SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON ENCOURAGEMENT OF ORGAN AND TISSUE DONATION REGISTRATION

CHAPTERⅠGENERAL PROVISIONS Article 1 (Purpose) The purpose of this Ordinance is to provide for matters relating to the establishment and operation of the Seoul Metropolitan Government Committee on the Promotion of Organ and Tissue Donation Campaigns and matters relating to the honorable treatment and support of organ and tissue donors, so as to encourage registration for organ and tissue donation.

Article 2 (Scope of Application) Except as otherwise provided for in Acts and subordinate statutes, this Ordinance shall apply with respect to organ and tissue donation.

Article 3 (Definitions) The definitions of terms used in this Ordinance shall be as follows:
1.The term “organ and tissue” means any human internal organ and other tissue needed for transplant for the purpose of recovery of any damaged or defunct function, as provided for in subparagraph 1 of Article 3 of the Organs, etc. Transplant Act (hereinafter referred to as the “Act”);
2.The term “organ or tissue donor” means any person who donates any specific organ or tissue from his/her body without consideration, for the purpose of functional recovery of another person’s organ or tissue, as registered pursuant to Article 14 of the Act;
3.The term “potential organ or tissue donor” means any person who has indicated his/her intention to donate his/her own organ or tissue at the time of his/her brain death or death in the future, as registered pursuant to Article 15 of the Act;
4.The term “information desk for organ donation” means any desk that is established within a public facility readily available to citizens for the purposes of receiving applications from potential organ or tissue donors and communicating such applications to organ transplant registration institutions pursuant to Article 13 of the Act.


CHAPTERⅡSEOUL METROPOLITAN GOVERNMENT COMMITTEE ON PROMOTION OF ORGAN AND TISSUE DONATION CAMPAIGNS Article 4 (Establishment of Committee) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the “Mayor”) may establish the Seoul Metropolitan Government Committee on the Promotion of Organ and Tissue Donation Campaigns (hereinafter referred to as the “Committee”) to promote understanding of and encourage organ and tissue donation.

Article 5 (Constitution of Committee) (1) The Committee shall be comprised of not more than 15 members including one chairperson and one vice chairperson, and Vice Mayor Ⅰ for Administrative Affairs shall serve as the chairperson and the vice chairperson shall be elected by mutual vote from among members of the Committee.
(2) Members of the Committee shall be commissioned or appointed by the Mayor from among the following persons:
1. Two members of the Seoul Metropolitan Council;
2. Public officials of Grade III or higher who belong to the department of health or other health-related department of the Seoul Metropolitan Government (hereinafter referred to as the “City”);
3. Leaders of religious organizations;
4. Persons recommended by directors of hospitals or the president of the Medical Association;
5. Heads of vocational organizations;
6. Representatives of related civil organizations;
7. Journalists, sports persons, and artists;
8. Other persons who are recognized by the Mayor as having rendered distinguished service to organ and tissue donation campaigns.

Article 6 (Functions of Committee) The Committee shall deliberate on the following:
1. Basic policies for organ and tissue donation campaigns;
2. Cooperation with organ transplant registration institutions;
3. Publicity activities relating to organ and tissue donation campaigns;
4. Other matters the chairperson tables at the Committee as necessary to encourage registration for organ and tissue donation.

Article 7 (Terms of Office of Members) The term of office of a commissioned member shall be two years, which is renewable: Provided, That the term of office of a member who is appointed as successor to a vacancy shall be the remainder of his/her predecessor’s term of office.

Article 8 (Operation of Committee) (1) The Committee shall meet in regular sessions and special sessions; and a regular session shall be held once a year and a special session shall be convened by the chairperson as needed.
(2) A simple majority of the members of the Committee shall constitute a quorum at all sessions of the Committee, which shall adopt resolutions by a simple majority of the members present.
(3) The Committee shall have one secretary to deal with the general affairs of the Committee, who shall be the chief of the section that takes charge of the general affairs of the Committee.
(4) Allowances, travel expenses, etc. may be paid to members other than public officials of the Committee who attend meetings thereof, within budgetary limits.

Article 9 (Decommission of Members) The Mayor may decommission a member of the Committee even before his/her term of office expires, in any of the following cases:
1. Where he/she is not able to perform the duties of the Committee due to any disease or other cause;
2. Where he/she desires to resign from his/her office.


CHAPTERⅢINFORMATION DESK FOR ORGAN DONATION Article 10 (Establishment of Information Desks for Organ Donation) (1) The Mayor may establish information desks for organ donation to promote the participation in donation of organs and tissues.
(2) Detailed matters regarding the establishment and functions of information desks for organ donation shall be prescribed by the Enforcement Rule.


CHAPTERⅣHONORABLE TREATMENT AND ASSISTANCE Article 11 (Honorable Treatment and Assistance) (1) The Mayor may provide appropriate treatment and assistance for organ and tissue donors and potential organ and tissue donors to promote and encourage a culture of organ and tissue donation.
(2) Detailed matters regarding the honorable treatment of and assistance to organ and tissue donors and potential organ and tissue donors under paragraph (1) shall be prescribed by the Enforcement Rule.

Article 12 (Commission of Honorary Ambassadors for Organ and Tissue Donation Campaigns) (1) The Mayor may commission not more than 20 honorary ambassadors for organ and tissue donation campaigns, consisting of celebrities, persons of fame, etc. to publicize organ and tissue donation campaigns.
(2) Persons commissioned as honorary ambassadors for organ and tissue donation campaigns may carry out the following activities:
1. Appearance in public-interest TV commercials for organ and tissue donation campaigns;
2. Participation in events to publicize organ and tissue donation campaigns;
3. Free offering of portrait rights to publicity materials for organ and tissue donation.
(3) The Mayor may reimburse some of the expenses incurred in publicity activities of honorary ambassadors commissioned for organ and tissue donation campaigns.

ADDENDUM
This Ordinance shall enter into force on the date of its promulgation.
