SEOUL METROPOLITAN GOVERNMENT ORDINANCE ON LIVING WAGE

Article 1 (Enforcement Date) This Ordinance shall enter into force on the date of its promulgation.

Article 2 (Transitional Provisions) Notwithstanding the provisions of Article 1, the initial living wage shall apply retroactively from January 1, 2015 and thereafter.

Article 3 (Eligible Persons) The persons eligible for living wage shall be determined by the Mayor of the Seoul Metropolitan Government (hereinafter referred to as the "Mayor") through deliberation by the Living Wage Committee (hereinafter referred to as the "Committee"), from among the following persons:
1. Workers employed by the Seoul Government or a City-invested or City-funded agency affiliated to the Seoul Government;
2. Workers employed by an institution or company to whom the Seoul Government entrusts its administrative functions or that executes a construction project for the Seoul Government or provides services to the Seoul Government;
3. Workers employed by a subcontractor of any of the institutions and companies referred to in subparagraph 2.

Article 4 (Establishment of Living Wage Committee) (1) The Mayor shall establish and operate the Living Wage Committee of the Seoul Metropolitan Government (hereinafter referred to as the "Committee") in order to deliberate on the efficient implementation of living wage and other important matters.
(2) The Committee shall deliberate on the following matters:
1. The level of living wage, the ground for calculating the level of living wage, etc.;
2. The extent of persons eligible for living wage and matters concerning phased application;
3. Actual situation of operation of the living wage system and research and suggestions for improvements;
4. Other matters that the Mayor deems important for living wage.
(3) The Committee may conduct various activities to determine the reasonable level of living wage and improvements, such as consulting service, surveys, and research.

Article 5 (Composition of Committee) (1) The Committee shall be composed of not less than five but not more than eleven members, including one chairperson and one vice chairperson, and the chairperson and the vice chairperson shall be elected by and from among committee members.
(2) Committee members shall be appointed or commissioned by the Mayor, from among the following persons, but the number of the committee members referred to in subparagraphs 3 through 5 shall constitute the majority of the total number of committee members:
1. Two members of Seoul Metropolitan Council;
2. The head of the office/division in charge of living wage and the head of the office/division in charge of budgeting in the Seoul Metropolitan Government;
3. Relevant experts who work for a school, research institute, or nonprofit organization;
4. Persons who have knowledge and experience in living wage, working conditions, etc.;
5. Other persons deemed necessary for enhancing expertise for deliberation.
(3) The term of office of each ex officio member shall correspond to the period during which he/she holds the relevant position, while the term of office of each commissioned member shall be two years but may be renewed consecutively only once.

Article 6 (Operation of Committee) (1) The chairperson of the Committee shall represent the Committee and administer all business affairs of the Committee.
(2) The vice chairperson shall assist the chairperson and shall act on behalf of the chairperson, if the chairperson is unable to perform his/her duties due to an unavoidable cause or event.
(3) When the chairperson intends to convene a committee meeting, he/she shall notify each committee member of the date, time, place, and items on the agenda of the meeting by not later than seven days before the opening date of the meeting: Provided, That the foregoing shall not apply to emergency cases.
(4) A meeting shall be duly formed with the attendance of the majority of current committee members, and a resolution shall be adopted by affirmative votes of the majority of the members present at the meeting.
(5) If the chairperson deems it necessary for seeking advice on an item on the agenda or for mediation, he/she may summon public officials in the relevant office/division, relevant experts, or stakeholders to attend a committee meeting to hear their opinions.
(6) Committee meetings shall be open to the public, and minutes of each meeting shall be taken and made available for public inspection: Provided, that the committee may resolve to hold a closed meeting or restrict public inspection of minutes of a meeting, if it concludes that public disclosure is inappropriate.
(7) Allowances and travel expenses may be paid to committee members who attend a committee meeting in accordance with the Seoul Metropolitan Government Ordinance on Payment of Allowance and Travel Expenses for Committees, within budgetary limits.

Article 7 (Determination of Living Wage) (1) The Mayor shall formulate implementation schemes with respect to the reasonable level of living wage, a budget therefor, etc. and shall determine living wage through the Committee's deliberation.
(2) The Committee shall take into account the following factors in deliberating on living wage:
1. The economic and labor environment, including the inflation rate in the Seoul Government and the level of average household expenditure of workers;
2. The minimum wage publicly notified each year under the Minimum Wage Act;
3. Other matters deemed necessary for determining living wage.
(3) The Mayor shall give public notice of the following matters regarding living wage by December 31 each year after the Committee's deliberation:
1. The level of living wage;
2. Persons eligible for living wage;
3. Other matters of which citizens shall be informed, such as improvements of living wage.
(4) The living wage applicable to the period from January 1 to December 31 each year shall be renewed every year.

Article 8 (Encouragement of Application of Living Wage) (1) The Mayor shall endeavor to search for persons eligible for living wage and to expand the extent of such persons.
(2) The Mayor may execute an agreement on the application of living wage with a party who intends to sign a contract for entrustment, service, or procurement with the Seoul Metropolitan Government and may preferentially treat companies that apply living wage.
(3) The Mayor shall sincerely conduct activities for guidance and supervision over the current status of implementation of living wage.

Article 9 (Enforcement Rule) Matters necessary for the enforcement of this Ordinance shall be prescribed by rule.

Article 10 (Application Mutatis Mutandis) Relevant statutes shall apply to the matters not prescribed by this Ordinance.
