SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON THE ESTABLISHMENT AND OPERATION OF VOCATIONAL EDUCATION AND TRAINING FACILITIES

Article 1 (Purpose) The purpose of this Ordinance is to prescribe the matters necessary to establish Seoul Metropolitan City’s vocational education and training facilities under Article 27 (1) of the National Lifelong Vocational Skills Development Act, and the matters necessary for their management and operation.<Amended on Dec. 30, 2022>


Article 2 (Scope of Application) Except as otherwise provided in other laws or ordinances, the establishment and operation of Seoul Metropolitan City’s vocational education and training facilities (hereinafter “training facilities”) shall be governed by this Ordinance.


Article 3 (Establishment) (1) The names and locations of the training facilities established and operated under this Ordinance shall be as set forth in the Annex.
(2) The following facilities may be installed in the training facilities:
1. Training and lecture halls;
2. Counseling and data rooms;
3. Auditoriums and meeting rooms;
4. Dormitories;
5. Cafeterias;
6. Facilities deemed necessary by the Seoul Metropolitan City Mayor (hereinafter referred to as the “Mayor”), such as fitness training rooms, childcare facilities, etc.;


Article 4 (Functions) Training facilities shall have the following main functions:
1. Vocational education and training programs;
2. Employment facilitation support programs;
3. Local activities support programs;
4. Programs deemed necessary by the Mayor, such as industrial and educational cooperation.


Article 5 (Admission Criteria, Etc.) (1) A person eligible to be admitted to a training facility shall be 15 years of age or older, and shall be registered as a resident of Seoul Metropolitan City at the time recruitment is announced.<Amended on May 22, 2023>
(2) The Mayor may give priority of admission to any of the following persons who have the qualifications specified in paragraph (1):<Amended on Oct. 8, 2015; Jan. 7, 2016; Sep. 30, 2021; May 20, 2024>
1. Eligible recipients under subparagraph 1 of Article 2 of the National Basic Living Security Act;
2. Persons eligible for employment assistance under Article 29 of the Act on the Honorable Treatment of and Support for Persons of Distinguished Service to the State;
3. Persons of distinguished service to the May 18 Democratization Movement under Article 4 of the Act on the Honorable Treatment of Persons of Distinguished Service to the May 18 Democratization Movement and Establishment of Related Organizations, their survivors, or family members;
4. Residents in social welfare facilities under Article 2 of the Social Welfare Services Act;
5. Persons eligible for support under Article 5 of the Single-Parent Family Support Act;
6. Persons in the second-lowest income bracket under subparagraph 10 of Article 2 of the National Basic Living Security Act.
(3) Notwithstanding paragraph (1), any of the following persons may be admitted to training facilities if recognized by the Mayor:<Amended on Jan. 7, 2016; Dec. 30, 2022; May 20, 2024>
1. Aliens and overseas Koreans;
2. Trainees entrusted by other institutions in connection with employment facilitation programs under subparagraph 2 of Article 4;
3. Trainees entrusted by Gyeonggi-do: Provided, however, that in such event the entrusted training shall be carried out at the Seoul Institute of Technology & Education (Southern Campus);
4. Trainees who participate in governmental programs to foster human resources, such as National Key Strategic Industry Vocational Training or Regional Industry-Aligned Workforce Training.


Article 6 (Education and Training Costs, Etc.) (1) The Mayor may collect from trainees in vocational education and training facilities the costs necessary for their education and training, such as education and training expenses, dormitory expenses, and meal expenses.
(2) The detailed matters necessary for the implementation of paragraph (1) shall be determined by the relevant rules. <Amended on May 20, 2024>
(3) The costs of trainees under Article 5 (3) 2 and 3 shall be borne by the entrusting institution.
(4) The Mayor may pay training allowances to trainees under Article 5 (2) as determined by the relevant rules within the available budget: Provided, however, that admission shall be canceled for any trainee who has been paid training allowances and admitted by deception or other improper means, etc.; and all or a part of the allowance shall be recovered. <Amended on Dec. 30, 2022; May 20, 2024>

Article 7 (Enrollment Quota, Etc.) The enrollment quota of vocational education and training facilities by facility and department shall be determined by the relevant rules in consideration of the size and capacity, etc. of each facility or department. <Amended on Dec. 30, 2022>


Article 8 (Entrustment of Operations) (1) The Mayor may entrust all or a part of the operation of vocational education and training facilities to corporations, organizations, or individuals.
(2) The entrustment of the operation of vocational education and training facilities under paragraph (1) shall be by public invitation to tender.
(3) The matters necessary for the procedures, means, etc. of entrustment of vocational education and training facilities operations, other than those in paragraph (2), shall be governed mutatis mutandis by the Seoul Metropolitan Government Ordinance on the Entrustment of Administrative Affairs to the Private Sector.


Article 9 (Evaluation of Vocational Training Projects) (1) The Mayor shall evaluate vocational education and training facilities under Article 21 of the Vocational Education and Training Promotion Act.
(2) An evaluation of a vocational education and training facility under paragraph (1) shall include the following:
1. Current state of the vocational education and training facilities and equipment;
2. Current state of the vocational education and training faculty and employees;
3. Operational status of the vocational education and training courses;
4. Status of trainees’ careers and employment;
5. Level of satisfaction of trainees and enterprises;
6. Matters deemed necessary by the Mayor, such as industrial and educational cooperation and contribution to local communities.


Article 10 (Establishment and Functions of the Integrated Steering Committee) The Mayor shall establish the Integrated Steering Committee for Seoul Metropolitan City Institutes of Technology & Education (hereinafter referred to as the “Committee”) to operate efficiently, and provide support for, the integrated management of occupational education and training facilities. <Amended on Dec. 31, 2019>
1. Matters concerning the reasonable operation and integrated management of the Institutes of Technology & Education;
2. Matters concerning the adoption or improvement of new vocational education and training policies;
3. Other matters necessary for vocational education and training projects.

Article 11 (Composition of the Committee) (1) The Committee shall be composed of approximately 15 members, including one Chairperson and one Vice-Chairperson.
(2) The Mayor shall appoint or commission members of the Committee from among the following persons: <Amended on May 20, 2024>
1. A person who has extensive insights into, and expertise and experience in, vocational training, such as an academic, expert, or the representative of a civic organization or a relevant institution in the field of vocational education and training;
2. Members of the Seoul Metropolitan City Council;
3. A Seoul Metropolitan Government director in employment affairs and a director in charge of financial affairs;
4. The head of a Seoul Institute of Technology & Education.
(3) The Chairperson is elected by and from external outside members; there shall be a secretary to handle Committee affairs, with the secretary being the head of the competent office or bureau.
(4) A member’s term of office shall be two years, and it may be renewed only once, while the term of office of a member who is a public official shall be the period in office. <Amended on May 20, 2024>

Article 12 (Members’ Compensation and Travel Costs) The compensation and travel costs to be paid to members who participate in meetings shall be governed by the Seoul Metropolitan Government Ordinance on the Payment of Committee Compensation and Travel Costs.

Article 13 (Facility Rental Fees, Etc.) (1) An entrusted entity may grant approval to an entity seeking to rent part of a vocational education and training facility to the extent that such rental does not interfere with the vocational education and training entrusted by the Mayor, and shall impose and collect rental fees accordingly. In such event, the rental approval and the imposition and collection of rental fees shall be limited to athletic fields or vocational education and training facilities for national technical qualification examinations, etc.<Amended on Oct. 4, 2013>
(2) An entrusted entity shall pay the Mayor the collected rental fee revenue.

Addendum <No. 9287, May 20, 2024>
This Ordinance shall enter into force on the date of its promulgation: Provided, however, that the amended Article 5 (3) 3 and the Annex shall enter into force on March 1, 2025.
