Seoul Metropolitan Government Ordinance on the Development and Support of Children's Group Homes
Amendment of Other Laws No. 6016, Oct. 08, 2015 Amendment of Other Laws No. 7423, Dec. 31, 2019

Article 1 (Purpose) The purpose of this Ordinance is to support the promotion of the children’s group home project that provides a home-like residential environment and protection to children in need of protection pursuant to Articles 4, 50, and 52 of the Child Welfare Act, thereby helping them grow into sound members of society, and to stipulate matters necessary for the establishment and operation of the child group living home support center. &#lt;Amended on Oct. 8, 2015&#gt;

Article 2 (Definitions) 1. "Children’s group home (hereinafter referred to as “group home”)" refers to an alternative home that provides a home-like residential environment and protection to children in need of protection, and where seven (7) or fewer children and their guardians live together.
2. Other terms shall be governed by Article 3 of the Child Welfare Act (hereinafter referred to as the “Act”).

Article 3 (Responsibilities of the Mayor)

Chapter 2. Support for the Children’s Group Home Project Article 4 (Project Operation Entity) A person who has the appropriate qualifications to conduct group home business, such as a social welfare corporation, a non-profit corporation under the Social Welfare Services Act, an organization, or an individual, may conduct group home business by filing a report pursuant to Article 50 of the Act and Article 23 of the Enforcement Rules of the same Act. &#lt;Amended on Oct. 8, 2015&#gt;

Article 5 (Functions of Group Homes) 1. Protection and psychological and emotional treatment support for children admitted to relevant institutions
2. Appropriate educational support for children admitted to relevant institutions
3. Support for independence by improving the social adaptation ability of children admitted to relevant institutions
4. Programs and support for returning children to their original families
5. Other projects deemed necessary for children admitted to relevant institutions

Article 6 (Eligible Persons for Admission) 1. Children who are not receiving parental care due to the death of parents, running away from home, divorce, separation, imprisonment, economic poverty, etc.
2. Children in need of protection due to physical, emotional, or sexual violence or cruelty by their parents, or due to abandonment or neglect
3. Children recognized by the Mayor as benefitting more from living in a group home

Article 7 (Cost Support) 1. In principle, the housing for group home installation shall be secured by the operating entity, but the Mayor may allow group home operators (including privately operated facilities) to secure rental housing or lease funds support projects
2. In cases of an unsupported facility with four (4) or more children under protection, personnel expenses and management, and operating expenses
3. The salary recognition and treatment stipends of group home workers, etc. shall be applied mutatis mutandis as the standards for childcare facilities

Article 8 (Setting Up and Function of a Group Home Support Center) Chapter 3. Group Home Support Center

(1) The Mayor shall establish and operate a Group Home Support Center (hereinafter referred to as the “Center”) to continuously support group home business and cooperation and linkage activities between group homes.
(2) The Center shall perform the following functions. <Amended on Dec. 31, 2019>
1. Support services for individual group homes and children
2. Support work for admission, discharge, counseling, investigation, and follow-up management for children in group homes
3. Education and support services for group home workers
4. Establishment of an information base and linkage system for effective group home projects
5. Research and publication of materials related to group home projects
6. Development and management of programs for group home projects
7. Education and campaigns for group home projects
8. Support work for setting up a new group home
9. Other work deemed necessary by the Mayor for related group home business

Article 9 (Organization and Composition) (1) The Center shall have a Center Director who oversees the operations of the Center and employees necessary to carry out group home support projects.
(2) The qualifications of the Center Director and employees under Paragraph 1 shall be those who are social workers with experience in the field of social welfare, and other requirements for the establishment, operation, and designation of the Center shall be determined by the Mayor by regulations. <Amended on Dec. 31, 2019>

Article 10 (Operating Committee) (1) The Center may form and operate an Operating Committee when necessary to carry out group home support projects, such as the establishment of networks with related organizations and the promotion of information exchange. <Amended on Oct. 8, 2015>
(2) The Committee shall be composed of no more than nine (9) members including the Chairperson. The Chairperson shall be the Center Director, and Committee members shall be appointed by the Chairperson from among the ex officio public officials and those with extensive knowledge and experience related to group home business. <Amended on Oct. 8, 2015>
(3) Other matters necessary for the composition and operation of the Committee shall be determined by the Chairperson with the approval of the Mayor.

Article 11 (Entrustment of Operations) (1) When the Mayor deems it necessary for the efficient operation of the Center, they may entrust the center to a non-profit corporation pursuant to Article 32 of the Civil Act among professional organizations that have performed children's group home-related business for more than three (3) years.
(2) In cases where the operation of the Center is entrusted pursuant to Paragraph 1, the trustee shall appoint a Center Director with the approval of the Mayor, and other employees shall be reported to the Mayor after being appointed by the Center Director.
(3) Other provisions related to civil outsourcing shall be governed by the Seoul Metropolitan Government Ordinance on the Administrative Work to the Private Sector. <Amended on Dec. 31, 2019>

Article 12 (Support for the Center) The Mayor may provide administrative support necessary for the organization and activities of the Center, and may support part or all of the expenses and project costs required for the establishment and operation of the Center within the scope of the budget.

Article 13 (Reporting and Investigation)

Article 14 (Enforcement Rule) Detailed matters necessary for the enforcement of this Ordinance shall be separately determined as regulations.

Addendum (Seoul Metropolitan Government Ordinances and Rules on Comprehensive Reorganization of Japanese Expressions in Autonomous Laws) <No. 7423, Dec. 31, 2019>
This Ordinance shall enter into force on the date of its promulgation.
