SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON TRAFFIC SAFETY OF CHILDREN’S COMMUTING ROUTES
Amendment of Other Laws No. 6386, Jan. 05, 2017 Partial Amendment No. 6976, Jan. 03, 2019

Article 1 (Purpose) The purpose of this Ordinance is to promote the traffic safety on children's commuting routes by prescribing the matters necessary for protecting children from the risk of traffic accidents in the children protection zone and on the commuting routes designated pursuant to Article 12 of the Road Traffic Act.

Article 1 (Purpose) The purpose of this Ordinance is to promote the traffic safety on children's commuting routes by prescribing the matters necessary for protecting children from the risk of traffic accidents in protection areas for children designated pursuant to Article 12 of the Road Traffic Act and on the commuting routes.

Article 2 (Definition) The terms used in this Ordinance shall be defined as follows:
1. The term"children protection zone" means the area designated to protect children (referring to the persons younger than 13 years; hereinafter the same shall apply) from the risk of traffic accidents pursuant to Article 12 of the Road Traffic Act (hereinafter referred to as "Act");
2. The term "elementary school, etc." means the kindergarten prescribed in subparagraph 2 of Article 2 of the Early Childhood Education Act and the elementary school and special school under Articles 38 and 55 of the Elementary and Secondary Education Act;
3. The term "Infant care facility" means the child care center (limited to the child care facilities under Article 14 of the Enforcement Rule of the Act) as prescribed in Article 10 of the Infant Care Act;
4. The term "private teaching institute" means the private teaching institute (limited to the private teaching institute under Article 14 of the Enforcement Rule of the Act) as prescribed in Article 2 of the Act on the Establishment and Operation of Private Teaching Institutes and Extracurricular Lessons;
5. The term "educational facility" means the elementary school, etc., the infant care facility and the private teaching institute as prescribed in subparagraphs 2, 3 and 4;
6. The term "commuting routes" means, among the major routes used by the children who are attending the educational facility while they commute from home to the educational facility, the children protection zone under Article 12 of the Road Traffic Act and other routes which the Mayor of the Seoul Metropolitan Government deems necessary for the safety of children's walking environment.

Article 2 (Definitions) The terms used in this Ordinance shall be defined as follows: <Amended by Ordinance No. 6976, Jan. 3, 2019>
1. The term "protection area for children" means an area designated to protect children (referring to persons younger than 13 years; hereinafter the same shall apply) from the risk of traffic accidents pursuant to Article 12 of the Road Traffic Act (hereinafter referred to as the "Act");
2. The term "elementary school, etc." means a kindergarten prescribed in subparagraph 2 of Article 2 of the Early Childhood Education Act and an elementary school and a special school under Articles 38 and 55 of the Elementary and Secondary Education Act;
3. The term "child care facility" means a child care center (limited to child care facilities under Article 14 of the Enforcement Rule of the Act) as prescribed in Article 10 of the Child Care Act;
4. The term "private teaching institute" means a private teaching institute (limited to a private teaching institute under Article 14 of the Enforcement Rule of the Act) as prescribed in Article 2 of the Act on the Establishment and Operation of Private Teaching Institutes and Extracurricular Lessons;
5. The term "educational facility" means an elementary school, etc., a child care facility, and a private teaching institute as prescribed in subparagraphs 2, 3 and 4;
6. The term "commuting routes" means, among the major routes used by children who are attending an educational facility while they commute from home to the educational facility, protection areas for children under Article 12 of the Road Traffic Act and other routes which the Mayor of the Seoul Metropolitan Government deems necessary for the safety of children's walking environment;
7. The term "pedestrian voice guidance system" means a device installed in a crosswalk waiting area to discourage pedestrians from crossing at other than a crosswalk and to provide voice services to help them cross the road at a green pedestrian light, thereby preventing pedestrian traffic accidents.

Article 3 (Responsibilities) (1) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as "Mayor") shall devise the policies necessary for the establishment and improvement of various facilities for children's traffic safety and for the preventive measures against children's traffic accident.
(2) Every citizen shall actively participate in and cooperate with the projects and policies for children's traffic safety.

Article 3 (Responsibilities) (1) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") shall devise the policies necessary for the establishment and improvement of various facilities for children's traffic safety and for the preventive measures against children's traffic accidents.
(2) Every citizen shall actively participate in and cooperate with the projects and policies for children's traffic safety.

Article 4 (Establishment of Master Plan, Etc.) (1) The mayor shall establish a master plan, every five years, necessary for securing children's traffic safety while they commute to and from schools and annually prepare the master plan's implementation plan.
(2) The master plan under paragraph (1) shall include the matters under each of the following subparagraphs:
1. The goal and direction of improvement of the children protection zone and children's commuting routes;
2. Current status of the children protection zone and children's commuting routes;
3. Matters concerning establishment and management of the traffic safety facilities within the children protection zone and children's commuting routes;
4. Matters concerning establishment and management of the objects annexed to the routes within the children protection zone and children's commuting routes;
5. Matters concerning improvement and financial support of the children protection zone and children's commuting routes;
6. Matters concerning restriction of the vehicles accessing to the children protection zone;
7. Matters concerning discontinuation or relocation of the street parking lot established within the children protection zone;
8. Other matters concerning the walking environment and preventive measures against children's traffic accident within the children protection zone and children's commuting routes.
(3) Where necessary for establishment of the master plan and implementation of the concerned project in accordance with paragraphs (1) and (2), the Mayor shall consult, approve and take other measures with respect to the superintendent of education of the Seoul Metropolitan Government and other relevant institutions.

Article 4 (Establishment of Master Plan) (1) The Mayor shall establish a master plan, every five years, necessary for securing children's traffic safety while they commute to and from schools and prepare an annual implementation plan.
(2) The master plan under paragraph (1) shall include the following matters:
1. The goal and direction of improvement of protection areas for children and children's commuting routes;
2. Current status of protection areas for children and children's commuting routes;
3. Matters concerning the establishment and management of traffic safety facilities within protection areas for children and children's commuting routes;
4. Matters concerning the establishment and management of road appurtenances within protection areas for children and children's commuting routes;
5. Matters concerning the improvement of and financial support for protection areas for children and children's commuting routes;
6. Matters concerning the restriction on vehicles’ access to protection areas for children;
7. Matters concerning plans for discontinuation or relocation of an on-street parking lot established within protection areas for children;
8. Other matters concerning the walking environment and preventive measures against children's traffic accidents within protection areas for children and children's commuting routes.
(3) Where necessary for establishment of the master plan and implementation of the concerned project under paragraphs (1) and (2), the Mayor shall take measures, such as consultation with and approval from the superintendent of education of the Seoul Metropolitan Government and other relevant institutions.

Article 5 (Investigation of Actual Condition) The Mayor shall annually investigate actual conditions of the traffic safety facilities and the objects annexed to the routes within the children protection zone and children's commuting routes and the matters necessary for improvement thereof, have the results of the aforementioned investigation reflected in the master and implementation plans under Article 4 (1) and may request the head of Gu to provide any data concerning the aforementioned matters.

Article 5 (Fact-Finding Surveys) The Mayor may annually conduct a fact-finding survey on traffic safety facilities and road appurtenances within protection areas for children and children's commuting routes and the matters necessary for improvement thereof, have the results of the fact-finding survey reflected in the master and implementation plans under Article 4 (1), and request the head of a Gu to provide the relevant data, if necessary.

Article 6 (Designation, Etc. of Children's Commuting Routes) (1) Where deemed necessary to protect children from the risks of traffic accident, the Mayor may designate part of the children protection zone and the streets nearby the educational facility as a children's commuting route, after thoroughly examining the traffic circumstances and effectiveness, etc of the children commuting route.
(2) For the safety of the children commuting routes, the Mayor may implement the matters under each of the following subparagraphs: <Amend by Ordinance No. 5820, Jan. 2, 2015; Ordinance No. 6386, Jan. 5, 2017>
1. Establishment and management of the traffic safety facilities under Articles 3 and 4 of the Act;
2. Establishment and management of the objects annexed to routes under Article 2 of the Road Act;
3. Deployment of the personnel such as a traffic safety instructor;
4. Other projects deemed by the Mayor necessary to improve the children's commuting routes.

Article 6 (Designation of Children's Commuting Routes) (1) Where deemed necessary to protect children from the risks of traffic accidents, the Mayor may designate part of protection areas for children and roads around educational facilities as a children's commuting route, after thoroughly examining the traffic circumstances, effectiveness, etc of the relevant area.
(2) For the safety of children commuting routes, the Mayor may implement the following matters: <Amended by Ordinance No. 5820, Jan. 2, 2015; Ordinance No. 6386, Jan. 5, 2017>
1. Establishment and management of traffic safety facilities under Articles 3 and 4 of the Act;
2. Establishment and management of road appurtenances under Article 2 of the Road Act;
3. Deployment of personnel, such as a traffic safety instructor;
4. Other projects to improve children's commuting routes that the Mayor deems necessary.

Article 7 (Controling Vehicles in the Children Protection Zone) To ensure that the practice of controlling vehicles in the children protection zone, for each section and time slot, takes root as soon as possible in accordance with Article 9 of the Rules concerning Designation and Management of the Protective Zone for Children, the Elderly and the Disabled, the Mayor may provide administrative and financial support, through proactive consultation with the Commissioner of the Seoul Metropolitan Police Agency.

Article 7 (Controling Vehicles in Protection Areas for Children) To ensure that the practice of controlling vehicles in protection areas for children by each section and time of day takes root as soon as possible in accordance with Article 9 of the Rules concerning Designation and Management of the Protective Zone for Children, the Elderly and the Disabled, the Mayor may provide administrative and financial support through proactive consultation with the Commissioner of the Seoul Metropolitan Police Agency.

Article 7-2 (No Stopping and Parking in the Children Protection Zone) (1) All drivers shall not stop or park within 10 meters from a crosswalk in a children protection zone.
(2) The Mayor may take any of the following measures to guide and control stopping or parking pursuant to paragraph (1):
1. Installation and management of a signal or safety sign for no stopping and parking;
2. Installation and management of unmanned control systems, such as surveillance cameras.

Article 7-2 (Prohibition of Stopping and Parking in Protection Areas for Children) (1) All drivers shall not stop or park within 10 meters from a crosswalk in a protection area for children.
(2) The Mayor may take the following measures to guide and control stopping or parking under paragraph (1):
1. Installation and management of a signal or safety sign to prohibit stopping and parking;
2. Installation and management of unmanned control systems, such as surveillance cameras.

Article 7-3 (Installation and Subsidization of Pedestrian Voice Guidance System) (1) The Mayor may install pedestrian voice guidance systems in protection areas for children prone to traffic safety accidents, places near educational facilities, or roads where children are likely to cross at other than a crosswalk.
(2) The Mayor may fully or partially subsidize the necessary expenses where the head of a Gu intends to install pedestrian voice guidance systems under paragraph (1).

Article 8 (Safety Education for Children) (1) Where it is necessary for the children in educational facilities, the Mayor may conduct a traffic safety education for them.
(2) The traffic safety education for children pursuant to paragraph (1) shall be conducted in the methods set forth in each of the following subparagraphs:
1. Self-education by an educational facility through producing and distributing a traffic safety program for children;
2. Other traffic-safety educational programs such as an education entrusted to an educational institute specialized in traffic safety.

Article 8 (Safety Education for Children) (1) Where it is necessary for children in educational facilities, the Mayor may conduct a traffic safety education for them.
(2) The traffic safety education for children pursuant to paragraph (1) shall be conducted as follows:
1. Self-education by an educational facility through producing and distributing a traffic safety program for children;
2. Other traffic-safety educational programs entrusted to an educational institute specialized in traffic safety.

Article 9 (Traffic Safety Instructor, etc.) (1) The Mayor may recruit and operate a traffic safety instructor whose role is to protect children from various risks that may occur while the children vulnerable to traffic safety accidents are commuting to and from schools.
(2) Where it is necessary for the traffic safety while children are commuting to and from schools, the Mayor may recommend the head of the educational facilities to operate a traffic-safety guidance group which is mobilized from among teachers, students' parents or traffic service groups, etc.

Article 9 (Traffic Safety Instructor) (1) The Mayor may recruit and operate a traffic safety instructor whose role is to protect children from various risks that may occur while children vulnerable to traffic safety accidents are commuting to and from schools.
(2) Where it is necessary for traffic safety while children are commuting to and from schools, the Mayor may recommend the heads of educational facilities to operate a traffic-safety guidance group which is mobilized from among teachers, students' parents, traffic service groups, etc.

Article 10 (Financial Support) Concerning the matters provided for in this Ordinance, the Mayor may financially support the concerned autonomous administrative body, etc. within the budget.

Article 11 (Delegation of Authority) The Mayor may carry out part of the affairs pursuant to the provisions in this Ordinance through entrusting it to the head of Gu.
