SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON SUPPORT FOR INSTALLATION OF FLOOD PREVENTION FACILITY

Article 1 (Purpose) The purpose of this Ordinance is to prescribe matters necessary to support the installation of flood prevention facilities in order to protect the lives, bodies, and property of citizens from damage caused by storm and flood.

Article 2 (Definitions) The terms used in this Ordinance are defined as follows:
1. The term "storm and flood damage" refers to storm and flood damage in accordance with Article 2 (3) of the Countermeasures Against Natural Disasters Act;
2. The term "flood prevention facility" refers to facilities under each subparagraph of Article 19-2 of the "Regulations on Standards for Evacuation and Fire Protection Structures of Buildings" and other facilities installed to prevent flood damage to buildings from storm and flood damage.

Article 3 (Duties of the Mayor) The Mayor of Seoul Metropolitan City (hereinafter referred to as the "Mayor") shall endeavor to support the installation of flood prevention facilities in areas and buildings requiring flood prevention facilities in order to protect the lives, bodies, and property of citizens from storm and flood damage.

Article 4 (Relationship with Other Ordinances) Except for cases where there are special provisions in other ordinances regarding support for the installation of flood prevention facilities, the provisions of this Ordinance shall be followed.

Article 5 (Establishment and Implementation of Support Plan) (1) The Mayor shall establish and implement a plan to support the installation of flood prevention facilities (hereinafter referred to as "support plan") in order to protect citizens' lives, bodies, and property from storm and flood damage.
(2) The support plan shall include the following items:
1. Goal and direction of support plan;
2. Damage caused by storm and flood in the previous year;
3. Criteria and targets for installation of flood prevention facilities;
4. Matters concerning financing to support the installation of flood protection facilities;
5. Other matters necessary to support the installation of flood prevention facilities.
(3) The Mayor shall report the progress and performance of the previous year's support plan to the relevant standing committee during the review of the settlement of accounts for the relevant year by the Seoul Metropolitan Council.

Article 6 (Fact-Finding Investigation) (1) In order to efficiently establish and implement a support plan under Article 5, the Mayor may conduct a fact-finding investigation on the current status of areas where flood damage has occurred or is at high risk of occurrence.
(2) The Mayor may request the submission of data or opinions from autonomous districts and related institutions and organizations, etc., if necessary for the fact-finding investigation under paragraph (1).

Article 7 (Support for Expenses) (1) The Mayor may subsidize a part of the cost for installing flood prevention facilities in areas where flood damage has occurred or is at high risk to the head of a district within budgetary limits.
(2) The support standards and procedures under paragraph 1 shall be determined separately by the Mayor.

Article 8 (Public Relations) (1) The Mayor may recommend that owners, occupants, or managers of buildings, etc. install flood prevention facilities to prevent flood damage from storm and flood damage.
(2) The Mayor may publicize matters related to support the installation of flood prevention facilities through the Seoul Metropolitan News or the Seoul Metropolitan Government website.

Article 9 (Establishment and Operation of Cooperation System) The Mayor may establish and operate a cooperative system with autonomous districts and organizations specializing in natural disasters to support the installation of flood prevention facilities.

This Ordinance shall enter into force on the date of its promulgation.
