SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE PROTECTION OF WORKING YOUTHS AND THE SUPPORT FOR THE SELECTION OF EXEMPLARY ENTERPRISES IN THE YOUTH EMPLOYMENT

SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE PROTECTION OF WORKING YOUTHS AND THE SUPPORT FOR THE SELECTION OF EXEMPLARY ENTERPRISES IN THE YOUTH EMPLOYMENT

Article 1 (Purpose) The purpose of this Ordinance is to encourage the guarantee of human rights of working youths by protecting their rights and interests and accrediting exemplary enterprises in their employment of youths observing the labor standards in the jurisdiction of Seoul Metropolitan Government.

Article 2 (Basic Principles) (1) Working youths shall receive special protection guaranteed by the Constitution and Acts and subordinate statutes.
(2) Working youths shall have the right to receive fair treatment and proper wages, and protection from industrial accidents.
(3) No employer shall dismiss any working youth without rational procedures prescribed in the Labor Standards Act and other relevant Acts and subordinate statutes.

Article 3 (Definitions) The terms used in this Ordinance shall be defined as follows:
1. The term "youth" means a person who is under the age of 19 years;
2. The term "employer" means a business proprietor, a person in charge of the management of a business who employs any youth, or any other person who acts for a business proprietor, in Seoul Metropolitan City (hereinafter referred to as the "City");
3. The term "working youth" means a youth who provides labor for business or to a place of business for the purpose of receiving wages irrespective of the kinds of jobs.

Article 4 (Scope of Application) This Ordinance shall apply to the following youths:
1. A youth who has his/her address or residence in the City;
2. A youth who works at a place of business located in the City.

Article 5 (Mayor's Responsibility) (1) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") shall be responsible to strive to enable youths to work in a proper working environment.
(2) The Mayor shall recommend to provide working youths with the best working conditions which do not hinder their studies or physical growth, taking into account the fact that they are minors, students, etc.

Article 6 (Request for Cooperation and Advice) (1) If necessary to guarantee the working conditions, etc. of working youths, the Mayor may request cooperation from the central government, public institutions, etc.
(2) The Mayor may seek advices on the improvement, etc. of working conditions for youths from the Seoul National Employment and Labor Office, the Seoul Metropolitan Office of Education, youth-related institutions, enterprises employing youths and civil organizations.

Article 7 (Employers' Responsibility) (1) Each employer shall treat working youths respectfully, and shall not exercise physical, mental or verbal violence.
(2) Each employer shall faithfully observe labor-related Acts and subordinate statutes, etc., including the Labor Standards Act.

Article 8 (Committee for Recommendation of Exemplary Enterprises in Employment of Working Youths) (1) In order to select and reward exemplary enterprises in the employment of working youths in his/her jurisdictional area, the Mayor may establish the Committee for Recommendation of Exemplary Enterprises in Employment of Working Youths (hereinafter referred to as the "Committee").
(2) The Committee shall be comprised of not more than ten members recommended by the Seoul National Employment and Labor Office, the Seoul Metropolitan Office of Education, the Korea Certified Public Labor Attorneys Association, the Seoul Labor Center, youth organizations, etc.

Article 9 (Analysis, etc. of Cases of Suffering of Working Youths from Employment) The Mayor may analyze and research cases of suffering of working youths related to their employment every two years, and take into consideration the outcomes thereof in the selection of exemplary enterprises in the employment of working youths, youth policies, and policies for the prevention of suffering of working youths.

Article 10 (Selection of and Granting Rewards to Exemplary Enterprises) (1) The Mayor may select and grant an official commendation to enterprises recommended by the Committee on the basis of the data inspected by the Seoul National Employment and Labor Office, fact-finding surveys on the employment of youths, etc.
(2) Detailed matters concerning official commendation shall be governed by the Seoul Metropolitan Government Ordinance on Official Commendation.

Article 11 (Support in Counseling and Receipt of Reports on Suffering) The Mayor may provide necessary administrative support to any youth who files an application for counseling on the violation of any labor-related Acts and subordinate statutes, including the Labor Standards Act, or a report on his/her suffering with a related agency, such as the Seoul National Employment Labor Office.

Article 12 (Enforcement Rule) Matters necessary for the enforcement of this Ordinance may be prescribed by Rule of the Seoul Metropolitan Government.
