mayor may decommission a member in the following cases:
1. Where the member becomes unable to do his/her duties due to mental and physical disability;
2. Where the member commits an irregularity as a matter of duty;
3. Where the member commits neglect of duty, injury to dignity, etc.; or
4. Where the member expresses his/her opinion that it is difficult for him/her to perform his/her duties; or
(8) The Committee shall have a secretary to handle its affairs and the secretary shall be a head of department in charge of carbon neutrality-related affairs.
(9) The Committee's expenses may be provided in a form of operation expenses, allowances, travel expenses, etc. within the scope of budgets.


Article 11 (Functions of the Committee) The Committee shall deliberate and resolve the following matters:
1. Matters concerning a basic direction of the policy for the transition to a carbon neutral society and the promotion of green growth;
2. Matters concerning the formulation of the Seoul Carbon Neutrality Vision and Reduction Target;
3. Matters concerning the formulation. modification and enforcement of the Master Plan;
4. Matters concerning the check findings regarding the implementation of the Master Plan;
5. Matters concerning the formulation and enforcement of the City's measures for coping with climate crisis under Article 21(1) herein;
6. Matters concerning the check of implementation under Article 22(1) herein; and
7. Other matters that the chairperson recognizes as necessary for the transition to a carbon neutral society and the promotion of green growth.


Article 12 (Meetings) (1) Committee meetings shall be convened by a chairperson, when the chairperson recognizes as necessary or 1/3 or more of its registered members request to convene a meeting.
(2) Committee meetings shall be started when a majority of registered members are present and resolved by vote of a majority of the members present; Provided, That the deliberation and resolution may be rendered in writing, when the chairperson determines that it would be impossible to convene a face-to-face meeting due to urgent reasons, such as force majeure, or that agenda are insignificant.


Article 13 (Exclusion, Recusal, and Abdication of Members) (1) A member shall be excluded from the deliberation or resolution of the Committee in the following cases:
1. Where the member or his/her current or ex-spouse becomes a party to the relevant matter or is or was in the relation of co-right holder or obligor;
2. Where the member is or was a relative of a party to the relevant matter;
3. Where the member provides or provided testimony, appraisal, or legal advice in relation to the relevant matter; or
4. Where the member is or was involved as an agent of the party to the relevant matter.
(2) Where it is difficult to expect that a member would fairly deliberate or resolve, a party may request the Committee to exclude the member and the Committee shall resolve whether or not to exclude the member. In such cases, the member subject to the request for exclusion may not participate in the resolution.
(3) Where a member falls under any of the subparagraphs of paragraph (1) above, the member shall, for himself/herself, abdicate the deliberation or resolution of the relevant matter.



CHAPTER IV POLICY FOR THE REDUCTION OF GREENHOUSE GAS EMISSIONS Article 14 (Budget for Greenhouse Gas Emission Reduction Awareness) (1) The Mayor shall analyze an effect of the budget and fund on climate change as stipulated by related laws and regulations and enforce the budget for greenhouse gas emission reduction awareness in which the effect is reflected.


Article 15 (Conversion to New and Renewable Energy) (1) The Mayor may formulate and enforce, within his/her jurisdiction, the policy for energy saving and energy conversion to new and renewable energy.
(2) The Mayor shall endeavor to promote the supply and use of energy saving and new and renewable energy facilities for the following: infrastructure, such as roads, transport, ports, etc.; and public-use facilities, such as stadia, gyms, cultural centers, etc.


Article 16 (Revitalization of Green Buildings) (1) A person who newly constructs buildings and an owner of the existing buildings shall endeavor to follow the standards and procedures stipulated by the Mayor to revitalize green buildings under Article 31(1) of the Act.
(2) The Mayor may provide administrative, financial, and technical support for a person who follows the standards and procedures under paragraph (1) above to revitalize green buildings.


Article 17 (Revitalization of Green Transport) (1) Citizens shall refrain from the use of vehicles in their business activities and everyday lives and maintain their vehicles in an appropriate way to reduct the emission of greenhouse gases.
(2) The Mayor shall endeavor to develop and supply equipment, devices, etc. preventing idling and drivers of vehicles shall not idle their vehicles while parking, stopping, etc.
(3) The Mayor may formulate and enforce the policy that restricts vehicle operation in downtown to reduce greenhouse gas emissions and inhibit vehicle operation in downtown by designating no vehicle day or no vehicle street. In such cases, all procedures under the Urban Traffic Improvement Promotion Act or the Road Traffic Act shall be followed.
(4) The Mayor shall formulate and enforce the policy that revitalizes the use of environment-friendly means of transportation, such as bicycles, so that citizens could safely and conveniently move even without vehicles.


Article 18 (Expansion of the Supply of Environment-Friendly Motor Vehicles) (1) The Mayor shall, when purchasing motor vehicles, purchase motor vehicles (hereinafter referred to as the "Environment-Friendly Motor Vehicles") under subparagraph 2 of Article 2 of the Act on the Promotion of Development and Distribution of Environment-Friendly Motor Vehicles on a preferential basis and endeavor to distribute the same.
(2) The Mayor may provide purchasers of environment-friendly motor vehicles with necessary support, such as financial assistance.
(3) The Mayor shall endeavor to distribute infrastructure, such as electric vehicle charging stations, hydrogen stations, etc. to expand the distribution of environment-friendly motor vehicles.


Article 19 (Expansion of Carbon Sinks) (1) The Mayor shall formulate and enforce a policy that creates and expands carbon sinks under Article 33(1) of the Act and improves the absorption of greenhouse gases in order to reduce greenhouse gas emissions.
(2) When business operators or citizens create and expand carbon sinks and improve their capability to voluntarily absorb greenhouse gases, the Mayor may provide administrative, financial, and technical support necessary therefor.
(3) When a forest is damaged due to unavoidable reasons, the Mayor may create an alternative forest to offset the emission of greenhouse gases anticipated therefrom.


Article 20 (Preparation of Information and Statistics on Greenhouse Gases) (1) The Mayor shall prepare information and statistics that are necessary to calculate and analyze the greenhouse gas statistics of the City under Article 36(3) of the Act.
(2) The Mayor shall endeavor to reinforce the City's capability to calculate and analyze the greenhouse gas statistics and improve on the transparency, accuracy, integrity, consistency, etc. of the statistics.



CHAPTER V CLIMATE CRISIS ADAPTATION PROJECT Article 21 (Formulation of Climate Crisis Adaptation Measures) (1) The Mayor shall formulate and enforce, every five years, the City's climate crisis adaptation measures (hereinafter referred to as the "Adaptation Measures") in light of the following: the national climate crisis adaptation measures under Article 38(1) of the Act; regional characteristics; various opinions of communities, etc.
(2) The Adaptation Measures under paragraph (1) above shall include the following:
1. Matters concerning the assessment of the effect of climate change and vulnerability to climate crisis in the City;
2. Matters concerning the climate crisis adaptation measures of the City;
3. Matters concerning the adaptation measures by field, such as water control, the ecosystem, health, etc. in the City;
4. Matters concerning the prevention of disasters due to climate crisis for vulnerable classes, regions, etc.; and
5. Other matters that the Mayor recognizes as necessary for adaptation to climate crisis.
(3) When formulating or modifying the Adaptation Measures, the Mayor shall report such facts to the City Council after being deliberated by the Committee and shall file the report with the Minister of Environment no later than 1 month from the date when the deliberation is completed.
(4) The Mayor shall publicly announce the Adaptation Measures when finalized.


Article 22 (Inspection of Implementation Progress of Adaptation Measures) The Mayor shall do the following every year: inspect the implementation progress of the Adaptation Measures; prepare a report of the findings; be deliberated by the Committee; report such facts to the Council; and file a report with the Minister of Environment by April 30.



CHAPTER VI TRANSITION, SPREAD, ETC. OF CARBON NEUTRAL LOCAL COMMUNITIES Article 23 (Support, Special Cases, etc. Regarding Green Technology and Green Industries) (1) The Mayor may provide support, such as payment of subsidies, provision of demonstration place and financial support, etc. for demonstration projects, as may be necessary for green technology and green industries within budgetary limits.
(2) The Mayor may support enterprises related to green technology and green industries by exempting them from local income tax, acquisition tax, property tax, registration tax, etc., as prescribed by the Restriction of Special Local Taxation Act.
(3) Where an enterprise related to green technology or green industry invites foreign investment under Article 2(1)4 of the Foreign Investment Promotion Act, the Mayor shall endeavor to assist the enterprise to the fullest extent possible.
(4) The Mayor may have agencies in which the City makes contributions or investments perform duties, such as the support under paragraph (1) above.


Article 24 (Support, Education, and Public Relations for Green Life Campaign) (1) The Mayor shall formulate policy measures to support a life of minimizing the generation of greenhouse gases and pollutants through saving energy and resources and diverting consumption toward green products in citizens’ everyday life from production to consumption to activities, etc. (hereinafter referred to as "Green Life"), and reinforce education and public relations, thereby aggressively spreading a national green life campaign.
(2) The Mayor may provide relevant private organizations, institutions, etc. with necessary financial and administrative support to ensure the Green Life campaign is spread as a voluntary practice movement driven by the private sector.
(3) The Mayor shall promote the settlement and spread of Green Life as well as education and public relations to improve citizens' awareness and disseminate the knowledge of climate change and carbon neutrality.


Article 25 (Cooperation with the State) (1) The Mayor shall plan to cooperate with the central and other local governments on a policy with which it could be possible to cope with, on a large scale, the transition to a carbon neutral society and the promotion of green growth.
(2) The Mayor shall endeavor to cooperate with government organizations, local governments, citizen organizations, etc. for the following: transition to a carbon neutral society; exchange of information as to the promotion of green growth; exchange of technology, etc.
(3) The Mayor shall cooperate with foreign local governments, citizen organizations, related organizations, etc. for the following: exchange of information as to coping with climate crisis; exchange of technology; international cooperation, etc.


Article 26 (Establishment, Designation, Operation, etc. of Carbon Neutrality Support Center) (1) The Mayor may establish a carbon neutrality support center (hereinafter referred to as the "Support Center") under Article 68(1) of the Act or designate among the following organizations and agencies under Article 63(1) of the Enforcement Decree and operate accordingly:
1. Local government-affiliated agencies or government-established research institutes;
2. Schools under Article 2 of the Higher Education Act; or
3. Other agencies and groups with exclusive organizations, facilities, and professionals who could perform duties under Article 26(2).
(2) The Support Center shall perform the following:
1. Support to formulate and enforce the Master Plan;
2. Support to formulate and enforce the Adaptation Measures;
3. Facilitate the City's energy conversion and develop and spread the conversion model;
4. Formulate a plan that improves the participation and awareness of carbon neutrality in local communities and support the implementation thereof;
5. Support related education and public relation projects;
6. Support inter-city carbon neutrality cooperative projects;
7. Support to prepare related information and statistics for the calculation and analysis of greenhouse gas statistics;
8. Investigate and research on local carbon neutrality;
9. Spread the development of the carbon neutrality model based on local transportation, building, green life, resources cycling, agriculture, livestock, fisheries, etc.; and
10. Support climate crisis coping activities pursuant to Article 65(1) of the Act by the secretariat of Local Governments' Action Alliance for Carbon Neutrality and mutual cooperation improvement activities among local governments.
(3) When establishing or designating the Support Center, the Mayor shall publicly announce such facts on the website, official gazette, etc.
(4) The Mayor may request the following data to the Support Center established or designated under paragraph (1) above:
1. Operation plan for the Support Center;
2. Human resources, organization, and facilities of the Support Center;
3. Budget plan for the Support Center;
4. Details of the use of support funds; and
5. Other data that the Mayor recognizes as necessary.
(5) The Mayor may, within budgetary limits, provide all or part of the expenses necessary to operate the Support Center established or designated under paragraph (1) above.


Article 27 (Establishment of a Just Transition Support Center) (1) The Mayor may establish and operate a just transition support center (hereinafter referred to as the "Transition Center") under Article 53(1) of the Act to protect and support industries and regions experiencing social and economic inequalities in the course of the transition to a carbon neutral society.
(2) The Transition Center shall perform the following:
1. Investigate and research trends for just transition at home and abroad;
2. Investigate the effect of the transition to a carbon neutral society on jobs and local communities;
3. Research and support a transition plan for industries, labor, and local economies and a job transition model;
4. Educate, train, and support career transitions, reemployment, career change, etc.;
5. Consult and support business transitions, such as business conversion, etc.;
6. Propose to improve related statutes and institutions;
7. Support the development of alternative industries by region and industry and business linkage and adjustment in relation to job creation; and
8. Find and promote related businesses.
(3) The Transition Center established under paragraph (1) above shall submit, no later than January 31 every year, the results of performance in the previous year and a business plan for the relevant year to the Minister of Trade, Industry, and Energy and the Minister of Employment and Labor.
(4) The Mayor may support the budget necessary to establish and operate the Transition Center.

Addenda <Ordinance No. 8437, Jul. 11, 2022>
Article 1 (Enforcement Date)
This Ordinance shall enter into force on the date of its promulgation.
Article 2 (Abolition of Other Ordinances)
On the enforcement of this Ordinance, the following are abolished: the Seoul Metropolitan Government Framework Ordinance on Low Carbon & Green Growth; the Seoul Metropolitan Government Ordinance on Climate Action; and the Seoul Metropolitan Government Framework Ordinance on the Green New Deal.
Article 3 (Transitional Measures)
As of the enforcement of this Ordinance, the comprehensive plan for coping with climate change formulated in accordance with the then existing Seoul Metropolitan Government Ordinance on Climate Action shall be regarded as plans and measures under this Ordinance, until the master plan and adaptation measures under this Ordinance are formulated for the first time.
