Article 1 (Purpose) The purpose of this Ordinance is to prescribe matters necessary for facilitating house repair to improve the living environment of low-rise residential areas in Seoul Metropolitan City and matters for supporting the fostering of relevant house repair companies. <Amended by Ordinance No. 7090, Mar. 28, 2019>

Article 2 (Definitions) The terms used in this Ordinance shall be defined as follows: <Amended by Ordinance No. 7090, Mar. 28, 2019>
1. The term "low-rise house" means a detached house or multi-family housing specified in attached Table 1 of the Enforcement Decree of the Building Act (excluding apartment houses and dormitories);
2. The term "low-rise residential area" means an area where several low-rise houses stand close together;
3. The term "house repair" means all the activities for improving the performance or functions of all or part of a worn-out house;
4. The term "house repair company" means a company that conducts business relating to house repair (limited to registered businesses);
5. The term "managing entity" means the owner of a low-rise house in a low-rise residential area or a person delegated with the management thereof, who wishes the house to undergo inspection or repairs under this Ordinance;
6. The term "zone for supporting the improvement of house performance" means a zone designated pursuant to Article 6 for the facilitation of house repair.

Article 3 (Responsibilities) (1) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") shall continuously provide administrative and financial support, etc. in order to create a pleasant living environment for residents of low-rise residential areas.
(2) The Mayor shall endeavor to secure budgets necessary for projects to subsidize house repair in low-rise residential areas.
(3) Any resident of a low-rise house shall have the right to easily repair his or her house, and shall provide the Mayor with information on the house in which he or she resides for the efficient maintenance and management thereof.

Article 4 (Formulation of Master Plan to Support House Repair) (1) In order to improve the living environment of low-rise residential areas, the Mayor shall formulate a master plan to support house repair (hereinafter referred to as "master plan") of the Seoul Metropolitan Government (hereinafter referred to as the "Seoul Government") on a five-yearly basis. <Amended by Ordinance No. 7090, Mar. 28, 2019>
(2) Each master plan shall include the following:
1. Basic objectives and direction-setting for implementing policies to support house repair;
2. The current situation and improvement of an administrative system to support house repair;
3. Job creation and revitalization of employment in the house repair sector;
4. Establishment and operation of a system for comprehensive information on house repair;
5. Subsidization for house repair construction;
6. Introduction and operation of a low-rise housing traceability system;
7. Establishment and operation of a house repair support center;
8. Support for exemplary house repair companies (including post inspection of, and penalties for, registered companies);
9. Funding for projects to support house repair;
10. Other matters on support for the residential stability, and improvement of the living environment, of residents of low-rise residential areas.
(3) Where a master construction plan of the Seoul Government containing the matters specified in each subparagraph of paragraph (2) is formulated, a master plan under paragraph (1) shall be deemed formulated.
(4) When formulating a master plan, the Mayor shall proactively gather consensus from residents of low-rise residential areas.

Article 5 (Inspection of Low-Rise Houses) (1) A managing entity may conduct regular inspections biennially from the date 20 years have elapsed since the date approval for use of the relevant building was granted.
(2) A managing entity may request the Mayor for the inspection under paragraph (1), and in such cases, the Mayor shall proactively conduct the inspection.
(3) Matters to be inspected under paragraph (1) shall be as follows:
1. Matters on improvement of house performance, such as waterproofing, condensation, and replacement of boilers;
2. Matters on energy saving, such as insulation, windows, and doors;
3. Matters on structural safety, such as cracks and structural reinforcement;
4. Other matters to improve the living environment of low-rise houses.

Article 6 (Designation of Zones for Supporting Improvement of House Performance) (1) The Mayor may designate as a zone for supporting the improvement of house performance any of the following areas in which low-rise houses for which at least 20 years have passed after approval for use is granted account for at least 60%, following deliberation by a local urban regeneration committee under Article 8 of the Special Act on Promotion of and Support for Urban Regeneration:
1. A zone in which it is expected to conduct a management-type project to improve the living environment;
2. An improvement zone cancelled pursuant to Article 20 or 21 of the Act on the Improvement of Urban Areas and Residential Environments;
3. Scenic districts and height restriction districts under the National Land Planning and Utilization Act;
4. A zone deemed necessary to be designated as a zone for supporting the improvement of house performance by the Mayor for facilitating house repair, such as alley revitalization areas;
5. A zone for which the head of an autonomous Gu deems that it is necessary to be designated as a zone for supporting the improvement of house performance and requests such designation.
(2) Notwithstanding paragraph (1), any of the following areas or zones shall be deemed designated as a zone for supporting the improvement of house performance, without deliberation by a local urban regeneration committee:
1. Urban regeneration revitalization areas publicly notified under Article 20 of the Special Act on Promotion of and Support for Urban Regeneration and Article 28 of the Enforcement Decree of the same Act;
2. Zones designated and publicly notified pursuant to Article 16 of the Act on the Improvement of Urban Areas and Residential Environments, as zones where residential environment improvement projects are to be implemented according to the method under Article 23 (1) 1 of the same Act (hereinafter referred to as “management-type project to improve the living environment”).

Article 7 (Projects to Support House Repair) The Mayor may provide administrative support as well as financial support for any of the following projects to support house repair, in a zone for supporting the improvement of house performance: Provided, That financial support in areas other than the zones for supporting the improvement of house performance shall be limited to loans: <Amended by Ordinance No. 7090, Mar. 28, 2019>
1. Establishment and operation of a system for comprehensive information on house repair;
2. Subsidization for house repair construction;
3. Introduction and operation of a low-rise housing traceability system;
4. Establishment and operation of a house repair support center;
5. Other projects necessary for improving the living environment of residents of low-rise residential areas.

Article 8 (Establishment and Operation of System for Comprehensive Information on House Repair) By establishing a system for comprehensive information on house repair, the Mayor may provide a variety of information to residents of low-rise residential areas or house repair companies.

Article 9 (Proportion of Subsidy for Construction) (1) Where the Mayor subsidizes house repair construction pursuant to Article 7, he or she may subsidize, in whole or in part, such construction; and where the Mayor subsidizes loans, he or she may grant the loans within 80 percent of the construction expenses.
(2) The Mayor may subsidize construction by determining the detailed criteria within the scope of subsidization set under paragraph (1).

Article 10 (Introduction of Low-Rise Housing Traceability System) To efficiently improve house performance and reduce expenses incurred in maintaining and managing houses, the Mayor may introduce and support a housing traceability system that encompasses new construction of houses; the time, scope, details, and expenses of house repairs; information on construction companies; changes in legal relationship, etc.

Article 11 (Establishment and Operation of House Repair Support Centers) The Mayor may establish a house repair support center to provide integrated administrative services, etc. regarding house repair for the residents of low-rise residential areas.

Article 12 (Support for Exemplary House Repair Companies) (1) The Mayor and the heads of Gus may select and support exemplary house repair companies to improve the living environment of low-rise residential areas by fostering house repair companies.
(2) A house repair company may file an application for registration with the Mayor through the system, etc. for comprehensive information on house repair referred to in Article 7; and the Mayor may select exemplary companies based on post evaluation, etc. of registered companies after construction.
(3) To revitalize the regional economy, the Mayor may accord priority to exemplary house repair companies adjacent to an area eligible for support projects, in providing administrative and financial support, such as issuing certificates; publicity through the comprehensive information system; loans for construction expenses; provision of subsidies, etc.
(4) Registration of and support for exemplary house repair companies and other necessary matters shall be prescribed by rule of the Seoul Government.

Article 13 (Financial Resources) Financial resources necessary for implementing projects to support house repair in low-rise residential areas may be covered from using any of the following special accounts, etc., in addition to a general account:
1. A special account for housing projects of the Seoul Government;
2. Other loans, subsidies, etc.

Article 14 (Relationship to Other Statutes or Regulations) Except as otherwise provided in other statutes, regulations, or Ordinances of the Seoul Government concerning the implementation of projects to support house repair, this Ordinance shall govern.
