SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON URBAN DESIGN

Article 1 (Purpose) The purpose of this Ordinance is to contribute to the efficient conservation and development of the Seoul Special Metropolitan City by providing for matters necessary for the comprehensive and systematic improvement and management of the urban landscape of the City.

Article 2 (Definitions) The terms used in this Ordinance shall be defined as follows:
1. “Urban design” means planning and projects for urban design for the conservation and improvement of urban landscapes of the Seoul Special Metropolitan City (hereinafter referred to as the “City”), such as urban buildings and spaces, the shapes, contours, colors, lighting of urban facilities, and the harmony of urban facilities with their surroundings;
2. “Landscaping project” means a project for the rearrangement and improvement of street environments under the landscaping plan pursuant to the Landscape Act, a project related to regional forestation, a project for the formation and rearrangement of night views, a project for proper utilization of regional history and cultural features, or any other project implemented in accordance with residents' proposals or a landscaping agreement;
3. “Design Seoul Guidelines” means the basic direction, principles, and detailed standards for urban design of Seoul.

Article 3 (Basic Urban Design Plan) (1) The Mayor of the Seoul Metropolitan Government (hereinafter referred to as the “Mayor”) shall formulate and implement a basic urban design plan for the Seoul Special Metropolitan City (hereinafter referred to as the “basic urban design plan”) on a five-yearly basis in order to comprehensively and systematically improve and manage urban design.
(2) The basic urban design plan under paragraph (1) shall include the following matters:
1. The basic objectives of urban design of and direction-setting for promotion of the objectives;
2. The establishment and management of urban design for each region, each area, and each street;
3. The improvement of systems for urban design and main policies thereon;
4. Other matters necessary for the enhancement and improvement of the level of urban design.
(3) When the Mayor intends to formulate or revise the basic urban design plan, he/she shall bring the plan or revision to the Seoul Design Committee under Article 7 for deliberation.
(4) The Mayor shall, when he/she establishes or revises the basic urban design plan pursuant to paragraph (1) or (3), make a public announcement thereof through the official bulletin of the Seoul Metropolitan Government. [This Article Wholly Amended on Apr. 22, 2009]

Article 4 (Establishment of Design Seoul Guidelines) (1) The Mayor shall establish the Design Seoul Guidelines for the comprehensive and systematic improvement and management of the urban landscape.
(2) The Mayor, the head of each Gu, and the head of each public agency shall comply with the Design Seoul Guidelines in implementing a project for public facilities or the like.

Article 5 (Certification of Outstanding Public Designs, etc.) (1) The Mayor may take necessary measures, such as the operation of a system for the certification of outstanding public designs, in order to facilitate the development and dissemination of public designs.
(2) The Mayor and the head of each Gu may recommend designs certified as outstanding public designs pursuant to paragraph (1) when designs are examined.
(3) Procedures for the certification of outstanding public designs and the revocation of such certification under paragraphs (1) and (2) and other necessary matters shall be prescribed by rules.

Article 6 (Cooperation with Related Agencies) (1) The Mayor may request related agencies to formulate measures necessary for the promotion of urban design in order to ensure smooth implementation of urban design and may provide budgetary and administrative assistance for such purpose.
(2) The Mayor may cooperate with the related agencies under paragraph (1) in conducting activities for the production and distribution of materials necessary to enhance the level of urban design and the education and advertisement thereon.

Article 7 (Establishment of Committee) (1) The Seoul Design Committee (hereinafter referred to as the “Committee”) shall be established under the control of the Mayor to deliberate on the following matters in connection with the promotion of urban design: <Amended on Apr. 22, 2009>
1. Matters concerning the enactment and amendment of ordinances related to urban design of the Seoul Metropolitan City; <Amended on Apr. 22, 2009>
2. Matters concerning the formulation and implementation of the basic urban design plan for the Seoul Special Metropolitan City; <Amended on Apr. 22, 2009>
3. Matters concerning the Design Seoul Guidelines; <Newly Inserted on Apr. 22, 2009>
4. Matters concerning facilities subject to deliberation under Table 1 attached hereto (including facilities on which the head of an autonomous Gu or any other public agency requests the Committee to deliberate) and designs of a project for the development of street environments or a landscaping project; <Amended on Apr. 22, 2009; Jul. 15, 2010>
5. Matters subject to deliberation by the Landscape Committee under Article 24 (1) of the Landscape Act; <Newly Inserted on May 29, 2008; Apr. 22, 2009>
6. Matters concerning the certification of outstanding public designs; <Amended on Apr. 22, 2009>
7. Matters specified as being subject to deliberation by the Committee pursuant to any other Ordinance; <Newly Inserted on Jul. 15, 2010>
8. Other matters that the Mayor considers necessary for the promotion of urban design.
(2) Products designated as outstanding Seoul public designs and those designated as standard designs of the Seoul Special Metropolitan City shall be excluded from matters subject to deliberation under the subparagraphs of paragraph (1). <Newly Inserted on Jul. 15, 2010>
(3) The Committee shall be requested to give advice on the following matters in connection with the promotion of urban design: <Newly Inserted on Apr. 22, 2009>
1. Matters on which advice by the Landscape Committee shall be sought pursuant to Article 24 (2) of the Landscape Act; <Newly Inserted on Apr. 22, 2009>
2. Matters concerning the formulation and implementation of the basic urban design plan of each autonomous Gu; <Newly Inserted on Jul. 15, 2010>
3. Other matters that the Mayor considers necessary for the promotion of urban design. <Newly Inserted on Apr. 22, 2009>
(4) The head of each Gu may establish the Design Committee (hereinafter referred to as the “Gu Committee”) under his/her control to deliberate on or give advice on the following matters in connection with the promotion of urban design: <Newly Inserted on Apr. 22, 2009>
1. Matters concerning designs of facilities, etc. included in a project implemented by the autonomous Gu with the total cost of not more than 500 million won; <Newly Inserted on Apr. 22, 2009; Jul. 15, 2010>
2. Matters concerning the enactment and amendment of ordinances of the autonomous Gu on urban design; <Newly Inserted on Jul. 15, 2010>
3. Matters concerning the formulation and implementation of the basic urban design plan of the autonomous Gu. <Newly Inserted on Jul. 15, 2010>
(5) The head of each Gu may prescribe detailed matters concerning the operation of the Gu Committee by Ordinance of the autonomous Gu. <Newly Inserted on Apr. 22, 2009>

Article 8 (Composition of Committee) (1) The Committee shall be comprised of not more than 100 members, including one chairperson, one vice chairperson, and three sectional committee chairpersons. <Amended on Apr. 22, 2009; Jul. 15, 2010>
(2) The Mayor shall serve as the chairperson of the Committee, and the head of the Design Seoul Headquarters shall serve as the vice chairperson. <Amended on Apr. 22, 2009; Jul. 15, 2010>
(3) Members of the Committee shall be appointed or commissioned by the Mayor from among related public officials and persons who have abundant knowledge and experience in architecture, urban planning, landscaping, plastic arts, colors, environment, lighting, or the like. <Newly Inserted on Jul. 15, 2010>
(4) The term of office for commissioned Committee members shall be two years, but may be renewed only once: Provided, That the term of office for a Committee member who fills a vacancy shall be the period remaining on his/her predecessor's term. <Amended on Apr. 22, 2009>

Article 8-2 (Exclusion of and Voluntary Avoidance of Committee Members) (1) The Committee shall exclude a Committee member in any of the following cases from the deliberation and advisory service on the case at issue:
1. If a Committee member has provided or provides services or an advisory service, or has carried out or carries out research or the like in connection with the case brought to the Committee for deliberation or advice;
2. If a Committee member has direct interests in the case brought to the Committee for deliberation or advice.
(2) The Committee chairperson shall notify the committee member concerned of a matter under paragraph (1) before opening a meeting of the Committee and shall exclude the committee member from the deliberation on the item at issue if the Committee member concerned files an application for abstention.

Article 8-3 (Dismissal of Committee Members) The Mayor may dismiss a Committee member in any of the following cases from office even before the expiration of his/her term of office, and the term of office for a Committee member newly commissioned to fill the vacancy shall be the period remaining on his/her predecessor's term:
1. If a Committee member has difficulty performing his/her duties due to an illness that requires long-term medical treatment or an overseas travel for not less than six months;
2. If a Committee member desires to be voluntarily dismissed for office;
3. If a Committee member is held incompetent to perform his/her duties due to his/her inappropriate demeanor or on any other ground.

Article 9 (Chairperson's Duties) (1) The Committee chairperson shall represent the Committee and shall have overall control over the Committee's affairs.
(2) If the Committee chairperson is unable to perform his/her duties due to a cause or event beyond his/her control, the vice chairperson or a sectional Committee chairperson shall act on behalf of the Committee chairperson, whereas if a sectional Committee chairperson is absent, the chairperson shall be elected by and from among Committee members present at the meeting. <Amended on Jul. 15, 2010>
(3) The Committee shall have a secretary to carry out administrative matters, and the officer responsible for public designs shall serve as the secretary. <Amended on Jul. 15, 2010>

Article 10 (Meeting) (1) The Committee chairperson shall convene a meeting whenever deemed necessary and shall preside over the meeting.
(2) A meeting shall be comprised of a total of 20 Committee members, including Committee members designated by the Committee chairperson for each meeting.
(3) A meeting shall adopt a resolution with the attendance of the majority of the members under paragraph (2) and by a concurrent vote of a majority of the Committee members present at the meeting.

Article 11 (Sectional Committees) (1) The Committee chairperson shall establish the following sectional Committees in order to efficiently carry out the Committee's affairs:
1. Sectional Committee I: It shall deliberate on and give advice on matters under Article 7 (1) 4 (excluding matters related to public buildings under Table 1-3 attached hereto), Article 7 (1) 5 (excluding the formulation, amendment, and approval of a landscaping plan), and Article 7 (1) 6 and (3) 1 and 2;
2. Sectional Committee II: It shall deliberate on and give advice on matters related to public buildings under Table 1-3 attached hereto among matters under Article 7 (1) 4;
3. Sectional Committee III: It shall deliberate on matters concerning the installation and alteration of scenic lighting on the walls of buildings.
(2) The chairperson of each sectional Committee shall be elected by and from among members of the Seoul Design Committee.
(3) Each meeting of a sectional Committee shall be formed with not less than seven members of the Committee.
(4) Matters deliberated on and resolved by a sectional Committee shall be deemed to have been deliberated on and resolved by the Committee.
(5) As to the meetings and operation of sectional Committees, Articles 9, 10, and 12 through 14 shall apply mutatis mutandis.

Article 12 (Keeping on Minutes of Meetings, etc.) The Committee shall prepare and keep minutes of meetings or written deliberations and resolutions and may assign stenographers to prepare minutes of meetings.

Article 13 (Request for Cooperation) The Committee may, if necessary in performing its duties, summon a related public officer, an appropriate expert, or an interest party to attend a meeting to hear his/her opinion or request a related agency, organization, or the like to submit necessary data.

Article 14 (Allowances) Committee members, experts, etc. who attend a meeting of the Committee may be reimbursed for actual expenses, including allowances and travel expenses, within budgetary limits: Provided, That the foregoing shall not apply to public officials who attend a meeting in direct connection with their duties.

Article 15 (Detailed Operating Rule) Except as provided for in this Ordinance, matters concerning the operation of the Committee and the sectional Committees shall be prescribed by the chairperson through resolution of the Committee.

The amended provisions of Article 7 (3) regarding the deliberation and advisory service of each Gu Committee shall become applicable as at the time this Ordinance is enacted and the Committee is formed pursuant to paragraph (4) of the aforesaid Article.

The Seoul Metropolitan Government Ordinance on the Establishment and Operation of the Urban Environment Design Committee is hereby repealed.
