SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON BEARING EXPENSES FOR ASSISTANCE BENEFITS FOR ACTIVITIES OF DISABLED PERSONS
Article 1 (Purposes)
The purpose of this Ordinance is to promote balanced development by prescribing the reasonable rates shared by and between Seoul Metropolitan Government and each autonomous Gu of Seoul Metropolitan Government of expenses for assistance benefits for activities of disabled persons that should be borne by local governments pursuant to Article 29 of the Enforcement Decree of the Act on Activity Assistant Services for Persons with Disabilities and Article 46 of the Enforcement Rule of the said Act pursuant to Article 390 of the said Act.
Article 2 (Bearing Expenses)
(1) The amount of expenses borne by local governments shall be the remaining amount after deducting the amount of expenses borne by the State pursuant to Article 46 of the Enforcement Rule of the Act on Activity Assistant Services for Persons with Disabilities, and the amount of expenses borne by Seoul Metropolitan Government (hereinafter referred to as "expenses borne by the City government") shall be as the rates to be borne specified in attached Table.
Article 3 (Notification of Rates of Expenses Borne by Local Governments)
Where the rates of expenses borne by the City government and expenses borne by the Gu government of each autonomous Gu in the relevant fiscal year are determined, the Mayor shall immediately prepare a table of the rates of expenses borne by the City government and expenses borne by the Gu government and notify the head of each Gu of such table.
Article 4 (Securing and Appropriating Funds for Expenses in Budget)
(1) The Mayor shall secure funds for expenses borne by the City government for assistance benefits for activities of disabled persons under Article 2 (1) and appropriate such funds in the budget.
Article 5 (Placing Money for Expenses for Benefits on Deposit)
The head of a Gu notified of the amount of expenses borne by the Gu under Article 3 shall place money for expenses for assistance benefits for activities of disabled persons on deposit in the receiving account of a depository institution by the 20th day of each month.
Article 6 (Formal Objections to Rates of Expenses Borne by Gu Government)
(1) Where the head of a Gu has an objection to the degree of satisfying standard financial demands of the relevant autonomous Gu calculated according to attached Table or the result of calculation of rates applicable to assistance benefits for activities of disabled persons, he/she may lodge a formal objection in writing with the Mayor within 10 days from the date he/she receives notification under Article 3.
