SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE COUNCIL OF AUDIT CITIZEN-COMMISSIONER

Article 1 (Purpose)
The purpose of this Ordinance is to prescribe the matters necessary for staffing and operating the Seoul Metropolitan Government Council of Audit Citizen-Commissioners in order to ensure citizens' participation in audit administrative procedures and ensure fairness and transparency in audit procedures.

Article 1 (Enforcement Date)
This Ordinance shall enter into force on the date of its promulgation.
|
|
Article 2 (Functions)
(1) The Seoul Metropolitan Government Council of Audit Citizen-Commissioners (hereinafter referred to as "Council") shall conduct deliberation on each of the following matters and provide consultation for Seoul Metropolitan Government Mayor (hereinafter referred to as "Mayor"):

Article 3 (Organizational Structure)
(1) The Council shall be comprised of nine commissioners, including one chairperson and one deputy chairperson.

Article 4 (Term of Office)
(1) The term of commissioners of the Council shall be two years, and the term may be extended one time only: Provided, That the term of the ex officio commissioners of the Council, the Inspector General and commissioners of the City Council, shall be the period during which he/she holds his/her official position.

Article 5 (Responsibilities of Chairperson, Etc.)
(1) The chairperson shall represent the Council and exercise overall control over the affairs of the Council.

Article 6 (Steering of Meetings)
(1) Meetings of the Council shall be classified as either general or extraordinary meetings; general meetings shall be held once monthly in principle, and extraordinary meetings shall be held whenever deemed necessary by the chairperson: Provided, That a meeting may be replaced by deliberating documents in case of a minor matter or deemed necessary by the chairperson.

Article 7 (Reporting Results of Deliberation and Consultation)
The Council shall report to the City Council and Mayor the results of its deliberation or consultation, etc. on the matters under each subparagraph of Article 2 (1).

Article 8 (Dismissal of Commissioners)
Where a commissioner is unable to perform any of his/her duties as a commissioner due to his/her voluntary resignation, disease, long-term absence, or loss of dignity, etc., the Mayor may dismiss the commissioner.

Article 9 (Secretary)
In order to handle the affairs regarding operation of the Council, the Council shall appoint a secretary, who shall be the officer in charge of the General Audit Division (Director).

Article 10 (Preparation of Meeting Minutes)
Where the Council holds its meeting, the secretary shall prepare and manage the minutes of the meeting.

Article 11 (Payment of Allowances, Etc.)
For the commissioners who have attended the Council, their expenses incurred may be reimbursed to them within budgetary limits of the Council in accordance with the Seoul Metropolitan Government Ordinance On Payment of Allowance and Travel Expenses of Committee Members.

Article 12 (Abstention of Commissioners)
A commissioner of the Council having conflict of interests with the deliberation/consultation concerned shall abstain from the deliberation/consultation concerned.

Article 13 (Confidentiality)
No person who attends a meeting of the Council shall disclose any confidential information which has come to his/her knowledge in the course of performing his/her duties.

Article 14 (Detailed Rules of Operation)
Matters, other than those provided for in this Ordinance, necessary for operation of the Council shall be determined by the chairperson of the Council after resolution of the Council.
