SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE MANAGEMENT AND OPERATION OF THE DONGDAEMUN DESIGN PLAZA (DDP) AND THE DONGDAEMUN HISTORY & CULTURE PARK

CHAPTER I GENERAL PROVISIONS Article 1 (Purpose) The purpose of this Ordinance is to prescribe the matters necessary for the management and operation of Dongdaemun Design Plaza (DDP) and the Dongdaemun History & Culture Park in Seoul Metropolitan City, thereby contributing to the promotion of the design and fashion industry and the appreciation of design culture.

Article 2 (Definition of Terms) The definitions of the terms used in this Ordinance shall be as follows:
1. "Facility" refers to the Dongdaemun Design Plaza (DDP), the park, annexed buildings, etc. in Dongdaemun Design Plaza (DDP), and to the Dongdaemun History & Culture Park in Seoul Metropolitan City (hereinafter referred to as “DDP”), classified as shown in Annex 1.
2. "Rental" refers to the renting of facilities in Annex 2 for use in events, performances, exhibits, etc. (hereinafter referred to as “events”), classified as follows:
(a) Periodic rental: Rental executed within a period as separately determined by the Seoul Metropolitan City Mayor (hereinafter referred to as the “Mayor”) to confirm the event schedules for the next year and within a five-year period.
(b) Occasional rental: Rental executed after periodic rental designations when there are time slots remaining, or when the Mayor deems it necessary.
3. "Renter" refers to a person or entity that has received permission to use a facility under subparagraph 2.

Article 3 (Responsibilities of the Mayor) (1) The Mayor shall manage and operate the DDP consistently in accordance with the purposes for which they were established.
(2) The Mayor, in operating the facility, shall open it to the public for citizens’ use to the extent it does not interfere with events, etc., and shall make efforts to provide users with fair opportunities to use the facilities.


CHAPTER II FACILITY USAGE Article 4 (Principles of Facility Usage) The use of THE DDP shall in principle be free of charge: Provided, however, that if the Mayor or a renter holds an event, admission fees, etc. may be charged.

Article 5 (Waiver of Admission Fees) The Mayor may waive admission fees for any of the following persons:
1. State guests, diplomatic delegation, and their accompanying personnel;
2. Persons aged seven years or younger, and persons aged 65 years or older;
3. Persons with disabilities as provided under the Act on the Welfare of Persons with Disabilities, and one accompanying guardian each;
4. Persons falling under any subparagraph of Article 86 (1) of the Enforcement Decree of the Act on the Honorable Treatment of and Support for Persons of Distinguished Service to the State;
5. Persons falling under any subparagraph of Article 17-2 (1) of the Enforcement Decree on the Act on Honorable Treatment of and Support for Persons Who Died or Were Injured for the Public Good;
6. Persons falling under Article 15 of the Enforcement Decree of the Act on Honorable Treatment of Persons of Distinguished Service to Independence;
7. Persons falling under any item of subparagraph 2 of Article 2 of the Act on Honorable Treatment of War Veterans and Establishment of Related Associations;
8. Persons falling under any subparagraph of Article 8-3 of the Act on Assistance to Patients Suffering from Actual or Potential After Effects of Defoliants and Establishment of Related Organizations;
9. Persons falling under any subparagraph of Article 52 (1) of the Enforcement Decree of the Act on the Honorable Treatment of Persons of Distinguished Service to the May 18 Democratization Movement and Establishment of Related Organizations;
10. Persons falling under Article 58 of the Enforcement Decree of the Act on Honorable Treatment of Persons of Distinguished Service During Special Missions and Establishment of Related Organizations;
11. Registered ex-prisoners of war under subparagraph 5 of Article 2 of the Act on the Repatriation, Treatment of the Prisoners of War of the Republic of Korea’s Armed Forces, and family members of prisoners of war from places of detention under subparagraph 3 of that Article;
12. Persons falling under subparagraph 2 of Article 2 of the National Basic Living Security Act;
13. Persons falling under Article 3 of the North Korean Defectors Protection and Settlement Support Act;
14. Persons falling under Article 5 of the Single-Parent Family Support Act;
15. Multicultural families falling under subparagraph 1 of Article 2 of the Multicultural Families Support Act;
16. Holders of the Dadungi Happiness Card (including family members entered on the card) under Article 2 of the Seoul Metropolitan City Ordinance on Support for Childbirth and Childrearing;
17. Persons seeking access for the purpose of academic research;
18. Persons seeking access to perform public official duties;
19. Persons awarded the “Seoul Metropolitan City Honorary Citizen” certificate;
20. Holders of the “Prestigious Military Service Family” certificate subject to the honorable treatment of prestigious military service families under Article 2 of the Seoul Metropolitan Government Ordinance on Honorable Treatment for Prestigious Military Service Families;
21. Other persons deemed especially necessary by the Mayor for the operation of the DDP.

Article 6 (Parking Fees) (1) The Mayor may charge and collect parking fees from visitors who use the parking lots attached to the DDP.
(2) The standards for charging parking fees under paragraph (1) shall be determined by the relevant rules: Provided, however, that matters not determined in this Ordinance shall be governed by the Seoul Metropolitan Government Ordinance on the Installation and Management of Parking Lots.

Article 7 (Usage Restrictions) (1) Visitors to the DDP shall refrain from the following acts: Provided, however, that the act under subparagraph 1 may be permitted as determined by the Mayor:
1. Consuming food or alcohol;
2. Touching or handling any exhibit without permission;
3. Acts that cause a nuisance to other visitors, such as loud speech, disorderly behavior, or smoking;
4. Acts that threaten the safety of visitors.
(2) The Mayor may demand that a person engaging in any of the acts specified in the subparagraphs of the foregoing paragraph (1) to leave the premises.


CHAPTER III RENTAL APPLICATION AND PERMISSION Article 8 (Rental Application) (1) A person (hereinafter referred to as an “applicant”) seeking to rent a DDP facility shall submit to the Mayor a rental application form to the Mayor as prescribed by the relevant rules.
(2) In the case of periodic rentals, the applicant shall submit the application within the application period determined by the Mayor; in the case of occasional rentals, the application may be submitted at any time when the rental schedule has available dates

Article 9 (Rental Restrictions) The Mayor may restrict a rental in cases where an application for rental is deemed to be unsuitable to the operational purpose of the DDP for the following reasons:
1. Where the event is judged or found to pose a risk of damaging a DDP facility, or to be incompatible with the maintenance and management of the facility;
2. Where the event is to be held by a religious group, or for a religious purpose;
3. Where the event is to be held by a political group, or for a political purpose;
4. Where the event is a social gathering, or is otherwise deemed inappropriate by the Mayor.

Article 10 (Rental Permits) (1) To that the extent a rental does not interfere with the operation of the DDP, the Mayor may permit it after the deliberation of the Seoul Metropolitan City DDP Rental Deliberation Committee (hereinafter referred to as the “Committee”).
(2) For periodic rentals, the Committee shall notify the applicant of whether the rental is permitted within 15 days from the end of the application period, and for occasional rentals, within seven days after the Committee’s deliberation.
(3) Notwithstanding the foregoing paragraph (1), if only a single application is filed, permission may be granted without the Committee’s deliberation.

Article 11 (Cancellation of Rental Permit) After permitting a rental, the Mayor may cancel the permit or compel the renter to cease usage of the facility in any of the following circumstances:
1. When the renter applies for the cancellation of rental permit;
2. When the rental fee is not paid by the deadline determined by the Mayor;
3. When the renter is found to have violated the purpose of the permit;
4. When the Mayor otherwise deems it necessary to limit usage of the facility in connection with visitor safety or facility maintenance.

Article 12 (Renter’s Obligations) (1) A renter shall uphold a fiduciary duty of care for the rented facility or installation.
(2) If the rented facility or installation is damaged due to the renter’s failure to uphold the duty of care provided in the foregoing paragraph (1) it shall be restored to its original state; however, if restoration is not possible or feasible, the renter shall be liable to pay damages accordingly.
(3) The renter shall not assign or sublease rights to the rented facility to a third party.
(4) The renter shall bear responsiblity for the management of exhibits, etc. for the rental.


CHAPTER IV RENTAL FEES Article 13 (Rental Fees) The Mayor shall charge and collect from the renter a rent assessed at 50/1,000 or more of the property value under Article 26 (1) of the Seoul Metropolitan Government Ordinance on the Management of Public Property and Goods. Detailed criteria for the charge of rental fees shall be determined by the relevant rules.

Article 14 (Rental Fee Discount) The Mayor may discount all or a part of the rental fees in the following cases:
1. Events hosted by the City: Waived
2. Events hosted by a corporation invested in or funded by the City: 20% discount

Article 15 (Payment and Return of Rental Fees) (1) The renter shall pay the rental fee within the period determined by the Mayor.
(2) The Mayor shall not return paid rental fees: Provided, however, that where the rented facility cannot be used due to force majeure such as a disaster, the Mayor may return all or a part of the rental fee as determined by rules.


CHAPTER V DDP Rental Deliberation Committee Article 16 (Establishment of the Committee) The Mayor shall establish a Committee for the deliberation of facility rentals, etc.

Article 17 (Composition of the Committee) (1) The Committee shall be composed of the following persons including one Chairperson in consideration of the gender ratio, with the majority being commissioned members:
1. Periodic rentals: approximately 7 people.
2. Occasional rentals: approximately 5 people.
(2) The Committee shall be composed in response to a rental application and be dissolved after the conclusion of deliberations.
(3) A commissioned member shall be appointed by the Mayor from among the following persons:
1. A person with extensive knowledge and experience in the relevant fields of expertise, such as the organizing of events;
2. An employee of an institution or organization relevant to design.
(4) The Chairperson shall be elected by and from among the commissioned members on the day of deliberation.
(5) Matters concerning the dismissal, exclusion, challenge, or recusal of members shall be governed by Articles 8-2 and 9 of the Seoul Metropolitan Government Ordinance on the Establishment and Operation of Various Committees.

Article 18 (Operation of the Committee) (1) The Chairperson shall chair meetings of the Committee (hereinafter referred to as “meetings”) and oversee its affairs.
(2) Meetings shall, in principle, be face-to-face (including video conferences); however, written deliberation may be substituted in cases involving urgent rental applications.
(3) Meetings shall be opened by the attendance of the majority of the members on the register, and shall make a resolution by the affirmative vote of the majority of the attending members.

Article 19 (Compensation) Members who attend a meeting may be paid compensation, travel expenses, and other necessary costs within the available budget under the Seoul Metropolitan Government Ordinance on the Payment of Committee Compensation and Travel Costs.


CHAPTER VI ENTRUSTMENT OF MANAGEMENT AND OPERATION Article 20 (Entrustment of Management and Operation) (1) To ensure the efficient management and operation of the DDP, the Mayor shall entrust such affairs to the Seoul Design Foundation: Provided, however, that entrustment may be made to another corporation, organization, etc. where deemed necessary by the Mayor.
(2) The head of an institution entrusted under paragraph (1) may, with the approval of the Mayor, determine or modify matters necessary for the details of operation.

This Ordinance shall enter into force two months after the date of its promulgation.
